RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to accept for and
on behalf of the City of Lubbock a Dedication Deed in connection with certain real property
located in the Section 38, Block AK, GC & SF R.R. Co. Survey, Abstract No. 689, Tract 9A1
& 11 D, of the Lowery Subdivision, Lubbock County, Texas, to be utilized for streets, public
use, right of way, utilities, and other public purposes, and all related documents. Said
Dedication Deed is attached hereto and incorporated in this Resolution as if fully set forth
herein and shall be included in the minutes of the Council.

THAT DSE Properties, Ltd., a Texas Limited Partnership, herein called "GRANTOR", for
and in consideration of the sum of TEN AND NO/100 ($10.00) DOLLARS and other good and valuable
consideration, to him/her in hand paid by the CITI' OF LUBBOCK, TEXAS, a Home Rulc
Municipal Corporation, Grantor does hereby grant, sell, and convey to Grantee for public use forever
and for street right-of-way and utility purposes, the following described tract of land situated in
Lubbock County, Texas, as more particularly described in the attached Exhibit "A".
GRANTOR agrees to grant the properiy described in Exlubit "A" and releases the City of
Lubbock from the obligation of obtaining an appraisal under Chapter 21 of the Texas Property Code.
TO HAVE AND TO HOLD this above described premises, together with alI and singulaz the
rights and appurtenances thereto in anywise belonging unto the said public forever so long as said
premises aze used for public street purposes.

Field notes describing a 0.13 acre Right-of-Way out of the remainder of a called 183.607
acre tract of land located in Section 38, Block AK, of the GC 8 SF R.R. Co. Survey,
Lubbock County, Texas.
Being a 0.13 acre tract of land out of the remainder of a called 183.607 acre tract of land
described in a Warranty Deed with Vendor's Lien to DSE Development, LTD., recorded in
County Clerks File Number 2022008712, Official Public Records, Lubbock County, Texas, and a
Warranty Deed with Vendor's Lien to DSE Properties, LTD., recorded in County Clerk File
Number 2021043323, Official Public Records, Lubbock County, Texas, situated in Section 38,
Block AK, of the GC & SF RR Co. Survey, Lubbock, Texas, and is further described by metes
and bounds as follows;
BEGINNING at a 1/2 inch iron rod (N: 7,268,137.11', E: 910,495.20') Found for the Southeast
corner of this tract, and being the same as a corner for North Right-of-Way line of 43rd Drive (64
feet wide) as described in a Street Dedication Deed recorded in County Clerk File Number
2023009687, Of�icial Public Records, Lubbock County, Texas, from which a 1/2 inch iron rod
with �ed cap stamped "AMD Engineering" Found for a corner of said 43rd Drive, bears South
43° 18' 17" East, 42.32 feet;

THENCE South 87°57'28" East, along the South line of said Frenship East Addition, a distance
of 15.00 feet to a 60D nail with washer stamped "COBB FENDLEY BOUNDARY" (N:
7,268,500.59', E: 910,507.04') Set for the Northeast corner of this tract and being the same as
the Southwest comer of Tract C of said Frenship East Addition, from which a 1/2 inch iron rod
with red cap stamped "AMD Engineering" Found for the Southeast corner of said Tract C, bears
South 70°' 17'27" East, 427.57 feet;
THENCE South 01°51'57 West, a distance of 363.67 feet to the POINT OF BEGINNING and

Project Scope
Upland Avenue from 34th Street to 50th Street is currently a two-lane paved road and is designated in the
2018 Thoroughfare Master Plan to become a five-lane Principal Arterial (Modified). Continued growth in
west Lubbock has increased traffic demands along the Upland Avenue corridor from 34th Street to 50th
Street. This thoroughfare will include the ultimate design of a five-lane undivided thoroughfare with curb and
gutter, drainage, streetlights, sidewalk improvements, utility adjustment and right of way acquisition
services.
PrOjeCt Justification
On November 8, 2022, Lubbock voters approved
issuance of a$200 million street improvements
bond package for the purpose of providing
permanent public improvements. The funding will
acquire, construct and reconstruct street
improvements, including but not limited to
sidewalks, utility line relocations and traffic
signalization, necessary and related storm
drainage facilities, and the acquisition of land and
rights-of-way for the full width dedication.
