HomeMy WebLinkAboutOrdinance - 1467-1953 - Releasing And Authorizing Mayor To Join With Warren And Purtrell Incorporated - 09/29/195309-Q9-t ~S'3 ORDINANCE N0."-14b7 lo-~-\95:3 AN ORDINANCE RELEASING AND AtrrHOR1ZING THE MAYOR TO JOIN WITH WARREN AND PURTELL, n lCORPORATED IN A RELEASE OF PAVING ASSESSMENTS ON PROPERl'Y ABUTTING PARTS OF NORTH ELGIN AVENUE, DUKE STREET, ZENITH AVENUE, AMHERST STREET, NORl'H DETROIT AVENUE, AUBURN STREE!', EAST 33RD ST~ AND TEAK AVENUE, EAST lGrH STREET, 24TH STREET AND EAST-WEST ALLEY FROM AVENUE P TO AVENUE Q BETWEEN 13TH STREEI' AND BROADWAY, SUCH RELEASE BEING LIMITED TO THE PROPERTY ABUTTING THE PAVING UNITS SPECIFICALLY DESCRii3ED IN THIS ORDI~ANCE AND TO THE ASSESSMENTS MADE UNDER PAVING ORDINANCE NO. 1179 UNDER G.'W.O. 643, AS RECORDED rn VOLUME 469, PAGE 139, DEED RECORDS OF LUBBOCK COUN!'Y, TEXAS. I WHEREAS, the City of Lubbock on or about the 28th day of February, 1952, passed its Paving Ordinance No. 1179, which Ordinance levied and assessed various properties in the City of Lubbock certain specified amounts for street improvement purposes; and, WHEREAS, such Ordinance was filed in the Deed Records of Lubbock County, Texas, on the lOth day of March, 1952, in Volume 469, page 139, constituting an apparent lien on properties contained therein; and, WHEREAS, Warren and Purtell, Incorporated, contracted, as set out in suoh Ordinance, to pave all that property contained in such Ordinance, but such paving as planned was not carried out in its entirety as originally planned for the reason that the said Warren and Purtell, Incorporated, was unable to obtain l sufficient legal guaranty of payment on certain properties abutting the paving units or portion thereof hereinafter designated, and the said Warren and Purtell, Incorporated, is willing and agreeable to abandon and not pave any portion of the hereinafter described units or portion5 thereof; and, l~AS, the present owners of such property are desirous of obtaining a release on all that property abutt ing those paving units or portions thereof hereinafter described which has not been paved, and there being no intent in the immediate future plans of the City for such paving, and the City Commission deems it wise and expedient to abandon such paving, which action has resulted in the abandonment of the assessment liens against the property abutting such paving units or portions thereof hereinafter specifically designated; THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the paving liens created ~ Ordinance No. 1179, recorded in Volume 469, page 139, Deed Records ot Lubbock County, Texas, against those lots, tracts or parcels of land abutting the hereinafter described paving units or portions thereof are hereby in all things released, and the Mayor is hereby authorized and directed to join with Warren and Purtell, Incorp~rated, the paving contractor, in the execution of a release to be filed with the County Clerk of Lubbock County, Texas, said property so released being limited to the property abutting the paving units or portions thereof hereinafter described, all of which are lying and being situated in Lubbock, Lubbock County, Texas, and further described as follows, to-wit: Paving Unit Location Part of l2S6-B North Elgin Ave. from NPL Erskine St. to NPL alley South of Erskine St. ~ includes only !h! followtng abutting propertY: Lot 1, Block 5 and Lot 5, Block 1, Tech Gardens (Paving Unit and Location, continued) 1293 Duke St. from WPL North Canton Ave. to WPL of North Detroit Ave. Part of 1295-A Zenith Ave. from SPL East 9th St. to NPL of alley south of East 9th ~ includes onlY ~ followini abutting property: Lot 15, Block 9 and Lot 1, Block 6, C.
