AN ORDINAtroE PROVIDING THAT IT SHALL BS UNLAWFUL TO PARK OR LEAVE
STANDING ANY TROOK OR OTHER VEHICLE IN SOOH A WAY THAT WOULD NOT LEAVE .AT LEAST
TEN FEET CLEAR BETWEEN SUCH TROOK OR VEHICLE AND THE. PLAINLY MARKED CENTER OR
DIVIDING LINE OR BAiuUER OF SOOH STREEr; PROVIDING '!'HAT THIS ORDINAWE SHALL BE
CUMULATIVE OF THE PROVISIONS OF ALL OTHER ORDIN!BJESJ P:ROVlDING FOR A PENALTY; AND
PROVIDING FOR PUBLICATION.
WHEHSAS, on streets upon which have ~en painted, placed or constructed
dividers to separate vehicular traffic lllOri.12g in opposite directions, commonq
oalled "centerline• or "dividing barrier•, •D1' trucks, traUors and other -vehicles
are parked and left sta.ndillg while being loaded, unloaded or for other purposes
in a way and manner projecting such a distano:J into the street that insuf'f'icient
clearance is left between the whioles so parked or left etanc:'lillg aDd the oenterli
or dividiDg barrier of such street for moving vehicular traffic to safely pass; and
WHEREAS, the City-Comnission finds that it is necessary, in order to
protect and to praael"V'e the public streets tor the pri.mar;y and paramount purpose
f'or vhich the7 wre dedicated and established, that is, for longitudinal traf'f'ic
movement, to restrict and prohibit the leaving and parking of 8Jl7 such vehicle in
a va7 that vould not leave adequate spaoe for the lavtul a1ld safe passage of moving
traffic required b,y prudence as well as b7 law to sta.y to the right o.f' such
centerlinee and barriera; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOOKs
SECTION 1. It shall be unlavtul tor 8Jl1' driver or other person in control
of &JV' tl"UUk or other vehicle to park or permit the same to be parked, whether for
leading, unloading or any other ~se, on any public street in such a vay that
would not leave at least a ten (10 )-foot cleara.noe tor movhlg traffic bet-..en such
truok or other vehicle and the painted or otherwise plain17 mrked or constructed
dividillg line or barrier dividing suoh street for opposite vehicular travel.
SECTION 2. The provisions ot this Ordinance shall be cUJilU.l.ative o£. all
other ordinances, and sball never be construed as repeal.i.Jlg any part or ponion c-f
Ordinance No. 890 or an;y other ordinanae unless in direct oonf'lict hereWith,
regulatil'lg the parking of vehicles on public streets ot this City, except that the
provisions of this Ordinance ahall supersede Sub-Section (1) of' Section 4, of
Article XI o.f' said Ordinance No. 890 in only those oases vhere the provisions ot
this Ordinance are applicable; and, this Ordinance shall never be construed so ae
to pel'Diit the parking of &DJ' vehicle at aJl7 plaoe or in 8JV' way or DI8Dil8r upon aDJ
public street where such parlt.i.Dg or leaving of a vehicle standing is prohibited by
aJIY ordinance nov existing or that my be hereafter enacted by the Govenrl.Dg Bod7
ot the Cit7 of Lubbock.
SECTION 3• A1:q person, firm or corporation violati.Dg the provisions ot
this Ordinance shall upon conviction be fined in a.rv sum not exceeding Two Hundred
llara (t200).
SIOOTION 4• The Cit7 Secretar;y is hereby authorised and directed as an
lternative ll8thod ot publ~oation provided b7 law, to cause the ~blieation ot the
descriptive caption of thie Ordinance, together with the penalty clauee, once a
