HomeMy WebLinkAboutOrdinance - 1458-1953 - Abandoning And Closing A Portion Of Compress Ave. - 09/29/1953Copy 10-2-53 to liildg.Insp City Atty City Engr page 6..9 -.;:>9 -I .95 3 ORDINANCE NO. 1458 AN ORDINANCE ABANDONING AND CLOSING A PORTION OF COMeRESS AVENUE IMiEDIATELY NORTH OF AND ADJOINING EAST l9l'H STREET FOR STREET PURPOSES AND RESERVING SUCH PORTION CLOSED FOR OTHER CITY PURPOSES, AND AUTHORIZING AND iQIRIOOTIBG THE DIRECTOR OF PUBLIC WORKS TO BARR!CADE THAT PORI'ION CLOSED; AND DECLARING AN EMERGENCY. WHEREAS, in contract and agreement with the Texas State Highway Depart- ment it was contemplated that Compress Avenue, as it extends into East 19th Street on the North of 19th Street, would be abandoned and closed for street purposes and that a new access road to 19th Street further East of that portion to be closed would be opened for public travel making access to East 19th Street more accessible, and such new public w~ having been opened; and, WHEREAS• it appears from the records that that portion of Compress Avenue to be closed and abandoned for street purposes is owned in fee simple b.Y the City of Lubbock and that the City of Lubbock owns that property i.Inmadiataly east and adjoining that portion herein closed, and that even though the same is not now needed for the public for street purposes and that the same should be closed and abamoned as a public street but should be reserved by the City of Lubbock for use in conjunction with it8 adjoining properties for other public purposes, and that the sa.ma should. be physically closed and barricaded to prevent public travel upon such portion to be closed; and, WHEREAS., the closure and abandonment of such property for street purposes is necessary for the preservation of the public peace, property and safety in that public travel upon such street creates a traffic hazard at its intersection with east 19th Street as it now exists; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. That that part and portion of Compress Avenue lying North of East 19th Street in the City of Lubbock, Texas, being more particularly described as follows, to-wit: BEGINNING at a point 1642.54 feet East and 146.42 feet North of the Southwest corner of Survey 3, Block 0, Lubbock County, Texas, said point being the intersection of the North right-of-way line of East 19th Street, and the East right-of- way line of Compress Avenue; THENCE North 39° 511 West a distance of 215.96 feet to a point; THENCE North 74 ° 13' West a distance of 106.29 feet to a point; ~ THENCE South 39° 51 t East a distance of 260.86 feet to a point; THENCE North 88° 02 r East a distance of 83 .14 feet to the FOINT OF BEGINNING, BE, and the same is hereby abandoned and closed for street purposes. SECTION 2. It appearing from the records that such portion herein abandoned and closed for street purposes is owned in fee simple by the City of Lubbock, the same is hereby reserved by and to the City of Lubbock for other public purposes and uses. SECTION 3. That the Director of Public ~orks BE, and he is hereby authorized and directed to physically close and barricade that portion of Compress Avenue here~n closed to public travel. _) -,r;--£ paga2 SECTION 4. That an emergency exists for the reason tha.t such intersectio as it exists · creates a traffic hazard and the immediate passage ot this Ordinance is necessary for the preservation of the public peace, property and safety, it is therefore necessary that the rule requiring two readings before the passage of any ordinance is hereby dispensed ui. th and· this Ordinance is passed by' a 'UD8llimoUs vote of the Commission on the date of its introduction and shall take effect from and after its passage as provided by law.
