PEESlliNEL OF THE Cr!'Y-COUNTY HEALTH UNIT; PROVIDING EX-OFFICIO Ml.MBERS; AND
STATING THE PURFOSE OF THE OOARD; AND D:OOLARING AN El-E!liENCY.
WHEREAS, the City Ccmmd.esion or the City of Lubbodc and the Comissioners t
Court ot Lubbock County each desire to establish a City-County Board of Health
w1 th tull power to investigate and nake recommendationa concerning public health
in Lubbock County, and further desire jointly to otf'icially establish such board
and provide for i t.s organiaa tion; T' H E R E F 0 R E,
BE IT ORDAINED BY THE CITY COMUSSION OF THE CITY OF LUBBOCK: . SECTION 1. '!'here is hereby created and established a City-County Board
of Health to be composed ot nina (9) members, each of vhom shall be a resident
citizen of the County ot Lubbock, Texas, and said Board shall be of'ficiall;y
designated as \he Lubbock Ci ty-Count;y Board of Health. The members of said
Board shall be appointed by the joint a~tion ot the City C~ssion and Com-.
missioners Court. Fiw (5) of the members shall be appointed by the City Com-
mission and four (4) of the mmbers by the Commissioners Court. The term ot
office shall be three (.3) ysare, except that three ot the members first selec-
ted shall hold office for a term ot one year and three of the members shall
hold office tor a term of tvo year, and three of the members shall bold office
tor a term of three years, the term of each to be determined by lot, and there-
after their successors shall hold office for three years.
SECTION 2. Upon death, resignation, removal, or expiration ot the term
of office of any of the members of eaid City-County Board ot Health the City
Commission or the Commissioners Court, as the oase uay be, shall nominate
and appoint a successor as a mmber ot said Board who shall hold his member-
ship on said Board for the unexpired term ot the member he is appointed to
succeed or for a period of three years vhen the appointnsnt is 1D!lde due to
the expiration of a Board :memberts term, and further provided that in the
event the best interests of the City of Lubbock or the County of Lubbock
require the removal of any member of said Board, removal of such member
shall be efrected through appointment of such member's suGcessor by unan-
imous vote of the City Connnission or the Commissioners Court, as the case
my be.
SECTION .3. No Salary or compensation of any sort shall be paid to
the members of the said Board of Health for their services.
SECTION 4. When the City Commission of the City of Lubbock and the Com-
missioners Court of Lubbock County have completed the appointment of the nine
members of the Lubbock City...County Board of Health, said Board shall as soon
thereafter as is practicable meet and organize and shall appoint one of its
members as cbairmn and one of its members as secretary, and it shall be the
duty of the <ah&il'lllln to preside at all meetings of the Board, and the secre-
tary. shall keep a record of all the proceedings_ of said Board, vhicb shall
upon request ot the City Commission or the Commissioners Court be delivered
to it for its inspection and review.
SECTION 5. Follovi!lg the original meeting provided for in Section 4,
the Lubbock City-Count7 Board of Health shall hold regular monthly meUDge
at a place and time to be determined by said Board at its original meting.
SECTION 6. Any and all recOJIID9ndations made by the said Board to the
City Commission and/or the Commissioners Court shall be by the concurring
vote of tin members of the Board, providing, however, this provision shall
not exclude a Jl:inority recoD18ndation which is hereoy authorized to be mde
in writing· by less than a majority of the members of said Board. The mjor-
i ty ot the total mmbership of said Board shall constitute a quorum for the
tra.maction or all matters to be coDSidered by said Board.
SECTION 7. The Lubbock City-County Board of Health hereby created is
and shall constitute an advisory board to the City Commission of the City
ot Lubbock and the CoDidssio:ners Court ot the County of Lubbock vith paver
to hold hearings in Lubbock, consider and mate recOJIIMndations to the City
Colllld.ssion and the Colllllissioners Court in writing trOll time to time on any
and all mtters pertaining to the public health of the City of Lubbock and
the County ot Lubbock. Said Board shall also have the paver to supervise
the functioning and to nake reccmmendations concerning the personnel ot the
Lubbock City-County Health Unit.
SECTION 8. The following officers of the City of Lubbock and the County
ot Lubbock 1hall be ex-officio members of said Board without voting privileges
and shall act in an advisory capacity to said Board;
1. County Judge
2. City Manager
.3. Director of the City-Cotmty Health Unit
SECTION 9. This Ordinance is passed contingent upon and subject to be-
ing approved bT the Commissioners Court of Lubbock County by its resolution
duly entered in its minutes. It being further provided, that in the 8'98nt of
approval by said Court, both the Said Court and the CoDIIlission will promptly
in joint or separate meetings, at the earliest practicable time, appoint mem.-
bers of said Board as provided in Sec~ion 1.
8roTION 10. There being an iJDDBdiate need tor the appointment ot "City-
County Boa1"41 of Health•, an emergency is hereby declared to exist in connec-
tion with the handling of DBtters of illmediate importance effecting the gen-
eral heal tb of the County and City and this Ordinance shall become effective
from and after the date of its pasaage.
