RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute
for and on behalf of the City of Lubbock, an Amendment to Public Infrastructure Funding
Agreement, by and between the City of Lubbock and Lubbock Economic Development
Alliance and related documents. Said Agreement is attached hereto and incorporated in this
resolution as if fully set forth herein and shall be included in the minutes of the City Council.

AMENDMENT TO
PUBLIC INFRASTRUCTURE FUNDING AGREEMENT
BETWEEN THE CITY OF LUBBOCK AND
LUBBOCK ECONOMIC DEVELOPMENT ALLIANCE
WHEREAS, pursuant to an Agreement (the "Original Agreement") dated on or
about January 22, 2019, Resolution No. 2019-R0023, the City of Lubbock (the "City")
and Lubbock Economic Development Alliance ("LEDA") entered into an agreement
whereby LEDA agreed to perform the construction and development of certain public
infrastructure within the Lubbock Business Park, and the City agreed to reimburse LEDA
for said performance;
WHEREAS, the funding amount, as described in Exhibits A and B of the Original
Agreement, is to be amended;
WHEREAS, on September 5, 2019, the Lubbock Business Park Tax Increment
Financing Reinvestment Zone #3 Board of Directors recommended approval of this
Amendment to the Original Agreement; and
WHEREAS, the City and LEDA now desire to replace Exhibits A and B in the
Original Agreement under the terms and conditions set forth in the Original Agreement.
NOW, THEREFORE, for and in consideration of the premises and the mutual
covenants herein contained, the City and LEDA agree to modify the Original Agreement
as follows:
1. The Original Agreement shall be amended by replacing"Exhibit A" with
"Exhibit A-1", attached to this Amendment to Agreement and made a part
hereof-'for all purposes.
2. The Original Agreement shall be amended by replacing"Exhibit B" with
"Exhibit B-1", attached to this Amendment to Agreement and made a part
hereof for all purposes.
3. Except as expressly modified or amended herein, all terms and provisions
of the Original Agreement shall be and remain in full force and effect as
therein written.
IN WITNESS HEREOF, the parties have executed this Agreement as of this 24th
day of Septernhe,• 2019.

Project Scope:
Construction of a City of Lubbock standard"Industrial"street at approximately the mid-point between North Ivory Ave and North Nutmeg Avenue
within the Lubbock Business Park. The proposed street would extend from Lubbock Business Park Blvd.,south approximately 600 feet. The new street
is proposed to be 42R wide from face of curb to race of curb,accommodating one lane of traffic in each direction and accommodating width for a central
turn lane.
Project Justification:
Development at the Lubbock Business Park continues to increase. Adding paving and street lights along the west side of Lot 22 will allow better access
and road conditions for a prospective tenant on that piece of property.
Project History:
$500,000 was appropriated in FY 2017-18 Budget Amendment No.22,Ord.No.2018-00092,August 23,2018.
$180,000 was appropriated in FY 2018-19 Budget Amendment No.21,Ord.No.2019-00092,August 13,2019
