(Construction and Maintenance)
AN ORDINANCE PROVIDING FOR THE CONSTRUCTION AND MliNTENANCE OF THE
PORTION OF HIGHWAY NO. U. S. S2 IN THE CITY OF LUBBOCK BET\VEEN THE
FOLLOWING LIMITS, TO-WIT: BEGINNING AT THE INTERS:mTION OF FOUKTH STKEET
AND AVENUE D, THENCE EASTEaLY VIA A NE~~ LOCATION TO A CITY LIMIT 4-INE,
SAID CITY LIMIT LlNE LYING 320.0 FEET NORTH OF AND PARALLEL TO THE SOUTH
BOUNDARY LINE OF SECTION 21 BLOCK A (EXCEPT A PffiTION LYING \t.'ITtiOUT 'I'HE
CITY LIMITS FROM THE SOUTH :&..UNDARY LINE OF SEX:TION 1, BLOCK A TO THE EAST

AND DEX:LARING AN EMERGENCY AND PROVIDING THAT THE ORDINANC E SHALL BE
EFFECTIVE FROM AND AFTER ITS PASSAGE.
w~s, the public convenience, safety and necessity of the City, and
th~ people ot the City, require that the portion of U. s. Highway S2 from
the intersection ot Fourth Street and Avenue D, via a ne~ location to a
City Limit Line, said City Limit Line lying 320.0 teet North of and parallel
to the South boundary line of Section 2, Block A (except a portion lying
without the City Limits tram the South boundary line of Section 1, Block A
to the East boundary line of the said Section,l, Block A,) be constructed,
since the existing condition constitutes a serious inconvenience to the public
which it is urgently required to be remedied;
and
~£.EAS, the City has requested the State of Texas to contribute
financially in the project; and
WlfEREAS, the State of Texas has made it lmown to the City that the State
will assist the City in the improvement and maintenance of said project
providing the City approves the plans for said project.

NOW 1HE.~EFORE, BE IT ORDAINED BY THE CITY COUNClL:
SECTION 1, That since the public convenience, safety and necessity ot
the City and the people o! the City require it, said project shall be
constructed.
S~TlON 2. That the State of Texas be and is hereby authorized to enter
upon, construct and maintain the project at the location and in the manner
shown on the plan attached hereto, marked IIExhibit A", and made a part hereof
in all respects.
S:&:TION 3. The Mayor ot the City be and is her eby authorized to execute
tor and on pebalf of the City an agreement ani contract with the State of
Texas in accordance ~ith and tor the purpose of carrying out the terms and
·provisions of this ordinance, in the form attached hereto and marked "Exhibit
B." The Mayor ot the City is further authorized to approve and sign the
detailed plans tor construction of the projec~ or any section thereof when and
as such plane are completed and prior to a~ard of construction contract ~

the State. The City Secretary is hereby directed to attest the agreement
and contract and to affix the proper seal of the City hereto.
SECTION 4. The fact that there is an imperative necessity that the
work provided for in said contract be begun and carried out promptly, and
that such contract should accordingly be forthwith executed, creates a
public emergency requiring that this ordinance be passed finally on the
date of its introduction, and the ~,yor. having in ~iting declared the
existence of such emergency and requested such passage, this ordinance
shall be passed finally on the date of its introduction, this 22 day of
April , A. D. 1954, and shall take effect immediatelY upon its pa&sage
and approval by the Mayor.
On motion of Commissioner Carpenter, seconded by Commissioner Forrest,
