Said Amendment is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. W IL�ZK�lu1u 1��y I:�� 1_L�T.YI LEASE EXTENSION This Amendment to Commercial Lease ("Amendment") 13350 is dated effective February 27 , 2024, by and between BR GRIFFIN OIL & GAS, TLD ("Landlord") and CITY OF LUBBOCK ("TenanY'). The parties agree as follows: RECITALS WHEREAS, Landlord and Tenant entered into that certain Commercial Lease dated March 23, 2017 for the lease of the property described as LOT 3, RIl' ADDTTION, City of Lubbock, Lubbock, County, Texas for a primary term of two (2) years ternunating on February 28, 2019 with an option to automatically renew for a total of five (5) additional one (1) year terms (hereinafter referred to as "Lease"). WHEREAS, the Lease is set to expire on March 18, 2024. WHEREAS, Landlord and Tenant now desire to amend the Lease by renewing and extending the term of the Lease, as further detailed below. NOW TI-IEREFORE, the Landlord and Tenant agree to amend the Lease as follows: AGREEMENT 1. The terms and conditions of the Lease are hereby amended by amending the following provisions: The primary term of the lease shall be twenty-four (24) months commencing on March 17, 2024, and ending at 11:59 p.m. on the 16`h day of March 2026, upon the following terms, conditions, and covenants: 3. RENEWALS. This lease shall be automatically renewable at the end of the primary term for five (5) consecutive one-year terms upon the same conditions and covenants contained herein unless either party shall give written notice of a desire to terminate the lease at least thirty (30) days prior to the expiration of the primary term or any subsequent renewal period. 2. Except as expressly amended hereby, the Lease remains unchanged and in full force effect. 3. In the event of a conflict between the terms of the Lease and this Amendment, the provisions of the Lease shall control. 4. This Amendment may be executed and delivered in any number of counterparts, each of which so executed and delivered will be deemed an original and all which shall constitute one and the same instrument. Either party may deliver its signature to the other via facsimile or electronic transmission (such as in the form of a PDF), and any signature so delivered shall be binding on the delivering party.
