RESOLUTION AND ORDER
FOR
SPECIAL CITY ELECTION
WHEREAS, an initiating committee registered with the City Secretary on August 18, 2023, for
the purpose of proposing passage of an ordinance to create "Freedom Act Lubbock" and to
reduce enforcement of low-level marijuana offenses within the City of Lubbock and (the
Proposed Ordinance"); and
WHEREAS, said initiating committee did thereafter within the time limit prescribed by the
Lubbock City Charter file with the City Secretary a petition supporting the Proposed
Ordinance; and
WHEREAS, sufficient signatures upon said petition were validated by the City Secretary to
bring the Proposed Ordinance before the City Council on November 7, 2023; and
WHEREAS, City Council of the City of Lubbock heretofore on November 14, 2023, failed to
enact the Proposed Ordinance; and
WHEREAS, the initiating committee has now requested that the City Council order an election
at which a proposition to adopt or reject the Proposed Ordinance to create "Freedom Act
Lubbock" and to reduce enforcement of low-level marijuana offenses within the City of
Lubbock shall be placed before the voters of the City of Lubbock in a special election at the
next available uniform election date, which is May 4, 2024; NOW THEREFORE:
BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF
LUBBOCK:
SECTION 1. THAT the City Secretary has received a certificate from the initiating committee,
certifying its desire to have the Proposed Ordinance submitted to the vote of the electors of the
City of Lubbock for adoption or repeal, and a certified copy of the Proposed Ordinance, which
said copy of the certification of the initiating committee and the certified copy of the Proposed
Ordinance is attached hereto as Exhibit A and made a part hereof for all purposes.
SECTION 2. THAT a Special City Election of the City of Lubbock is hereby ordered to be
conducted on May 4, 2024, under the applicable provisions of the Texas Election Code, the
Lubbock City Charter and City ordinances.
SECTION 3. THAT said election shall be for the purpose of voting for or against the
following proposition:

THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK SHALL BE
AMENDED BY ENACTING AN INITIATIVE ORDINANCE CREATING
FREEDOM ACT LUBBOCK" INCLUDING MEASURES TO REDUCE
ENFORCEMENT OF LOW-LEVEL MARIJUANA OFFENSES.

SECTION 4. THAT said City special election shall be held at the places in the City of
Lubbock hereinafter designated as voting precincts and in the voting places designated in
Exhibit B hereto, as may be amended by the Election Order signed by the Mayor. Voting
places shall be open from 7:00 a.m. to 7:00 p.m., and all electors shall vote a ballot appropriate
for the precinct of their residence at any Countywide Polling Place (Vote Center) shown on
Exhibit B, as provided for in Section 43.007 of the Texas Election Code.
SECTION 5. THAT an accessible electronic voting system shall be used for this election,
including early voting. At least one accessible voting device approved and certified by the
Texas Secretary of State shall be provided in each polling place and in every polling location
used to conduct said City special election. Said approved and certified accessible electronic
voting system shall be supplied for said City special election by Lubbock County, acting by and
through its Elections Administrator. The sealed ballot box procedure established by Subchapter
C, Chapter 127, Texas Election Code, shall be used for this election.
SECTION 6. THAT the persons named in Exhibit B, as may be amended by the Election
Order signed by the Mayor, hereto are hereby appointed Judges and Alternate Judges to
conduct said Special City Election on May 4, 2024. In the event any named person is unable to
serve for any reason, the City Secretary of the City of Lubbock is hereby authorized and
directed to make such substitutions as may be required and to amend Exhibit B hereto as
required. Each Presiding Judge so named is authorized to appoint the number of clerks
authorized by the City Secretary of the City of Lubbock, which number shall not be less than
two (2) clerks or more than six (6) clerks. The Alternate Judges shall serve as Presiding Judges
in the event that the regularly appointed Presiding Judge is unable to serve. The Alternate
Judges shall be appointed by the Presiding Judge to serve as one of the clerks in the event that
the regularly appointed Presiding Judge conducts the election.
SECTION 7. THAT early voting by personal appearance shall commence on Apri122, 2024,
and end on Apri130, 2024. Said early voting shall be conducted at the locations, days and
hours indicated on Exhibit C, as may be amended by the Election Order signed by the Mayor,
hereto; and Early Voting Clerk shall be:

SECTION 8. THAT the Mayor, assisted by the City Secretary, is hereby authorized and
directed to give notice of this Special City election as required by law in the notice and order
of election (the "Election Notice and Order") (see Exhibit D attached hereto).
SECTION 9. THAT the City Secretary of the City of Lubbock is hereby ordered to cause
publication of this Resolution ordering the Special City election in a newspaper of general
circulation at least once no earlier than the 30`h day nor later than the 10`h day before election
day. In addition, a copy of this Resolution shall be posted not later than the 21 S day before
election day on the bulletin board used for posting notices of ineetings of the governing body
and a notice of consolidation shall be posted prior to the day of the election at any polling
places not consolidated at the last previous election, which notice shall indicate the precinct of
consolidation and the location of the new polling place.
SECTION 10. THAT the City Secretary shall serve a duly certified copy of this Resolution
and the Election Notice upon each of the Presiding Judges named in Exhibit B, as may be
amended by the Election Order signed by the Mayor, not later than the 7`" day after the signing
of this Resolution or the 15`h day before Election Day, whichever is later. In addition, the City
Secretary shall deliver a certified copy of this Resolution and the Election Notice on the County
Clerk not later than the 60'h day before election day.
SECTION 11. THAT the Mayor is hereby authorized to sign the Election Notice and Order,
which is hereby incorporated and attached herein for all purposes, as Exhibit D. Further, in the
event any voting places designated in Exhibit B are required to be changed or any named
person in Exhibit B is unable to serve for any reason, the Mayor is hereby authorized and
directed to make such substitutions as may be required and to amend Exhibit B by amending
the Election Order hereto to indicate such change. In addition, if the early voting locations and
times indicated on Exhibit C are required to be changed, the Mayor is hereby authorized and
directed to make such substitutions as may be required and to amend Exhibit C by amending
the Election Order hereto to indicate such change.
SECTION 12. THAT this Resolution shall become effective upon passage by the City Council
of the City of Lubbock.

A statement by the initiating committee in regards to AN ORDINANCE CREATING
FREEDOM ACT LUBBOCK" INCLUDING MEASURES TO REDUCE ENFORCEMENT OF
LOW-LEVEL MARIJUANA OFFENSES in certification requesting a special election to be
called for the purpose of the citizens of Lubbock having the opportunity to vote for or
against the enactment of this ordinance that would immediately decriminalize low-level
marijuana possession in the city of Lubbock.

On November 14, 2023, Mayor Tray Payne and the City Council had an opportunity to vote in
favor of an ordinance submitted by our committee that would decriminalize low-level marijuana
possession within the city limits of Lubbock.
Whereas they have voted unanimously to reject this ordinance as proposed, and in accordance
with the city charter, ARTICLE IV (INITIATIVE; REFERENDUM; RECALL], § 1 Initiative and
referendum, we the undersigned hereby formally request that this ordinance as written be
submitted to a vote of the citizens of Lubbock for adoption or repeal during the May 4, 2024
general election.

AN ORDINANCE CREATING "FREEDOM ACT LUBBOCK" INCLUDING MEASURES TO
REDUCE ENFORCEMENT OF LOW-LEVEL MARIJUANA OFFENSES
BE IT ORDAINED BY THE VOTERS OF THE CITY OF LUBBOCK:
Title I, Chapter 14, Article 14.08 of the City Code is hereby created, to be entitled "Freedom Act
Lubbock," and to read as foliows:
14.08.001 Title
This ordinance shall be known as Freedom Act Lubbock.
14.08.002 Purpose
Pursuant to the home rule authority of the Texas Constitution, to promote the health, safety, and
general welfare of the people of Lubbock, Texas, the voters of Lubbock hereby enact Freedom
Act Lubbock, a policy to reform marijuana enforcement by city personnel, with the specific
objectives of carefully allocating scarce city resources, reducing the risk of discriminatory
enforcement practices, and focusing city resources on the highest priority public safety
concems.
14.08.003 Enforcement of Misdemeanor Marijuana Offenses
Unless and until a binding act of a state or federal court requires otherwises, the Lubbock Police
Department shall not make any arrest or issue any citation for Class A or Class B misdemeanor
marijuana possession, except in the limited cases described by this ordinance.
14.08.004 Safe Harbor
In the event of a binding act of a state or federal court, which would prevent the City of
Lubbock's fulfillment of § 14.08.003, the City's policy shall be to make enforcement of Class A
and Class B misdemeanor marijuana possession its lowest enforcement priority. In particular,
the City shall update its annual budget, police department manual, and relevant policies and
procedures to ensure that public safety resources are not wasted on misdemeanor marijuana
enforcement, and are instead targeted at other programs that best promote the health, safety,
and general welfare of the people of Lubbock.
14.08.005 Exceptions to Enforcement Policy
This ordinance shall not limit enforcement of misdemeanor marijuana possession offenses if an
offense is (a) revealed as part of a felony narcotics investigation that has been designated as
high priority" by a commander, assistant chief of police, or chief of police; (b) and/or revealed
as part of the investigation of a violent felony. Lubbock police officers shall not issue any charge
for misdemeanor possession of marijuana unless it meets one or more of these exceptions.
14.08.006 Non-Applicability of Enforcement Policy to Juvenile Residents
This policy does not amend or alter any city policy, practice, or procedure concerning the
enforcement of marijuana possession offenses against juvenile residents, including the City's
Teen Court program.
14.08.007 Handling of Evidence
In any instance governed by this policy, if a Lubbock police officer has probable cause to
believe that a substance is marijuana, the officer may seize the substance. If the officer seizes
the substance, they must write a report explaining the grounds for seizure and release any
detained person if possession of marijuana is the sole charge.
14.08.008 No Citations for Paraphernalia or Residue in Lieu of Possession Charge
A Class C misdemeanor citation for possession of drug residue or drug paraphernalia shall not
be issued in lieu of a possession of marijuana charge.
14.08.009 Ban on Using City Resources for THC Concentration Testing
No City funds or personnel shall be used to request, conduct, or obtain tetrahydrocannabinol
THC) testing of any cannabis-related substance to determine whether the substance meets the
legal definition of marijuana under state or federal law, except (a) for purposes of toxicology
testing to ensure public safety or (b) the investigation of a violent felony offense.
14.08.010 Ban on Using Odor of Marijuana or Hemp as Probable Cause for Search
or Seizure
Lubbock police shall not consider the odor of marijuana or hemp to constitute probable cause
for any search or seizure, except in the limited circumstances of a police investigation pursuant
to § 14.08.005.
14.08.011 Training and Policy Updates
The City Manager and Chief of Police shall ensure that (a) City policies and internal operating
procedures are updated in accord with this ordinance and (b) Lubbock police officers receive
adequate training concerning each of the provisions of this ordinance.
14.08.012 Officer Discipline
Any violation of this ordinance may subject a Lubbock police officer to discipline as provided by
the Texas Local Government Code or as provided by City policy.
14.08.013 Quarterly Reports
The City Manager, in consultation with the Chief of Police and other relevant City personnel,
shall prepare quarterly reports concerning the implementation of this ordinance, to be presented
to the City Council at a public meeting subject to the Texas Open Meetings Act, and with the
first report due no later than 120 days following the effective date of this ordinance. Each report
shall include a summary of the City's implementation of this policy, and shall include specific
information concerning enforcement of misdemeanor marijuana possession offenses, including
total arrests made, total citations issued, estimated personnel hours used in conducting
enforcement activities, and demographic information for each person charged with an offense,
including age, gender, race, and ethnicity.
14.08.014 Severability
In the event that any court finds any section of the Freedom Act Lubbock to be unlawful or
unenforceable, that section shall be severed from this ordinance and the rest shall continue in
force.
