I II Ol -IU-1..954-- ORDINANCE NO. 1518 ···-- , 0\ -~<0-\.SS~ AN ORDINANCE RELEASING AND AUTHOlUZING THE 1-J!~ YOR TO JOIN wl:Tff . . ~ ELLIO'l'T ;TAYLOR, ';, IN A RELEASE OF PAVING ASSESSMElfTS ON PROP.IillTY ABUTTING PARTS OF 6TH STREE'l', AVENUE S, AVENUE U, 15TH STREET Al~D 17TH STREEI', SUCH Rl:!:LEAS BEING LHUTED TO THE PROPERTY ABUFTING THE LEAV:OOUT PAVIt~G UNITS SPECIFIC.U.LY DESCRIBED IN THIS ORDINANCE AND TO THE ASSESSl-iEHTS l"1ADE UNDb.R PAVING Ol:IDII,..rt.l\CE NO. 1214 UNDER G.'lr'l.O. 667, AS RECORDED IN VOLUME 476, PAGE 416, DEED ~C01iDS UF LUBBOCK COmfTY, T~~S. \"H1ERE.\S, the City of Lubbock on or about the 12th day of June, 1952, passed its Paving Ordinance No. 1214, which ordinance levied and assessed various properties in the City of Lubbock certain specified amounts for street improve- ment purposes; and, vffiEREAS, such Ordinance \lfas filed in the Deed Records of Luobock County, Texas, on the 23rd day of June, 1952, in Volume 476, page 416, constituting an apparent lien on properties contained therein; and, WHEREAS, Elliott Taylor, contracted, as set out in such Ordinance, to pave all that property contained in such Ordinance, but such paving as planned was not carried out in its entirety as originally planned for the reason that the said Elliott Taylor was unable to obtain sufficient legal guaranty of pa~aent on certa.in ·properties abutting the leaveout paving units or portions thereof herein- after designated, and the said Elliott Taylor is willing and agreeable to abandon and not pave any portion of the hereinafter described leaveout paving units, uud, ~JHEHEAS, the present ov.'llers of such property are desirous of obtuining a release on all that property abutting those leaveout paving units hereinafter described Nhich h::l'5 not been paved, and there being no intent in the immediate future plans of the City for such JX:1.Ving, and the City Commission deems it Nise and expedient to abandon such pu.vlng, \vhich action has resulted in the abandonment of the assessment liens against the property abutting such paving units or portiO.·G thereof hereinafter specifically designated; THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the paving liens created by Ordinance No. 1214 recorded in Volume 476, page 416, Deed Records of Lubbock County, Texas, against those lots, tracts or parcels of land abutting the hereinafter described leaveout paving units are hereby in all things released, and the Hayor is hereby authorized and directed to join with Elliott Taylor, the paving contrn.ctor, in the execution of a release to be filed with the County Clerk of Lubbock County, Texas, said property so released being limited to the property abutting the paving units or portions thereof hereinafter described, all of which are lying and being situated in Lubbock, Lubbock County, Texas and further described as follows, to-<.Yit: Leaveout Paving Unit L.o. 2 L.O. 5 L.O. 6 t.o; 7 t.o. 10 L.O. 11 L.O. 12 Location and Property to be Released 2421 -2423 6th,Lots 11, 12, Blk. 131, Overton Addition 802 -806 Ave. S, Lot 1, Blk. 29, Overton Add. 902 -906 Ave. U, Lot 1, Blk. 58, Overton Add. 907 -909 Ave. s, W! of Lots 6 & 7, Blk. 116, Overton Addition 1906 15th St., Lot 22, Blk. 23, Overton Add. 1610 Ave. U, Lot.24, Block 51, Overton Add. 1702 -1706 17th St., Lot 5, Blk. 7, Overton Add Leaveout Paving Unit Location and ,Property to be Released L.O. 34 411 -417 15th St., Lot 1, Blk. 187, Original Town AND IT IS SO ORDERED.
