RESOLUTTON
WHEREAS, Lubbock Power & Light ("LP&L") is the municipally owned electric
ility of the City of Lubbock ("City");
WHEREAS, pursuant to Chapter 1, Article XII, Section 1, of the City's Charter, the
Council of the City of Lubbock has exclusive jurisdiction to approve all of LP&L's
ery system and discretionary rates;
WHEREAS, the LP&L Electric Utility Board ("EUB") is charged with approving
nd submitting a delivery system electric rate schedule (`Rate Schedule") for LP&L to the
'ity Council pursuant to Section 2.03.415(a) of the Code of Ordinances of the City of
ubbock by filing them with the City Secretary;
WHEREAS, the Electric Utility Board pursuant to Tex. Util. Code §40.055(a) may,
required from time to time, submit to the City Council for its approval amendments to
; Rate Schedule/Tariff pursuant to §2.03.415(a) of the Code of Ordinances of the City of
WHEREAS, the current version of LP&L's Retail Delivery Service Tariff

WHEREAS, LP&L has identified changes that need to be made to three rate
dules in the October 1, 2023, version of the Delivery Service Tarif£ Rate Schedule I

WHEREAS, Rate Schedules I and K will no longer be functional after the transition
to the retail market is complete because Retail Electric Providers will be selling energy to
customers and LP&L will only be delivering energy, and thus, cannot transact with
customers regarding excess power customers' distributed generation systems might produce.
In addition, both Rate Schedules I and K include a Delivery System Availability Base
Charge of $30.00 per Meter per Month that was implemented to partially recover costs from
customers whose distributed generation facilities were used to offset their purchased energy
costs from LP&L. To address these issues, Rate Schedules I and K are being suspended and
customers transitioning to or currently assigned to Rate Schedule I will be moved to the
Residential Rate Schedule and Rate Schedule K will be moved to the Secondary Service
Less Than Or Equal to l OkW Rate Schedule with no Availability Base Charge;
WHEREAS, Rate Schedule P reflects an incorrect Delivery System Charge of
$0.26824 per kWh, which is being reduced to the correct charge of $0.17490 per kWh;
WHEREAS, these changes to the Delivery Service Tariff will conform LP&L's
ivery service rates to the competitive market structure and ensure that customers are
ng charged appropriately;
WHEREAS, LP&L desires to amend the Delivery Service Tariff as set out herein,
nd Chapter 1, Article XII, Section 1 of the City of Lubbock Charter and Section 2.03.415(a)
f the Code of Ordinances of the City of Lubbock require that the EUB and the City Council
pprove these changes for them to be effective.
OW, THEREFORE:
E IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Electric Utility Board of the City of Lubbock has approved the
endments to the Delivery Service Tariff, as attached hereto and recommends approval
the City Council of the City of Lubbock;
IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the rates approved under this resolution supersede those passed by the City
Council by resolution No. 2023-R0199;
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the City Council of the City of Lubbock hereby approves the attached Rate
Schedules from LP&L's Delivery Service Tariff which shall replace the versions of the Rate
Schedules previously approved, to be effective as of March l, 2024.

WHEREAS, Lubbock Power & Light ("LP&L") is the municipally owned

WHEREAS, pursuant to Chapter 1, Article XII, Section 1 of the City's

Schedules and related pages be filed with the City Secretary as required by
Section 2.03.415(a) of the Code of Ordinances of the City of Lubbock and be
deemed filed with the City Secretary when this R.esolution and the attached
tariff pages are delivered to the City Secretary;
BE IT FURTHER RESOLVED BY THE ELECTRIC UTILITY BOARD
OF THE CITY OF LUBBOCK:
THAT upon approval by the City Council of the City of Lubbock, the
attached Rate Schedules from LP&L's Delivery Service Tariff shall replace the
versions of the Rate Schedules previously approved, to be effective as of March
1, 2024.

CHAPTER l: DEFINITIONS
The following definitions apply to the Access Tariff of City of Lubbock, by and through
Lubbock Power & Light (LP&L) and to any Access Agreements made under the Access Tariff, unless
specifically defined otherwise therein.
ACCESS. The ability of a Competitive Retailer to deliver electric energy to Retail Customers at the Point
of Supply.
ACCESS AGREEMENT. The Access Agreement set forth in this Access Tariffthat must be executed by
LP&L and Competitive Retailer before the Competitive Retailer can deliver Electric Power and Energy to
LP&L's Delivery System and provide Electric Power and Energy to Retail Customers connected to
LP&L's Delivery System.
ACCESS TARIF�'. The document filed with and approved, except for Chapters 2 and 5, by the PUC
pursuant to which LP&L provides Access to Competitive Retaiiers. It is comprised of Rate Schedules,

I. RESiDENT1AL WITH DISTRIBUTED GENERAT[OlV DELIVERY SYSTEM SERVICE
APPLICABLE: This schedule is applicable to Delivery 5ervice for residential
purposes with Distributed Generation, upon execution of an approved
Interconnection Agreement, (which may include a small amount of
non-residential usage incidentai to residential usage) of a permanent
nature to Individual Private Dwellings (including their appurtenant
structures) and to individually metered apartments when such
Delivery Service is to one Point of Delivery and measured through
one Meter and is not for shared or resale purposes. Residential
Service is limited to one Individual Private Dwelling per platted
parcel of land or postal delivery address.
If a premise is primarily used for non-residential purposes, Delivery
Service will be provided under the LPBtL's appropriate Secondary
Service or Primary Service rate schedule.

but not limited to water welis, electric gates, bams, garages, boat
docks, or recreational vehicle parks, br for structures on the platted
parcel of land requiring a separate Meter.

adopted by the Director of Electric Utilities.

K. SECONDARY SERVICE LESS THAN OR EQUAL TO 10 KW
WITH DISTRIBUTEQ GENERATION DELIVERY SYSTEM SERVICE
APPLICABLE: This schedule is available to Customers requesting Delivery
Service for non-Residential Purposes upon approved
Interconnection Agreement with Distributed Generation at
Secondary Distribution Voltage levels with a peak demand less
than or equal to 10 kW when such Delivery Service is to one
Point of Delivery and measured through one Meter and is not for
shared or resale purposes.
LP&L will evaluate Customers' demand once per year in October.
If a Customer's demand exceeds l OkW at any time during that
year, the Premises will be assigned to the Secondary Service
Greater than l OkW until the next evaluation.
RATE: Delivery System Availability Charge: $30.00 per Meter per
