AN ORDINANCE PROHIBITING PERSONS LEAVING OUTSIDE OF ANY
BUILDING OR DWELLING UNATTENDED, DISCARDED OR ABANDONED
REFRIGERATORS, ICE BOXES AND OTHER CONTAINERS; AND· PROVIDING
A PENALTY NOT EXCEEDING $200.
W HER E AS , an emergency exists in the City of Lubbock. in that in stan-
ces have been reported in other cities of death due to suffocation of children in
abandoned, unattended ice boxes, refrigerators and other containers having
air-tight doors which when closed cannot be opened from the inside; and,
WHEREAS, such abandoned, unattended or discarded ice boxes, refrig-
erators and other containers are a constant menace to the health, welfare and
safety of children in the City of Lubbock; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. It shall be unlawful for any person, firm or corporation to
leave outside of any building or dwelling in a place accessible to children any
abandoned, unattended or discarded ice box, refrigerator or any other container
of any kind which has an air-tight door, or lock which may not be released for
opening from the inside of said ice box, refrigerator or container.
SECTION 2. It shall be unlawful for any person, firm or corporation to
leave outside of any building or dwelling in a place accessible to children any
abandoned, unattended or discarded ice box, refrigerator or any other container
of any kind which has an air-tight snap-lock or other device thereon without
first removing the said snap-lock or doors from said ice box, refrigerator or
container.
SECTION 3. Any person, firm or corporation violating any of the provi-
sions of this ordinance shall be deemed guilty of a misdemeanor and upon
conviction thereof shall be fined not exceeding Two Hundred Dollars ($200}.
Each day such violation is committed or permitted to continue, shall constitute
a separate offense and shall be punishable as such hereunder.
