THE SOUTH SIDE OF THAT PORTION OF STREET KNOWN AS "PARKWAY DRIVEtt BEGINNING 2000 FEET WEST OF THE IDALOU HIGHWAY AND EXTENDING EAST 1000 FEET; AND FROM 30 MILES PER HOUR TO 40 MI LES PER HOUR ON THE SOUTH SIDE OF THAT PORTION OF STREET KNOWN AS 11 PARK- WAY DRIVE11 , BEGINNING AT A POINT 1000 FEET WEST OF THE IDALOU HIGHWAY AND EXTENDING ~T TO THE IDALOU HIGHWAY;30 MILES PER HOUR TO 60 MtLES PER HOUR ON THE SOUTH SIDE OF THE BROWN- FIELD HIGHWAY BEGINNING AT 19TH STREET TO 600 FEET SOUTH OF 6TH STREET AND THE NORTH SJDE OF BROWNFIElD HIGHWAY 600 FEET SOUTH OF 6TH STREET TO A POINT IN LINE WITH 15TH STREETi THE SAME BEING PARTS OF CERTAIN HIGHWAYS AND/OR STREETS WITHIN THE CORPORATE LIMITS OF THE CITY OF LUBBOCK; PROVID- ING FOR THE ERECTION OF SIGNS; PROVIDING PROVISIONS CUMULA.- TIVE; PROVIDING CONSTITUTIONALITY; PROVIDING FOR A PENALTYi AUTHORIZING PUBLICATION AND DECLARING AN EMERGENCY. WHEREAS, the governing body of the City of Lubbock has determined· upon the basis of an engineering and traffic investigation that the prima• facie speed limits set forth and established by Article 827a, Section 8, Vernon's Annotated Penal Code, as amended by Acts of 1951, 5Zd Leg., P. 589, Ch. 346, Sub-Sec. 1., are less than is reasonable or safe under the conditions found to exist upon certain highways, streets and/or parts of highways and streets at the locations named and designated in the body of this ordinance and in the corporate limits of the City of Lubbock, taking into consideration the width and condition of the pavement and other circum- stances on such certain highways, atreets and/or parts of highways and streets, as well as the usual traffic thereon; and, WHEREAS, it is necessary for the immediate preservation of the public health and safety to provide for the immediate enactxnent of such measures, constituting an emergency; N 0 W , T HERE F 0 R E , BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. That from and after the effective date of this ordinance the prima ... facie speed limit established by Article 827a, Section 8, Sub ... Sec. 1 (b) (1), Vernon's Annotated Penal Code, as amended by Acts 1951, SZd l T Leg., P. 589, Cb. 346, Sub-Sec. 1, is altered and changed for all ve·- bicles to thirty-five (35) ~~r h?fr on the following designated high- ways or streets in the corporate Um1 s of the City of Lubbock, to-wit: On each side of 4th Street between Av~nue Q and College Avenue. SECTION z.. That from and after the effective date of this ordinance the prima-facie speed limit established by Article 8Z.7a, Section 8, Subsec- tion 1 (b) (1), Vernon's Annotated Penal Code, as amended by Acts 1951, 52d Leg., P. 589, Ch. 346, Sub-Sec, 1, is altered and changed for all vehicles to forty (40} miles .E.!.!_~ on the following dis.ignated h.J.shways 1 or streets fiiiJie corporate Ilmlts of the City of Lubbock, to-wit: Each side of Clovis Road from Avenue Q to Erskine Street; On the South side of~t.por.fidnof Street known as Parkway Drive, beginning at a point 1000 feet West of the Idalou High• way and extending East to the Idalou Highway; SECTION 3. That from and after the effective date of this ordinance the :prima-facie speed limit established by Article 827a, Section 8, Subsection 1 lb) (1), Vernon's Annotated Panal Code, as amended by Acts 1951, 52d Leg., P. 589, Ch. 346, Sub-Bee. l, is altered and changed for all vehicles to fifty( (5.0) miles~~ on the following designated highway or street in the corporate bmlts of the City of Lubbock, to-wit: On the South side of that portion of Street known as Parkway Drive, beginning 2000 feet West of the Idalou Highway and extending East one thousand (1000) feet, SECTION 5. That from and after the effective date of this ordin&Bce the prima-facie speed limit established by Article 827a, Section 8, Subse!ction 1 (b) (1), Vernon1s Annotated Penal Code, as amended by Acts 1951, 5Z.d Leg., P. 589, Ch. 346, Sub-Sec. 1, is altered and changed for all vehicles to sixty {60) miles~~ on the following designated highways or streets in the corporate limits of the· City of Lubbock, to ... wit: On the South side of that portion of Street known as Parkway Drive,, beginning at Avenue A and extending East to a point 2000 feet West •: of the Idalou Highway and on the North aide of said Pa.l'kway, Drive begin- ning at the Idalou Highway and extending West to a point 2000 feet East of Avenue A·, On the South side of the Brownfield Highway beginning at 19th Street L to 600 feet South of 6th Street and the North side of Brownfield High- way 600 feet South of 6th Street to a point iti line with 15th Street. II J SECTION 6. All highways or sbeets not specifically set forth in Section 1 {One), 2. (Two), 3 {Three), 4(Four) or 5 {Five) of this ordinance shall not be affected by the provisions of this ordinance, and shall be cumulative of all other ordinances. I ' I SECTION 7. That all ordinances or parts of ordinances c·onflicting with any of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 8. Any violation of the prima-fade speed limit established by this ordinance by any person shall be unlawful and shall constitute a violation of Section 8 of Article 82.7a, as amended, Vernon's Annotated Penal Code: and shall be fined as prescribed for such violations by Sec- tion 15 of Article 8Z7a, Vernon's Annotated Penal Code. SEC',t'ION 9. The City Secretary is hereby authorized and directed to cause the publication of the descriptive caption of this ordinance, together with the penalty provisions, as required by law. SECTION 10. The Traffic Engineer is authorized and directed to place speed limit signs so as to clearly define the limits of the prima- facie areas set out in this ordinance. / SECTION 11. Should any section, paragraph, sentence, clause, phrase or word of this ordinance be declared unconstitutional or invalid for any reason, the re..ainde:r of this ordinance shall not be affected thereby. SECTION 12.. The .• fact that the heavy flow of vehicular traffic through the several highways and streets as herein designated and established is a hazard, dangerous to the safety of :.persons and property, creates a public necessity requiring all rules that no ordinance shall be finally pas- sed on the day of its introduction be suspended; and this ordinance is de• clared to be an emergency measure, to take effect from and after the date of its first publication.
