M~S-.2 __ _ 0£> -~-1:9-S ~ AN ORDI~E ESTABLISHING BUILDING LINES ON THE EAST AND WEST SIDlS OF THAT PART AND PORI'ION OF QUAKER AVE:trnE LYING BETWEEN THE :NORl'H LINE OF 5Gnl STREET AND THE EAST RIGHT-OF-VAt LINE OF mE BROWNFIELD HIGHWJ.Y, SAID BUILDilil LINES BEING M>RE PARTICULARLY IEOORIBED BY "foETES AND BOUNm IN '!'HE BODY OF THIS ORDINANCE• PROVIDING THAT NO BUILDING AND O!'HER S'l'RmTURES SHALL HEmaFTER BE EREX:TED, HE- ERECTED OR SUBSTANTIALLY REPAIRED BETWEEN SUCH BUILDING LINES; REQUIRING EXISI'IIfG STRI£TURES ON OR BETWEEN THE BUILDING LINES HEREIN ESTABLISHED TO CONFORM TO SUCH BUILDING LINES WITHIN FIVE YEARS; DEFINING "BUILDING LINE• AND PROVIDING THAT SETBACK REQUIREMENTS UNDER ORDDlANCE NO. 661 AND .AMENDMERrS THERETO BE IE'l'ERMIRED FH)M THE BUILDING LINE HEREIN ESTABLISHED; PROVIDII«l EXCEPTIONS FOR UTILITY EXTENSIONS AND PUBLIC IMPROVEMENI'S; PBOVIDING FOR A PENALTY; AND PROVIDING FOR PUBLICATION OF THE IESCRIPTIVE CAPTION AND PENALTY CLAUSE OF THIS ORDINANCE. WHE'HEAB, Article llOSa,, Revised Civil Statutes of Texas, provides for the establishmnt of Building lines on any part or side of aJq street in the City or Lubbock, said City ot Lubbock having a population of more than 15 1000; and, WHEREAS, the City Comnission of the City of Lubbock finds that it vould ba in the publlo interest to establish building lines in connection with the widening, opening, straightening and imprO'\'iDg of that part of Quaker Avenue desoribed in the body of this Ordinanoe; and, WEHEAS, the widening, straightening and improvements of said Quaker Avenue and tbe esta.bliabment of such building lines are necessary and will ultimately provide streets of desirable ~ adequate vidths which will aid in relieviag heav,-traffic in conjested areae in accordance with the Cit,.''a oompre- hensive plan, and the Cit7 Planning Comission bas recoDmended such imprOTements; THEREFORE, BE IT ORDAINED BY THE CITY C<»++ISSION OF THE CITY OF LUBBO(J(: SECTION 1. That pub.Ue necessity, convenience and safety in the City of Lubbock requires the extension, opening, widening, construction and improvement of that part of the street hereinafter designated within the building lil:Jes as herein established. 1 SECTION 2. That a building line is hereby established on the east and vest sides of Quaker Avem.e lyir:lg between the points hereinafter described and within tbe corporate bo~es of the City of Lubbock, which east and west buildi lines are more partieularly described as follows, to-vits EAST SIDI1 BEGINNING at a point which is 45.00 feet East of the Southwest Corner of Section 16, Block B, Lubbock County, 'l'e:xaa; THEl(CE Borth with a line which 1a 45.00 feet East and parallel to the West line of said Section 16, Block B, a distance of 1167 .s feet, more or less, to a point, said point being in the Southwest. SECTION 3. That no building or other structure shall hereafter be erected re-erected or substantially repaired and no new structures or parts thereof shall be erected or re-erected on that part of 'bhe street or land herein designated within said building lines hereinabove described. SECTION 4. That all structures on or between the building lines establish ~d by this Ordinance or extending in whole or in part within such building lines are hereby required to conform to the new building lines established in Section Two (2) of this Ordinance within five years from the effective date of this Ordinance. SECTION 5. The term "buUdiDg line" as used herein shall be construed to mean "street right-of-way line,• and the setback requiremnts under Zoning Ordinance No. 661 and all amendments thereto shall apply in addition to the right.- of""'f'ay lines or buildi~~g lines herein established, it being the intent and purpose of this Ordinance to preserve all land within the building lines herein established for ultimate street purposes. SECTION 6. The provisions of this Ordinance shall not apply to any officer, agent, employee or other person dul.7 authorized by the State of Texas and/or the City ot Lubbock when performiDg axv employmn" pursuant to the widen!Dg, straightening or extension of' the street and/or right-of-way contemplated by this Ordinance or authorized utUity extensions within the right-of-wq herein described. SECTION 7 • It shall be unlawful for aey person, fU. or corporation, trustee or any authorized agent or representative thereof to erect, reconstruct and substantiall.y repair an;r building or other structure or to ereot or re-erect any new building or other structure within or between the building lime established and described in Section Two (2) ot this Ordinance, and whoever shall violate &IJl" provisions of this Ordinance shall, upon conviction,be fined in aey sum not exceeding Two Hundred Dollars ($200). ~ SECTION 8. If arq section, paragraph, subdivision, clause, phrase or provision of this Ordinance shall be judged invalid or held unconstitutional, then same shall DOt affect the validity of the remainder of this Ordinance as a whole or au,y part or provision thereot other than the part so <Bcided to be invalid or unconstitutional. .
