AN ORDINANCE ESTABLISHING BUILDING LINES ON INDIANA AVENUE BETWEEN
40I'H STREXT AND 44TH STREET IN ACCORDANCE lUTH A COEPREHENSIVE STREET IMPROVEMENT
PROGRAM; ogcLARING THAT PUBLIC CONVENIENCE, NIDESSITY AND SAFETY RE~UIRE THE
EXTENSION, OPENING, WIDENING , CONSTRUCTION AND n PROVEMENT WITHIN SUCH BUILDING
LIW'..E; PROVIDING FOR SETBACKS ACCORDI:OO TO ZONING ORDINANCE NO. 661; PROVIDING THAT
NO BUILD!~ OR OTHER STR'OCTURE SHALL BE REPAIRED ORPLACED BETWEEN THE BUILDIOO
LINES; EXCEPTING PUBLIC UTILITIES ON PUBLIC PROPERTY BETWEEN WILDING LINES; RE-
QUIRING THAT STRUCTURES CONFORM TO SUCH BUILDING LINES AND SETBACK PROVISIONS OF
ORDINANCE Ho. 661, AS .AME:NDED, WITHIN FIVE YEARS; DEFINING BUILDING LINE; AND
AUTHORIZING PUBLICATION OF THE CAPTION OF THIS ORDINANCE.
W H E R E A S, the City Commission finds that it would be in the public
interest and that public convenience, safety and necessity require that building
lines be established in connection with the 'Widening, opening, straightening, and
improving of that part of Indiana Avenue described in the body of this Ordinance to
prevent repair and replacement of structures in the area between the building lines
so established; and,
W H E R E A S, the viderdng, straightening and improvements of said
Indiana Avenue and the establishment of such building lines are necessar,y and will
ultimately provide, economically, streets of desirable and adequate widths which
will aid in relieving heavy traffic in congested areas in accordance with the
City's comprehensive plan, and the City's Planning Comndssion has recommended
such improvements; T H E R E F 0 R E, ·
BE IT ORDAINED BY THE CITY CO:t-f.fiSSION OF THE Cl'rY OF LUBBOCK:
SECTION 1. That public necessity, convenience and safety in the City
of Lubbock requires the extension, opening, widening, construction and improvement
of that part of the street hereinafter designated within the building lines as
herein established.
SECTION 2. That a building line is hereby established on the East and
we~t sides of Indiana Avenue lying between the points hereinafter described and
within the corporate boundaries of the City of Lubbock, which east and west
building lines are more particularly described as follows, to-wit:

Starting at a point in the north right-of-way line of 40th Street,
which point is forty (40) feet east of the east line of Section Sixteen
(16), Block B, Lubbock,County, Texas;
Thence so~th along a line, said line being forty (40) feet from,and
parallel to the east line of said Section Sixteen, Block B, a distance
of 1320 feet, more or less, to the north property line of 44th Stre 3t.

Starting at a point in north right-of-way line of 40th Street, which
point is forty (40) feet west of the ea£t line of Section Sixteen (16), ·
Block B, Lubbock County, Texas;
Thence south along a line, said line being forty (40) feet from and
parallel to the east line of said Section Sixteen (16), Block B, a
distance of 1320 feet, more or less, to the north property line of
44th Street. ~ •. ¥ \y ~SECTION 3. That no building or other structure shall hereafter be
erected, r econstructed, or substantial~ repaired and no new buildings or other
structure or part thereof shall be erected or re-erected on that part of the
street or land herein designated within said lines herein established.
SECTION 4. That all structures now extending or being located•within
or between said building linea herein established are hereby required to conform
to the building lines herein established within five years from the effective
date of this ordinance.
SECTION 5. The term "building line" as used herein shall be construed o
mean "street right-of-way line", and the setback requirements under Zoning
Ordinance No. 661 and all amendments thereto shall apply in addition to the right-
of-way lines or building lines herein established, it being the intent and purpose
of this ordinance to preserve all land within the building lines herein established
for ultimate street purposes.
SECTION p. That the provisions of this Ordinance prohibiting the
placing of structures between building lines i"e rein established shall not apply to
any officer, agent, employee or other person duly authorized by the City of Lubbock
and/or the State of Texas when such work relates to utility extensions for street
improvements provided, however, this provision shall not be construed as autborizi
any such persons to enter upon private property lying between !Uch lines until
the same has been dedicated to public use or otherwise acquired for such purposes.
SECTION?. The City Secretary is hereqy directed to cause publica tion
of the descriptive caption of this Ordinance.
