DD'INING BUILDING LINE; AND AUTHORIZING PUBLICATION OF THE CAP'l'ION OF THIS
ORDINANCE.
WHEREAS, The City Commission finds tba t it would be in the public interest
and that the public convenience, safety and necessity require that a building
line be established in connection with the widening, opening, stMightening,
and improving of that part of 35th Street described 1n the body of this ordin-
ance to prevent repair and replacement of structures in the area. vi thin the
building line so established; and,
WHEREAS, the widening, straightening and improvments of said 35th Street
and the establishing of such building line is necessary and will ultimateJ.¥
pl"O'\Tide economically, streets of' desirable and adequate width which will aid
in relieving heavy traffic in congested areas in accordance with the Cityra,.com-
prehensive plan, and the City's Planning Commi.Jision has recommended such im-
provements; THEREJURE,
BE IT ORDAINED BY THE CITY COl+f.ISSION OF THE CITY OF LUBBOCKs
S~ION 1. That public neces8ity, convenience and safety in the City of
Lubbock requires the widening, opening and straightening of that part of the
street hereinafter designated wit)d.n the building line as herein established.
SECTION 2. That a buildiDg line be, and the same is hereby established
on the Borth side of 35th Street lying between the points hereinafter described
and within the corporate boundaries of the City of Lubbock, which building line
is more plrticularly described as follows, to-wit:
Beginning at a point 25 :feet North of the Southeast corner of' Lot 1, Block
3, Alta Vista Acres Addition at Avenue lttJ't;
Thence West parallel to and 25 feet North of the South line of said Lot 1
of Block J, Alta Vista Acres Addition, a distance of 635 feet to a point in
the West line of said lot 1, Block 3 at Avenue wv•. ;,
SECTION 3. '!'hat no building or other structure shall hereafter be erected,
reconstructed, or substantially repaired and no new building or other structure
or part thereof shall be erected or re-erected on that part of the street or
land herein designated within said lines herein established.
SECTION 4. That all structures now extending or being located within said
building line herein established are hereby required to conform to the building
line herein established within five years fro~ the effective date of this or-
dinance.
SECI'ION 5. The term •building line• as herein used ahall be construed to
mean"street right-of-way line•, and the setback requirements under Zoning Ordin-
ance No. 661 and all amendments thereto shall apply in addition to the right-of-
way line or building line herein established, it being the intention and purpose
of this ordinance to reserve all land between the building line herein estab-
lished, and the right-of-way line on the South side of 35th Street .for ultimate
street purposes.
SECTION 6. That the provisions of this ordinance prohibiting the placing
of structures between building lines herein established shall not apply to aey
officer, agent, employee or other person dul.y authorized by the City ot Lubbock,
and/or the State of Texas, when such work relates to utility extensions for
street improvements, provided however, this provision shall not be construed
as authorizing arq such person to enter upon private property lying between
such lines until the same has been dedicated to public use or otherwise ac-
quired for such purposes.
SECI'ION 7. The City Secretary is hereby directed to cause public! tion of
the descriptive caption of this ordinance.
