HomeMy WebLinkAboutOrdinance - 1474-1953 - Releasing And Authorizing Mayor To Join With Warren And Purtrell Incorporated - 10/22/1953~-t ~ ~~~--------------------==----------------------------====----=----- ,...., 1 GWO 721 10-:;;ld-!.95 3 ORDINANCE NO. 1474 11-1~-1..953 AN ORDINANCE RElEASING AND AUTRORIZDJG THE MAYOR TO JOIN WITH WARREN AND PURTELL, INCORPORlTED, IN A RELEASE OF PAVING ASSESSMENTS ON PROPERTY ABUTTING PARTS OF AUBURN STREE:T, 28TH STREET, MEMPHIS AVENUE, 4orH STREET, JUNIPER AVENUE, QUAKER AVENUE, 36TH STREET, ORLAND~ AVENUE, AVENUE U, EAST 31ST STREET AND LOUISVILLE AVENUE, SUCH RELEASE BEING LIMITED TO THE PROPERTY ABUTTING THE PAVING UNITS SPECIFICALLY DESCRIBED IN THIS ORDINANCE AND TO THE ASSESSMENTS l"iADE UNDER PAVING ORDINANCE NO.l356 UNDER G.W.O. 721, AS RECORDED IN VOLUME 497, PAGE 25, DEED RECORDS OF LUBBOCK COUNTY, TEXAS. WHEREAS, the City or Lubbock on or about the 23rd d~ or April, 1953, passed its Paving Ordinance No.l356, vhich ordinance levied and assessed various properties in the City of Lubbock certain specified amounts for street improvement purposes; and, WHEREAS, such Ordinance was filed in the Deed Records of Lubbock County, Texas, on the ,29th day of April, 1953 in Volume 497, page 25, constituting an apparent lien on properties contained therein; and, WHEREAS, Warren and Purtell, Incorporated contracted, as set out in such Ordinance, to pave all that property contained in such Ordinance, but such paving as planned was not carried out in its entirety as originally planned for the reason that the said Warren and Purte]l, Incorporated ~s unable to obtain sufficient legal guaranty of payment on certain properties abutting the paving units or portions thereof hereinafter designated, and the sa~ Warren and Purtell, Incorporated is willing and agreeable to abandon and not pave 'any portion of the hereinafter described units or portions thereof, and, ... WHEREAS, the present owners of such property are desirous of obtaining a release on all that property abutting those paving units or portions thereof hereinafter described which has not been paved, and there being no intent in the immediate future plans of the City for such paving, and the Uity Commission deems it wise and expedient to abandon such paving, which action has resulted in the abandonment of the assessment liens against the property abutting such paving units or portions thereof hereinafter specifical~ designated; THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCKi THAT the paving liens created by Ordinance No. 1356, recorded in Volume 497, page 25, Deed Records of Lubbock County, Texas, against those lots, tracts or parcels of land abutting the hereinafter described paving units or portions thereof are hereby in all things released, and the ~or is hereby authorized and directed to join with Warren and Purtell, Incorporated, the paving contractor, in the execution of a release to be filed with the County Clerk of Lubbock County, Texas, said property so released being limited to the property abutting the paving units or portions thereof hereinafter described, all of which are lying and being situated in Lubbock, Lubbock County, Texas, and further described as follows, to-wit: Paving Unit Location 945-B Auburn Street from WPL North Gary Avenue to WPL North Flint Avenue 139S 28th Street from EPL ¥~mphis Avenue to "60 ft. East of EPL Memphis Avenue - v Paving Unit Location 1400 1401-A l~mphis Avenue from SPL 27th Street to NPL 28th Street Memphis Avenue from SPL 28th Street ~o NPL alley between 28th and 29th Streets Part of 1435 40th Street from EPL Avenue X t~~WPL Avenue W and includes only the following property: 1451 Part 1472 1474 Lots 9, 10, 11, 12, 13, 14, 15, 16, 17 and 18, Block 4, Woolverton Addition Lot 1, Block 13, Alta Vista Acres Juniper Avenue from S. paving line RR Avenue to N Paving Line East 34th Street of 1470 West one-half of Quaker Avenue from NPL 30th Street to North Paving Line 34th Street and East one-half of Quaker Avenue from SPL 32nd Street to NPL of alley South of 32nd Street and includes only the following property: Block 5, Zellner Acres The West 100 ft of the East 160 ft of the South 534 ft of the property described as beginning at a point 297 varas north of the southeast corner of Section 17, Block B, Lubbock County, Texas; Thence north 653.4 varas; Thence West 748.9 varas; Thence south 53°50' West 248.6 varas; Thence South 506.7 varas; Thence east 950.4 varas to the place of beginning. Lot 10, Block 3, Roberson Addition 36th Street from East line of Ft. Worth & D. c. RR R.o.w. to the WPL Avenue J Orlando Avenue from S. Paving Line 46th Street to NPL 47th Street Part of 1476 Avenue U from the SGL 40th Street to the NPL 42nd Street and includes only the following property: --- Lot 1, Block 1, B. C. Paving Line RR Avenue 1495 Louisville Avenue from SPL 31st Street to NPL 32nd Street AND IT IS SO ORDERED.
