Insp., City Tax City Atty Plan Engr pagel \ {)' l;;l-lO-l~S-3 ORDINANCE NO. ~504 l ~ -.;).;;) -\ 9 s -=s AN ORDINANCE AMENDING .ZONING ORDINANCE_!«). 661 TO INCLUDE SECTiON VI-A TO INCLUDE AND CREATE A "F-1" DISTRICT; PROVIDED FURI'HER FOR AMENDMENT TO ZONING ORDINANCE NO. 661, SECTION XIV TO INCLUDE FRONT YARD RmULATIONS FOR THE "F-1" DISTRICT HEREIN CREATED, REQUIRING A 43-FOOT SETBACK OR BUILDING LINE FOR THE FRONT YARD IN SUCH DISTRICT; AND CONTAINmG A SAVINGS CLAUSE. WHEREAS 1 this proposed amendment to the Zoning Ordinance bas been submit~d tor the Planning and Zoning Commission for ite recOJDJ'JI9ndation and report and said Commission hae recommended to the City Commission that Zoning Ordinance No. 661 be amended to include Section Vii-A establishing regulatioDS tor a "F-1• Distric't, and further, by amending Section nv to require a 43-foot front yard setback in such Dietric't, which recommendation was received by the City Commission, and, attar due consideration, the City Commission finds that D&king the proposed amenclmnts more tully hereinafter set out would be in the public interest and would promote the heUth, eatet7, morale and general welfare of the general public and lessen the congestion in the streets aDd provide greater safety trom fire, paJlio and other dangel'l!l and provide adequate light and air and ~v,.ent the overcrowding ot land to avoid undue concentration ot population and oth'er public requirementSJ and, WHER&.A$1 all conditions precedent required by law tor a valid amendment to the Zoning Ordinanoe0have been~ oomplied with, and notice was duJ.7 published on the #-:J..~ day ot ~ \M. b 4. r , 195-:!L in the Lubbock Morn!Dg Avalanche, and the publiq hearing, according to said notice, was held at 2:00 p.m. on December 101 1953 in the Oity Commission Room on the First Floor or the City Hall, Lubbock, Texas, at vbicb time persons appeared in support or the proposal; and attar· said hearing it was by the City Commission determined tbat it would be in the public interest, due to changed conditions, that the Zoning Ordinance be amended in substantial oourpl.ianoe with the recommendations ot the Planning and Zonblg Commission; THEREFORE, B& IT ORDAINED BY THE CITY OO:MMISSION OF THE CITY OF LUBBOOKa SECTION 1. That Ordinance No,. 661, commonly known as the Zoni.Dg Ordinance, be amended to include Section VI-Ae •BOOULATlONS FOR tF-1' DISTRICT, • which shall provide as tollwa: Section VI-A. REGULATIONS FOR "F-111 DISTRICT. In an "F-1• District no building or land shall be used and no building shall be hereafter erected or structurally altered which is arranged or designed to be used for other thAn one or more ot the following uses: (1) AJJ7 use permitted in any of the foregoing districts, •A• through WE, tt inclusive. (2) Bamk, office, studio. (3) Restaurant or cafe, wbioh prgvidea no service outside ita buUding. (4) RetaU pressing, dyeing and cleani:Dg shops. (5)RataU store, barber shop, beauty parlor, and other shops for custom work or the making or artioles to be sold a~ retail on the premises. Provided that no "Second-band goods• store or yards will be permitted in this Distriot. (6) 'Wasbaterias. (7) Advertising Signs, in connection with the business use ot the rem1.a_g_. (8) Poster Boards, when such poster boards are located as tollovs: (c) (d) On the roof ot a commercial structure. Attached to, or within ~e (3 • )teet, and parallel to the wall Of a CODIIIIel'Cial building • On vacant property, provided such poster board is not within one hundred and tventy-f'i ve (125 ') teet ot any property zoned for residential purposes that tronta on the sam at.reet as the poster board. Provided also, that in case a poster boa.rd is erected on a corner lot, both streets shall be considered fronting streets, regardless ot the actual direction the poster board faces. In no event shall a poster board be located closer to a property line than that allowed tor a coDIIDircial structure. Further, tba t the setback troll a street shall be not less than the building(s) adjacent there- to, and that for a corner lot looa tion the poster board shall be at least torty-three (4.3 1) teet frCII both streets. Provided further, that a permit be secured from the Building Inspector for each poster board to be erected under the above provisions. A plat shall be submitted to the Building Inspector showing the proposed looa tion of such poster board and the location of any buildings adjacent thereto. The area and building height, rear yard, side yard, and lot area regulations for this district shall be the same as required in the "F• Zoning District. SECTION 2. '!'hat Section XIV ot Ordinance No. 661, cODIDODl.y lcnown as tha Zoning Ordinance, be amemed to include "F-1• District, which shall have front yard regulations as follows~ ttp\..1" DISTR1CT• In an 1t!'-l" District, the setba.ok, or building line, for aey build!~ or structure shall be a minilnum or fol"t7-three (43') te~ for the front yard as that tem is herein defined. SECI'ION .3. That it any section, paragraph, subdivision, olause, }ilrase or provision ot this Ordinance shall be adjudged invalid or held unconatitutioml, the same shall not affect the validity of this Ordinance as a whole or any part or provision thereof other than the part so decided to be invalid or unconsitutio AND IT IS SO ORDERED.
