Legal did research on this March 3 and 4, 1988. 09 -~.9--(..9 5 3 l4iPI opy 10-2- 953 to olice Dep • City Atty Traffic Engineer, President Texas Tee College ORDINANCE NO. 1461 ----- AN ORDrnANCE REGULATING AND PROVIDING CONTROU3 FOR VEHICULAR AND PEDESTRIAN TRAFFIC ON THE TEXAS TECHNOLOGICAL COLLEGE CAMPUS AND PROVIDING UNIFORM CONTROL DEVICES, INCLUD ING SIGNS AND SIGNALS AT LOCATIONS SHOWN ON EXHIDITS 1. 2, 3, 4, AND 5 ON FILE WITH THE CITY SECRETARY OF THE CITY OF LUBBOCK AND MADE A PART OF THIS ORDINANCE BY REFERENCE; LIMITING SPEED OF VEHICLES TO ZO MILES PER HOUR ON ANY ROAD, STREET OR ALLEY ON THE CAMPUS, AND TO 10 MILES PER HOUR ON ANY PARKING LOT; PROHIBITING PARKING ON ANY PAVED STREET 1 ROAD OR ALLEY WHERE 11NO PARKING,.. SIGNS ARE DULY PLACED; AUTHORIZING THE TRAFFIC ENGINEER OF THE CITY OF LUBBOCK TO PLACE CONTROL DEVICES AT PLACES DESIGNATED ON SAID EXHIBITS. AND ADDITIONAL CONTROL DEVICES, INCLUDING SIGNS, WHEN REQUIRED BY TRAFFIC CONDITIONS; REGULATING THE PARKING OF VEHICLES WHILE LOADING AND UNLOAD- ING .PASSENGERS, GUESTS AND COMMODITIES; PROHIBITING USE OF THE STREETS .. ROADS AND ALLEYS ON THE CAMPUS BY TRUCKS EXCEPT WHEN REQUIRED FOR DELIVERY OF COMMO.QITIES THEREON; PROVIDING FOR IMPOUNDING OF VEHICLES PARKED IN VIOLATION OF THE PROVI- SIONS OF THIS ORDINANCE AND OTHER ORDINANCES OF THE CITY OF LUBBOCK. PROVIDING IMPOUNDING FEES; FURTHER PROVIDING FOR " 11SCHOOL -SLOW11 AND "TRUCI<S KEEP OUT" SIGNS AT ALL CAMPUS ENTRANCES; PROVIDIN'G A REPEALING CLAUSE, SAVINGS CLAUSE, PEN- ALTY CLAUSE; DIRECTING PUBLICATION OF THE CAPTION AND PENALTY CLAUSE OF THIS ORDINANCEJ~·D DECLARING AN EMERGENCY. WHEREAS, the undedicated streets, roads and alleys located on Texas Technological College Campus are permissively used by students and the public generally and the same constitutes a school area requiring special control devices to provide adequate safety to pedestrians and other persons within the area described in Section One (1) of this ordinance, and th~ campus has no adequate contr.ol devices, creates an emergency; THEREFORE 1 BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. For the purpose of this ordinance, the Texas Technological College Campus is described as follows, to-wit: BEGINNING at the Northwest corner of 19th Street a-~d College Avenue; THENCE North to the Southwest cornel"' of Fourth Street and College Avenue; THENCE West to the East right-of-way line of the Brownfield Highway, U. s. Highway 6.2 and Fourth Street; THENCE South- westerly along the Southe..asterly right-of-way line of the Brownfield Highway, U. S. Highway 62, to the North line of 19th Street; THENCE East to the POINT OF BEGINNING. SECTION z. It shall be unlawful for the driver or any other person in control of a vehicle to operate or permit any such vehicle to be operated on any street, drive, or roadway within the Texas Technological College campus at a rate of speed in excess of twenty miles per hour (20 MPH). SECTION 3. It shall be unlawful for the driver or any other person in control of a vehicle to operate or permit any such vehicle to be operated within any parking lot upon the Texas Technological College campus at a rate of speed in e?'cess of ten miles per hour (10 MPH). P. 2. SECTION 4. It shall be unlawful for the driver or any other person in charge of a vehicle to park or permit a vehicle to be parked on the paved por- tion of any street, drive, or roadway on the Texas Technological College campus where "No Parking" signs are lawfully placed thereon and designated as shown on Schedule (Exhibit) 1 (One) of this ordinance. SECTION 5. It shall be unlawful for the driver or any other person in charge of a vehicle to park or permit a vehicle to be parked on the paved portion of any street, drive, or roadway on the Texas Technological College campus between the hours of 7:00A.M. and 5:00P.M. where signs are lawfully placed thereon and designated as "No Parking 7 A.M. to 5 P.M. 11 and designated as shown on Schedule (Exhibit) 2 (Two) of this ordinance. SECTION 6. It shall be unlawful to place any such signs on any street, drive, or roadway on the Texas Technological College campus unless the same be done by written direction of the City Traffi~ .Engineer of the City of Lubbock. SECTION 7a. One .. Way Streets. Upot:l those streets and parts of streets described as shown on Schedule (Exhibit) 3 (Three) attached hereto and made a part hereof of this ordinance, vehicular traffic shall move only in the indicated direction when signs indicating the direction of traffic are erected and main- tained at every intersection where movement in the opposite direction is prohibited. SECTION 7b. It shall be unlawful for any person to operate any vehicle in violation of such markers, signs, barriers, or other devices so placed in accordance with this section. SECTION 8. The City Traffic Engineer shall place and maintain traffic control signals as shown on Schedule {Exhibit) 4 (Four) of this ordinance and may place and maintain such additional traffic control devices as he may deem necessary to regulate traffic{under the traffic~rdinances of this city or under State Law. SECTION 9. The City Traffic Engineer is further authorized and directed to place such fl'dditional standard and approved signs at such.).ocations as may be deemed necessary to carry out the intent and purpose of this ordinance. SECTION 10. It shall be unlawful for the driver or any other person in control of a vehicle to stop, stand, or park a vehicle for any purpose or length of time other than for the expe.di:fieus unloading and delivery and pick-up a~d loading of materials in any place marked as a loading zone within the Texas Technological College campus for the purpose of this ordinance, the areas marked as loading zones as shown on Schedule {Exhibit) 5 (Five) of this ordinance. SECTION !1. Impounding of a Vehicle. Any vehicle parked in an alley or in front of a fire hydrant or on any part of a crosswalk, or in any loading zone, or on the turf, or on the street in violation of the traffic ordinances of the City of Lubbock, or abandoned on any street, may, upon the direction of the Chief of Police, be removed from such place and impounded by the Traffic Division at Police Headquarters Station in the City of Lubbock, and an impound- ing fee of $2.50 plus storage shall be assessed against said vehicle and the owner or driver thereof and collected before such vehicle is released. The payment of the impounding fees shall not constitute a defense to any charge against the driver or owner of such vehicle for violating· said traffic ordinance prohibiting or limit- ing such parking. The fees herein provided for shall be charged and collected by the City Recorder and accounted for, and such sum as may be collected shall be used to defray the expense of impounding and transporting such impounded vehicles. SECTION 12. It shall be unlawful for th~ driver or any other person in control of a truck to operate or permit any S\lCh truck to be operated on any stree drive, or roadway within the Texas Technological College campus other than trucks making deliveries on the Texas T~chnological College campus. SECTION 13. The City Traffic Engineer is authorized and directed to place the following traffic control signs at all entrances to the Texas Technologi- cal College campus: 11School -Slow, 11 "Trucks Keep Out. tt SECTION 14. Unless another p,enalty is expressly provided by law, every person convicted of a violation of any provision of this ordinance shall be punished by a fine of not more than Two Hundred Dollars ($200). SECTION 15. All ordinances and parts of ordinances pertaining to traffic control and regulation on Texas Technological College campus in conflict with the provisions of this ordinance are hereby repealed. SECTION 16. The fact that no adequate traffic control deviceJs, signs' and~ signals are operative upon the roads, streets and alleys of Texas Technological College campus, and the further fact that a new semester is about t(li'begin at the college and public safety requires immediate control of vehicular traffic, creates an emergency, requiring that all rules relating. to the passage of ordin- ances on more than one reading be suspended, and• the ,!lame are hereby .,sus- pended and this ordinance and its provisions shall b'ecothe effective from and after the date of its passage, provided, however, tP,at the caption and penalty clause shall be duly publish~d as provided for othe~ or4inances of a penal nature.
