D'f -09 -L953 ORDINANCE NO. 1 J,?3 ()=I -d=3 -1.953 AN ORDINANCE REQUIRJN"G RESTRAINT OF CERTAIN ANIMALS BY KEEPING THEM IN CAGES OR ON LEASHES; PROHIBITING SUCH ANIMALS BEING PERMITTED TO RUN AT LARGE ON PUBLIC OR PRIVATE PROPERTYi PROVIDING FOR THE IMPOUNDING AND RELEASE OF ANY S'UCH ANIMALS BY THE POLICE AND DOG CATCHER, MAINTENANCE DURING THE IMPOUNDING PERIOD, ESTABLISHING AN IMPOUNDING FEE; AND PROVID- ING A PENALTY. WHEREAS, the City has no ordinance requiring restraint of elephants, bears, tigers, leopards, monkeys, wildcats, skunks and other animals of like t nature which should be adequately restrained to promote public safety and pre• serve the public peace; THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. It shall be unlawful for any person who owns, or possesses, or has the duty of caring for any elephant, bear, tiger, leopard, monkey, wildcat, or skunk in its natural state, or any such animal usually confined to cages or restrained by leashes, to permit any such animal to run at large or upon any public place or private property. SECTION z. The owner or other person having the responsibility of caring for any such animal shall not keep, maintain, or bring any such animal within the corporate limits of the City of Lubbock unless such animal is securely caged or maintained and kept by a leash of sufficient strength and durability to restrain such animal at all times upon premises belonging to or under the control of the owner or other person having the duty to care for such animal, or upon premises where due consent has been given for the keeping, maintaining or possessing of any such animal. SECTION 3. Any person who shall wilfully or negligently fail to restr ain any such animal in the manner herein provided for shall be guilty of maintaining a nuisance, and upon conviction shall be fined in any sum not exceeding Two Hundred Dollars {$2.00). SECTION 4. When any animal named in Section 1 (One) of this Ordinance shall be found running at large in the City of Lubbock, or not in a cage, or not restrained by a leash1 as provided in this Ordinance, all police officers and the City Dog Catcher are authorized to capture, restrain and impound any s uch animal to preserve the public peace and safety. Any such animal may be restored to the person entitled to its possession if request therefor is timely made and all actual costs of maintaining the animal plus an impounding fee of Two Dollars and Fifty Cents ($Z. 50) for each animal are paid to the Chief of Police of the City of Lubbock or his authorized .representative, provided, how- ever, that the person entitled to possession of any such animal shall satisfy the thief of Police or his authoriz ed representative that equipment adequate to meet the provisions of this Ordinance in restraining any such animal is avail- able and will be used for such purpose. AND IT IS SO ORDERED.
