HomeMy WebLinkAboutResolution - 2019-R0359 - Hensel Phelps - 09/24/2019 Resolution No. 2019-RO359 Item No. 7.8 September 24, 2019 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City of Lubbock, Amendment No. 2 to the Construction Manager at Risk Contract 13705 for services related to the Lubbock Preston Smith International Airport terminal building modifications, by and between the City of Lubbock and Hensel Phelps, a Delaware general partnership of Austin, Texas, and related documents. Said Amendment is attached hereto and incorporated in this Resolution as if frilly set forth herein and shall be included in the minutes of the City Council. PO E, MAYOR ATTEST: Re cca Garza, City Secret ry APPROVED AS TO CONTENT: Kelly Cai pbell, Executive Director Airport APPROVED AS TO FORM: e erwhite, First Assistant City Attorney Rcs.Amcnd 2 Hensel Phelps Airport 9.4.2019 Resolution No. 2019-RO359 Amendment 2 To Agreement Between The City of Lubbock,TX And Hensel Phelps THIS IS THE SECOND AMENDMENT TO THE AGREEMENT dated and entered into the 12'day of April 2018 by and between the City of Lubbock ("City") and Hensel Phelps ("Contractor"), a Delaware general partnership, of Austin, Texas, (collectively "Parties") for providing construction manager at risk services for terminal building modifications at the Lubbock Preston Smith International Airport(LPSIA). WITNESSETH: WHEREAS, the Parties have determined the project work shall be taken in two phases: Phase I for the roof repair and/or replacement as contemplated in RFQ No. 18-13705-TF; and Phase 2 for all other remaining items necessary for the completion of LPSIA terminal building modifications, as included and described in the same RFQ. WHEREAS, this Second Amendment shall include work to be performed in Phase 2, as described above. This Second Amendment establishes the Guaranteed Maximum Price (GMP) and time for substantial for completion only for Phase 2 services. WHEREAS, in this Second Amendment, in accordance with Article 2, Section 2.2 of the agreement, Contractor proposes, for Phase 2 services only, the GMP of thirty-two million four hundred sixty-seven thousand three hundred sixty-seven dollars and 00/100 ($32,467,367.00) as supported by detailed information provided in Exhibit A, attached and incorporated herein. WHEREAS, in accordance with Article 2, Section 2.2 of the agreement, as a component part of the GMP, the time required for substantial completion proposed by Contractor is nineteen (19) months from receipt of the Notice to Proceed. WHEREAS, all other portions of the original Agreement and previous Amendments, if any, shall remain in place and are not altered by this amendment. NOW, THEREFORE, the City and Contractor agree to the following terms in this FIRST AMENDMENT: 1. The GMP for CMAR services for LPSIA terminal building modifications - Phase 2 shall be thirty-two million four hundred sixty-seven thousand three hundred sixty-seven dollars and 00/100($32,467,367.00); and 2. The time required for substantial completion for said Phase 2 services shall be nineteen (19) months from receipt of the Notice to Proceed.
