AN ORDIN.A}l:E ESTABLISHING BUILDING LINES ON THE EAST AND WEST SID&C3 OF
INDIANA .AVENUE BETWEEN 19TH STREET AND 20TH STREET, . .AND 3JRD STREET AND
35TH STREET AS MJRE PARTICULARLY IESCRIBED BY METES AND EOUNIS IN THE
BODY OF THIS ORDINANCE AND BEING GENERALLY PARALlEL WITH THE EXISTING
RIGHT-oF-WAY LINES OF INDIANA AVENUE BE'NEEN THESE STREETS; PROVIDING
THAT NO BUILDING OR OTHER STRUCTURE SHALL HEREAFTER BE ERECTED OR RE-
~TED OR SUBSTANTIALLY REPAIRED BETWEEN SOOH BUILDING LINES; REQUIR-
ING EXISTI:OO STRUCTURES ON OR BETWEEN THE BUILDI:OO LINES HEREIN E::JTAB-
LISHED ro CONFORM TO Stx:H BUILDING LINES WITHIN FIVE !EARS; DEFINING
BUILDING LINE AND PROVIDING THAT SETBACK REQUIREMENTS UNDER THE CITY'S
ZONING ORDINAIDE AND AMENDMENTS THERETO BE IETERMINED FROM THE BUILD-
ING LINES HEREIN ESTABLISHED; PROVIDING EXCEPTIONS FOR UTll.ITY EXTEN-
SIONS AND PUBLIC IMPRO~TS; PROVIDING A SAVINGS CLAUSE; EXPRESSLY
REPEALING ORDINANCES NOS. 1195, 1571, AND 1669; AUTHORIZING AND DI~T-
ING THE CITY SreRETARY-TRE.ASURER TO CAUSE PUBLICATION OF THIS ORDINANCE.
WHEREAS, Article 1105a, Revised Civil Statutes of Texas provides for
the establishment ot building lines on any part or side of any street in
the .City of Lubbock, said City of Lubbock having a population of more than
15,000; and,
WHEREAS, the City Commission finds that public convenience, safety
and necessity in the City of Lubbock requires that building lines or
right-of-ve,y lines be established on Indiana Avenue between the South
line of 19th Street and the North line of 20th Street, and the North
line of 33rd Street to the North line of 35th Street to prevent repair and
replacement of structures and trees in the I area between the building lines
so established, such areas being required in connection with the widening,
openii€ and improving that part of Indiana Avenue described more particu-
larly hereinafter in the body of this ordinance; and,
WHEREAS, the widening and the improvement ·Of said Indiana Avenue and
the establishment of such building lines are necessary and will ultimately
provide streets of desirable and adequate width which will aid in relieving
heavy traffic in congested areas in accordance with the City's comprehen-
sive plan and the City Planning Commission has recol!DD8nded such plan. The
City Commission further finds that such establishment at this time will pro-
mote economy; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. That a building line is hereby established on the East and
West sides of Indiana Avenue, lying between 19th Street and the North line
of 20th Street, and within the corporate boundaries of the City of Lubbock,
vhich East and Vest building lines are more particularly described as
follows, to-wit;
EAST SIDE:
BEGINNING at a point in the North line of 20th Street,

said point being 10 teet East of the Southwest corner
of Lot 13, Block 1, Maxwell Addition to the City ot
Lubbock;
THENCE North wi tb a line 10 feet East of and parallel
to the East line of Indiana Avenue, crossing Lots 13
and 12, Maxwell Addition to the City of Lubbock, to a
point in the South line of 19th Street, said point
being 10 feet East ot the Nortbwst corner of Lot 121 Block 1 1 Maxwell Addition.
WESI SIDE:
BEGINNING at a point in the North line of 20th Street,
said point being 10 feet West of the West line of
Indiana Avenue;
THENCE North with a line 10 feet West of and parallel
to the West line of Indiana Avenue 1 crossing Lots 16
and 1, Block +, of the West Lawn Addition to the City
ot Lubbock, to a point in the South line of 19th Street,
said point being 10 feet West ot the Northeast corner
ot Lot 1, Block 1, West Lavn Addition;
SECTION 2. That a building line is hereby established on the East and West
sides of Indiana Avenue lying between the points hereinafter described and
being between 33rd Street and 35th Street and within the corporate boundaries
ot the City of Lubbock, which East and 'West building lines are more particu-
larly described as follows, to-wit:
WEST SIDE:
BEGINNING at a p6int in the North line of 35th Street, said point
being 10 teet Eut of the Southwest corner of Lot 6, Hewett Addi-
tion to the City of Lubbock;
THENCE North with a line 10 feet East of and parallel to the
East line of Indiana Avenue, crossing Lots 6 and 5 of the
Hewett Addition, 34th Street, Lots 12 and 11, Block 4 1 West-
minister Heights Addition to a point in the South line of 33rd
Street, said point being 10 feet East of the Northwest corner
of Lot 11, Block 4, Weetminister Heights Addition.
BEGINNING at a point in ~the North-line of 35th Street, said
point being 10 feet West of the intersection of the North line
of 35th Street with the West line of Indiana Avenue;

-West line ot Indiana Avenue, crossing an undivided tract
of land, a distance of 262.5 teet to the South line of .34th
Street;
THENCE continuing North 10 feet West of and parallel to the
WeBt line of Indiana Avenue, crossing .34th Street, Lots 20
and 1, of the ~obnny and Jack Addition to the City of Lub-
bock, to a point in the South line of .3.3rd Street, said
point being 10 feet West of the Northeast corner of Lot 1 1
Johnny and Jack Addition.
S]lljTION .3. That no building or other structure shall hereafter be
erected, re-erected or substantially repaired and no new ~tructure or
pe.rts thereof shall be erected on that part of the street or land herein
designated within said building lines hereinabove described.
SlOOTION 4. That all structures on or between the building lines estab-
lished by this ordinance or extending in whole or in part within auch build-
ing linea are hereby required to confol"'l to tlie new building lines estab-
lished in Sections One (1) and Two (2) of this ordinanoe within five years
from the effective date of this ordinance.
SECTION 5. The term "building line" as used herein shall be construed
to mean •street right-of-way line,• and the setback requirements under the
City's Zoning Ordinance and all amendments thereto shall apply in addition
to the right-of-way lines or building lines herein established, it being
the intent and purpose of this ordinanoe to preserve all land vi thin the
building linea herein established for ultimate street purposes.
SECTION 6. The provision~ of this ordinance shall notappl.1' to any
officer, agent, employee or other person duly authorized by the State of
Texas and/or the City of Lubbock when performing any employment pursuant
to the widening, straightening or extension of the street and/ or right-of-
way contemplated by this ordinance or authorized utility extensions within
the right-of-way herein described.
SEX:TION 7. If any section, paragraph, subdivision, clause, phrase or
provision of this ordinance shall be judged iuvalid or held uneonstitutional,
the same shall not affect the validity of the reminder of this ordinance as
a whole or any part or provision thereof other than the part so decided to
be invalid or unconstit~tional.
SECTION 8. That Ordinance Nos. 1195, 1571 and 1669 are hereby expres-
sly repealed.
SEx:TlON 9. That the City Secretary-Treasurer is hereby authorized and
directed to cause to be published this ordinance, and the same shall become
effective from and after the last date of publication as provided by law.
