W.HEREAS, the governing body of the City of Lubbock has determined upon the basis of an engineering and traffic investigation that the prima-facie speed limits set forth and established by Article 8Z7a, Section 8, Vernon's Annotated Penal Code, as amended by Acts of 1951. 5ld Leg., P• 589, Ch. 346, Sec. 1t are less than is reasonable or safe under the conditions fowtd to exist upon certain highways, streets and/ or parts of highways and streets at the loca- tions named and designated in the body of this ordinance 4\Ild in the corporate limits of the City of Lubbock, taking into consideration the width and condition of the pavement and other circumstances on such certain highways, streets and/or parts of highways and streets, as well as the usual traffic 'thereon; and, W HER E AS , it is necessary for the immediate preservation of the pub- l,ic health and safety to provide for the immediate enactment of such measures, constituting an emergency; N 0 W , T HERE F 0 R E , BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. That from and after the effective date of this ordinance the prima-facie speed limit established by Article 8Z7a, Section 8, Subsection 1(b)(l~ Vernon's Annotated Penal Code, as amended by Acts 1951, 5Zd Leg., P. 589., Ch, 346, Sec. 1, is altered and changed for all vehicles to thirtyoofive (35) miles per hour on the following designated highways or streets or parts of highways or streets in the corporate limits of the City of Lubbock: South side of 19th Street from Nashville Avenue to Indiana Avenue South side of Brownfield Highway,· 60.0 feet South of 6th. Str·eet to 4th Street North side of Brownfield Highway from 4th Street to 600 feet South of 6th Street North side of Brownfield Highway from 15th Street to 1, 000 feet North of 19th Street South side of Broadway from Quirt Avenue to the Idalou Highway North side of Broadway from the Idalou fllghway to Quirt Avenue South side of the Idalou Highway from 600 feet East of Yanda Ave- nue to 3d Street North side of the Idalou Highway from 3d Street to 600 feet East of Yanda Avenue Both sides of 34th Street from Slide Road to Indiana Avenue SECTION z. That from and after the effective date of this ordinance the prii:na-facie speed limit established by Article 8Z7a., Section 8, Subsec:tion'l(b){l), Vernon's Annotated Penal Code, as amended by Acts 1951, 52d Leg,, p. 589t G·h. 346, Sec. 1, is altered and changed for all vehicles except for commercial motor vehicles., truck-tractors, trailers or senii-trailerst to fifty (50) miles per hour on the following designated highways or streets or parts of highways or streets in the corporate limits of the City of Lubbock: · Both sides of 19th Street from Quirt Avenue to Globe Avenue . All highways or streets or parts of highways or streets not specifically set forth in'Section 1 (One), Z (Two} or 3 {Three) of this ordinance shall· not be affected by the provisions of this ordinance, and shall be cumulative of all other ordinances. ---~ -- ,..,. i f 1 P. 3 SECTION 5. Any violation of the prima-facie speed limit established by this ordinance by any person·shall be Wllawful and shall constitute a violation of Section 8 of Article 8Z7a, as amended, Vernon's Annotated Penal Code, and ·shall be fined as prescribed for such violations by Section 15 of Article 8Z7a, Vernon's Annotated Penal Code. SECTION 6. The Traffic Engineer is authorized and directed to place speed limit signs so as to clearly define the limits of the prima-facie areas set out in this ordinance. SECTION 7. Should any section, paragraph, sentence. clause, phrase or word of this ordinance be declared Wlconstitutional or invalid for any rea- son, the remainder o£ this ordinance shall not be affected thereby. SECTION 8. The City Secretary is hereby authorized and directed to cause the publication of the descriptive caption of this ordinance, together with the penalty provisions, as required by law,. SECTION 9. The fact that the heavy flow of vehicular traffic through the several highways, streets or parts of highways or streets as herein designated and established is a hazard, dangerous to the safety of persons and property, creates a public necessity requiring all rules that no ordinance shall be finally passed on the day of its introduction be suspended; and this ordinance is declared to be an emergency measure •. to take effect from and after the date of its first publication.
