THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONING CASE NO. 484 -CHAN1E THE SOUTH ONE-HALF (!) OF THAT BLOC% Llllm BETWEEN ,34m AND 35TH STREETS AND BETWEEN INDIANA AND JOLIET AVENUES IN THE. CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM THE ,_A• TO •F• ZONING DISTRICT; PROVIDI~ A PEN- ALTY; .AUTHORIZING PUBLICATION OF THE DESCRIPTIVE CAPTION AND PENALTY CLAUSE HEREOF.· WHEREAS, the proposed change to the Zone District as hereinafter made has been d~ presented to the Zoning and Planning Commission for its recommendation, which recommendation was received ~ the City Commission and after due consid- eration, finds that such change in zone is in accordance with the Cityts compre- hensive plan for the purpose of promoting the health, safety, morals and the general welfare of the general public and that making su® change in zone 'Will lessen congestion in the streets and promote safety for both vehicular and pedes- trian traffic, and further provides safety from fire, panic and other dangers, and will more fully provide adequate light and air in such vicinity, and will prevent the over-crowdil'lg of land, and such change in zone as herein nade will ~urther provide and facilitate transportation and traffic in such vicinity and other public requirements; said Comission further finds that the Zone District change as herein made is being created with a fair and reasonable consideration, among other things, of the character of this particular district and its pecul- iar sui tablli ty for particular uses and conserves the value of land and build- ings in such district without being materially damaging or detrimental to the adjacent, adjoining and abutting property on any side and across the street frOlll such property. The Commission further finds that making such zone change will insure the harmonious and appropriate use of property in such zone and neighborhood, and will promote the general good and welfare of the public as there is a need for retail businesses of the kind and character in the area in which the zone change is made, as the City of Lubbock is a rapidly growing municipality, especially in the area and surrounding vicinity of the property on which the zone change is hereinafter mad~ 'hat 34th Street in the City of Lubbock is fast and continually growing and becoming a wide multi-lane street suitable for businesses, and there is a need in such vicinity for a shopping penter which cou1d provide adequate off-street parking to facilitate the moving br traffic and the storage of automobiles. Persons both in favor and against such zone change appeared at the hearing. The Comnission is of the opinion and finds that due to the constantly changing conditions in such vicinity, the influx of population and the rapid growth and development in the inmediate area, that DBking such change will be an added convenience and econonw to persons residing and working in the area and vicinity of the proposed change in zone, and is further for the benefit o~ the general good and welfare of the general public and in keeping with the comprehensive plan of the development of the City of Lubbock. 'WHEREAS, all conditions precedent required by lav for a valid amendment to the Zoning Ordinance and Nap have been tully complied with as well as giv- ing all notices in compliance with Section 25 of Ordinance No. 661, as amend- ed, as vall as notices provided by Article lOllf, Revised Civil Statutes, as amended in 1953, and notice was duly published on August 15, 1954, in the Lub- bock M::lrning Avalanche, and the public hearing according to said notice was held at 2:00 P. M. on September 9, 1954, in the City Commission Room on the first floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the prOposal; and, after said hea~ng, it was by the City u Commission determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in sub- stantial compliance with the proposal; THEREFORE, BE IT ORDAINED BY THE CITY COJ.MISSION OF THE CITY OF LUBBOCK: . . -SECTIOB l. THAT Ordinance No. 661 and the Official Zoning Map BE, and the same are hereby amended as follows, to-~t: ~ CASE NO~ -Change the South one-half Ct) of that block lying betveen 34th and 35th Streets and between Indiana and Joliet Avenues in the City of Lubbock, Lubbock County, Texas, from the "A" to "F" Zoning District, -SECTION 2. That from and after passage and effective date of this Ordin- ance said lot, tract and parcel of land described in Section l hereof shall be changed to the Zoning District indicated, and the Official Zoning Map is hereby amended in accordance herewith. SECTION 3. 1.riy one violating the provisions of this ordinance shall be guilty of a misdemeanor and shall upon conviction thereof be fined any sum not·to exceed Two Hundred ($200.00) Dollars, and each day such violation shall be permitted t6 exist shall constitute a separate offense. . The City Secretary-Treasurer ·is hereby autborized to cause the descriptive caption of this ordinance together with the penalty clause to be published once a week for two consecutive weeks in some newspaper regularly published in the City of Lubbock as an alternative method of publication as provided by law, and this ordinance is to become effective ten days after the date of its last publication.
