HomeMy WebLinkAboutOrdinance - 2019-O0136 - Amending Article 36.04 - Establishing A Fee For Commercial Driveway Inspections - 09/24/2019 First Reading Second Reading September 10,2019 September 24, 2019 Item No. 6.18 Item No. 6.11 ORQ1NANCE NO.,)njo_nn136 AN ORDINANCE AMENDING ARTICLE 36.04 "CONSTRUCTION, ALTERATION AND REPAIR OF SIDEWALKS, CURBING, DRIVEWAYS AND GUTTERS" OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, ESTABLISHING A FEE FOR COMMERCIAL DRIVEWAY INSPECTIONS; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed fee shall be for the efficient handling of the accounting process regarding driveway inspections and for the cost management of commercial driveway inspections performed by city staff; and WHEREAS, the City Counsel of the City of Lubbock, Texas deems it in the best interest of the citizens of Lubbock to make the following amendments to Section 36.04.126(5); NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 36.04.126(5) of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: (5) All paved surfaces of city streets that are cut for the construction of commercial driveways shall be replaced by the contractor who caused the street cut and shall be inspected by, and repaired to the satisfaction of, the city. The contractor shall pay the city an administrative fee for the city's inspection services at the time of issuance of the building permit. The rate shall be as set forth and established in the adopted annual budget. SECTION 2. THAT should any paragraph, section, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of the Ordinance shall not be affected thereby. SECTION 3. THAT the City Secretary of the City of Lubbock, Texas, is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative means of publication provided by law.
