AN ORDINANCE ALTERING AND ESTABLISHING PRIMA FACIE SPEED LIMITS OF
15 MILES PER HOUR IN AND UPON ALL .ALLEI!'·VITHIN THE CORPOBATE LIMITS OF THE CITY
OF LUBBOCK; OO'INING •ALLEYtt; PflOVIDING A PENALTY; AUTHORIZING PUBLICATION AND
DECLARING AN EME:RGENCY.
'W HE R E A s, the Governing Body of the City of Lubbock, upon the
basis of &-n engineering and traffic investigation, finds it :neoessarr to alter
the prim facie speed limits established by Article 827a, &lotion S, Vernon's
Annotated Penal Code, as aJnended by the Acts of 1951, 52nd LegislAture, Page 589,
Chapter 346, Section 1, in and upon all •alleys• within the corporate limits ot
the City of Lubbock; and,
W H E R E A s, it is necessary to the immediate preservation of the
public health and safety to provide tor the iumediate enactment of such measures
constituting an emergency; N 0 W, T H E R E F 0 R E,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCKs
SEX:TION 1. The term "alley" as used in this ordinance shall mean, for
the purpose of this ordinance, ~ public street, highway, or roadway which is
twenty {20') feet or less in width between the boundar,y lines thereof.
SE>.7riON 2. The prima facie speed limit established by Article 8Z7a,
Section 8, Vernon's Annotated Penal Code, as amended by Acts 1951, 52nd Legislature
Page 589, Chapter .346, Section 1, ot vehicles driven upon the public "alleys• withi
the corporate limits of the City of Lubbock is hereby altered, and from. and after
the effective date of this ordinance, shall be 15 miles per hour for all vehicles.
SECTION .3. Any speed in excess of the limit specified by this ordinan
I shall be prima facie evidence that the speed b not reasonable or prudent and that
it is unlawful and any person violating the prima facie speed limit established
by this ordinance shall be fined as prescribed by the provisiom~ of Article SZ7a,
Vernon's Annotated Penal Code, tor violation of Section 8 thereof'.
SECTION 4, The City Secretary is hereby authorized and directed to
cause publication of the descriptive caption of this ordinance together with the
penalty provisions, as required by law.
SECTION 5. The fact that the heavy flow of vehicular traffic upon
the "alleys" within the City of Lubbock at excessive rates of speed is a hazard
dangerous to life and limb, creates a public necessity requiring all rules pro-
viding that no ordim.nce shall be fimlly passed on the day of its introduction
be· suspended and this ordinance is declared to be an emergency measure to take
effect f'rom and a.f'ter the cia te of its first publication.
