AN ORDINANCE ABANOONING, VACATING AND CLOSING THAT PART AND PORI'ION
OF OLD ASH AVENUE DESCRIBED BY METES AND BOUNMIN THE BODY OF THIS ORDINAl(;E;
AND RESERVING A PERMANENT AND PERPETUAL EASEMENT FOR EXISTING UTILITIES •
WHEREAS, the City Commission finds that the part and portion of Old
sh Avenue described b.y metes and bounds in the body of this Ordinance is no
longer needed for street purposes, other rights-of-way having been substituted
and now being used for the purposes for which the said hereinafter described pro-
perty was dedicated, and it would be in the public interest to close, vacate and
::opy to abandon same for street purposes provided that an eas0ment for existing utili ties
City Engr running through, over and across said land be reserved, particularly an easement
City Atty. or a.n electric transmission line running north and south across said land;

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT, subject to the reservations hereinafter stated, that
rt of old Ash Avenue situated in the City of Lubbock, County of Lubbock, Texas,
particularly deacribed as follovs to-Wit:
BEGINNING at the point where the east bounda~ line of Section 71 Block B, Lubbock County, Texas, the ea~t bounda~ line of said Section
also being the east boundary line of old Ash Avenue, intersects ~ith
the center line of the main track of the Fort Worth and Denver Railway
C~ey; .
THENCE north along the east boundary line of said Section 7, Block
B, a distance of 307 feet to the south boundary line of a cer~~n
right-of-way easement, dated .November 5, 1952, granted and conveyed
to the City of Lubbock for a public road crossing by the said Fort
Horth and Denver Railway Company;
THENCE west a distance of 60 feet;
THF~CE south along the west boundar,y line of said old Ash Avenue a
distance of 287.1 feet;
THENCE southeasterly along the said main track center line, a distance
of 63.2 feet to the point of beginning;
, and the same is hereby abandoned, vacated and closed for street purposes.
SECTION 2. ·There is hereby excepted and reserved, however, a permanent
nd perpetual easement for any and e,ll existing utility lines and structures now
n or running through, over, under and across the si:iJip of land described in
ECTION 1 hereof, particularly an easement is reserved for an electric transmission
ine running north and south over and across said land.
AND IT IS SO ORDERED.
