AN ORDINANCE AMENDING ORDINANCE 981, "THE PLUM:SIN CODEf•
BY ADDING THERETO CHAPTER Z, 11ADMINISTRATION11 , SECTION 2-6--
PLUMBING BOARD; CREATING A PLUMBING BOARD; PRESCRIBING THE
QUALIFICATIONS OF MEM."BERS OF SAID BOARD; PRESCRIBING THE
POWERS AND DUTIES OF THE BOARD AND CONTAINING A SAVINGS CLAUS~.

WHE REA.S, it has been determined by the City Commission of the City
of Lubbol:k that there exists a need for a Plumbing Board to examine new de-
velopments and changing conditions for additions, deletions and changes to the
"Plumbing Code11 and recommend such additions, deletions and changes to the
City Commission; and,
W HER EA S, there is further need for such PlumbinS Board to act as an
.Appeal Board for the interpretation of the "Plumbing Code"; THEREFORE, b~:~a-s:) I

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:

' SECTION 1. That Chapter 2, "Administration" of Ordinance 981, commonly

• known as the 11Plumbing Code11 be, and the same is hereby amended,. by adding
v-l thereto Section Z-6 --Plumbing Board, as. followa:
SECTION Z-6 ...... PLUMBING BOARD
Paragraph z ... 6-l. There is hereby created a Board to be known as the
Plumbing Board for the City of Lubbock, Texas.
Paragraph Z.-6-2. The Board shall consist of seven members who shall
serve without compensation. The membership of said Board shall be as follows:
(1) City Building Inspector, or his authorized representative. who shall be
an ex-ofiic:io member of the Board without voting privileges, and shall continue
as such while holding this office.
(Z) City Senior Public Health Engineer, who shall be an ex-officio m ·ember
of the Board without voting privileges, and shall continue as such irhile holding
this dffice.
(3) Oone licensed and active Master Plumber, who shall have had at least
ten (10} years active experience as a plumber, one of such years of experience
having been performed in the City of Lubbock, Texas, working under the pro-
visions of 11 The Plumbing Code11 •
(4) One licensed and active Journeyman Plumber, who shall have had at
least five (5) years active experience aa a plumber, one of such years of exper-
ience having been performed in the City of Lubbock, Texas, working under the
provisions of liThe Plumbing Code".
(5) TJlree members, other than a Master or Journeyman Plumber, who
shall have knowledge of building construction and/or plumbing materials through
experience as a contractor, engineer, architect, supplier of building and/or
plumbing materials or other experience in a related field that would enable him
to render service in the interpretation of the "Plumbing Code" and recommenda ...
tions for improvements to the Plumbing Code.

Paragraph Z-6-3. The four (4) members, not inclu.ding the City Plumb-
ing Inspector and the City Senior Public Health Engineer, shall be appointed
to the Plumbing Board immediately upon this Ordinance becoming effective
and shall hold office for a term of four (4) years or until their successors are
appointed, except that the members first selected shall hold their offices for
the term ending January 1, 1955, January 1, 1956, January 1, 1957, and Jan-
uary 1, 1958, respectively, the term of each to be determined by lot; and their
successors ' shall hold office for four (4) years or until their successors are
appointed. I
Paragraph Z-6-4. Provided, however, if for any reason, any of t.he mem-
be-rs-of the Board shall be unable to act, or shall resign from thelr r-e.B..Jlei:ti~e
position or shall be removed for any cause, then the City Commission shall
appoint a successor or successors, who shall .fill out the unexpired term or
until respective successors shall be appointed.
Paragraph Z-6-5. The City of Lubbock shall provide the Plumbing Board
with proper books of record, blank forms, stationery and supplies proper and
adequate for the conduct of its business.
Paragraph z-6-6. It shall be the duty of the Plumbing Board to meet as
soon after their appointments as possible and organize. The City Plumbing
Inspector shall be Secretary of said Plumbing Board and shall keep a full
record-of the proceedings of such Plumbing Board.
Paragraph z-6-7. It shall be the power and duty of the Plumbing Board to
~amine new developments and changing conditions for additions, deletions,
am.endm.ents and changes to the "Plumbing Codett fr.om time to time as it may
deem proper, and to submi.t .. to th~ City Commission its written suggestions
for the improvement of the "Plumbing Code11 of the City of Lubbock.
Paragraph Z-6-8. Appeals to the Pluml1ing Board will be made by the
City Plumbing Inspector o.r any interested person and it is·hereby made the 1
power and duty of the Plumbing .Board when dispute arises between any person,
firm, association, partnership or corporation as to the m-eaning of the uf'lamb-
ing Code", to interpret same; and when a majority of. said Plumbing Board have ·1
interpreted the "Plumbing Code" as to its meaning, aaid interpretation by said
Plumbing' Board shall be final and binding on all persons, firms, associations, ~~~
partnerships and corporations."
SECTION z. If any section, sub"'1Jection, sentence, clause or phrase con ..
tained in this Ordinance shall for any reason be held ·to be invalid or unconstitu• "'
tional, such decison shall not affect the validity of the remaining portions of
this Ordinance and it is hereby declared that all other parts of this Ordinance
shall continue in full force and effect.
AND IT IS SO ORDERED
