""1476 AN ORDINANCE AMENDING ORDffiAN~E NO} '1i~l?E;./PrT'i~-, -"A_N __ ORDINANCE AUTHORIZING TEMPORARY EXTENSIONS OF WATER AND SEWER L.INES .INTO CERTAIN SPECIFIED AREAS PREVIOUSLY IMPROVED IN CERTAIN 1 lAKE AREAS'; SUSPENDING THE OPERATION OF THAT PART OF POLICIES, RESOLUTIONS AND ORDINANCES IN CONFLICT HERE- WITH; DECLARThTG AN EMERGENCY ThT THE INTEREST OF HEALTH, SAFETY AND PUBLIC WELFARE; AND PROVIDING EFFECTIVE DATE OF THIS ORDINANCE11 ; SO AS TO PRESERVE THE APPLICATION OF SAID ORDINANCE AS THE SAME APPLIED ON AND PRIOR TO DECEMBER 19, 1951, AND TO FURTHER REGUlATE AND PERMIT THE CONSTRUCTION OF UTILITIES, PUBLIC WORKS AND PAVING IN PARKS IN SUCH 11 I.AKE AREAS. WHEREAS, Ordinance No. 1153 defines "lake area'' and prohibits the dumping or other placing of any dirt, debris or other solid materials in any "lake area," and the Commission finds that it is necess.ary in the public inter- est to construct certain public works, extend public utilities, and pave certain roadways, which are not calculated to decrease the water-holding capacity of such 11lake areas," and Ordinance No. 1153 is being amended to permit the construction of such public works which are not designed or calculated to decrease the water•holding capacity of said "lake areas, 11 and the same is be- ing done in the interest of public economy, efficiency of operation and public need; THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK; THAT, Ordinance No. 1171 BE, and the same is hereby amended to read as follows: SECTION 1. That the City Engineer BE, and he is hereby authorized to extend sanitary sewer service to the following described property, to-wit: (a) Block Two (2), Southview Subdivision, B. c. Wells Subdivision, Stewart Saylor Subdivision, and Lot One (1) of the Wolverton Subdivision, all located on the North and East sides...of the "lake area11 located at 4Zd Street and Avenue W (reference is made to Engineering Department Drawing File No. 3-0-10}. (It is under.stood that the above described properties are now served with City water.} SECTION 2. That the City Engineer BE, and he is hereby authorized to extend water and sewer lines to serve houses located below the estimated high- water level on the Northwest corner and the Southwest corner of the "lake area11 located cyt 50th Street and Avenue A, reference being here made to the Engineer ing Departmentts Drawing File No. 5-0•3. SECTION 3. It is the intention of this ordinance to authorize the exten- sion o£ water and sewer service to the areas described herein which have been.a improved by the construction of residences and other structures prior to · December 19, 1951, but this ordinance shall not be construed as authorizing the granting of building permits for any new construction or the extension of water or sewer lines to other than those structures which existed on the prop- erties described in Sections 1 (One) and Two (2) of this ordinance. This ordi- nance shall not be construed to prohibit the construction of any public work or the extension of any public utility, or the paving of any roadway in any public park, in any "lake area, 11 as that term is defined in Ordinance No. 1153, as amended, when the project is planned and/or th~ work or contract is done with •.
