DEFINING BUILDING LINE IN D PROVIDING THAT SETBACK REQUIREMENTS UNDER THE CITY S il ZONING ORDINANCE AND AMENDi'I!ENTS ~'HERETO BE DETERMINED FROM THE BUILDING LINES HEREIN ESTABLISHEDJ PROVIDING EXCEPTIONS FOR UTILITY EX~ENSIONS AND PlffiLIC I~~ROVE~m~~S, AN I AUTHORIZING PUBLICATION OF THIS ORDINANCE. WHEREAS', Article 1105a, Revised Civil Statutes of Texas provides for the esta.b- 1 lishment of building lines on any part or side of any street in the City of Lubbock, said City of Lubbock having a population of more than 15,000. ; and 1 WHEREAS, the City Commission finds that public convenience, safety and necessit I in the City of Lubbock require that building lines, or right ot'r1ay lines be estab• lj lished on Indiana .. Avenue between 19th Street and 34th Street to prevent repair and I replacement of structtU·es and trees in ~he area. between the building lines so es~ab­ lished; such areas betng ultimately reqUired in connection with the widening, open• ing and improving that part of Indian~ Avenue described in the b~ of this ordi-I nance; and WHEREAS, the widening and the improvement of said !~diana Avenue and the estab-1 lishment of such building lines are necessary and will ultimately progide streets af desirable and adequate width which will aid in relieving heavy traffic in congested areas in accordal'\Ce with the City's comprehensive plan and the City Planning Commis• sion has recommended such plan. That all structures on or between the building lines established b this ordinance or extending in whole or in part within such building lines are here by required to ·conform to the new building lines established in Section Two (2) of this ordinance within five years from the effective date of this ordinance. I SECTION 4. The term lfbuilding line" as used herein shall be construed to mean : trstreet right-of-way line", and the setback requirements under the City's Zoning Ordinance and all amendments thereto shall apply in addition to the right•of-w~ lines or building lines herein established, it being the intent and purpose of this ' ordiaanoe to preserve all land within the building lines herein established for ult~ mate street purposes.. · J1 SECTION ;. The provisions of this ordinance shall not apply to any officer, a• gent, employee or other person duly authorized by the State of Texas and/or the Cit 1 of Lubbock when performing aey employment pursuant to the widening, straightening o extension of the street and/or right-of-way contemplated by this ordinance or autho - zed utility extensions within the right-of-way herein described. SECTION 7.
