HomeMy WebLinkAboutOrdinance - 1412-1953 - Prohibiting The Sale Of Goods, ETC, Without A Permit. - 06/11/19530 R ...., /,1-f-1 - ~ It,'~~ 4.-h t w X, ~ _ ~ • 0 lJ -II -I q 5'3 ~ 2'" c. e: ,_"=::M<¥.=~,.=, ,..._ ORDINANCE NO. 1412 ov -2 5-Jq 53 ,_....; __ _ AN ORDINANCE PROHIDITING THE SALE OF GOODS, WARES, MER~ p, CHANDISE, AND OTHER COMMODITIES IN PUBLIC PAR.KS AND AT SWIM- MING POOLS OF THE CITY OF LUBBOCK BY ANY PERSON NOT HAVING A PERMIT DULY ISSUED BY THE PARKSUPERINTENDENT, PURSUANT TO AUTHORITY VESTED IN HIM BY THE PARK COMM.ISSION AND THE PROVI- SIONS OF THIS ORDINANCE; REQUIRING R~OlSTRATION OF PERMITS WITH THE PARK MANAGER AND/OR SWIMMING POOL MANAGER PRIOR TO OFFERING OR EXHIBITING ANY SUCH COMMODITIES FOR SALE; DESCRIB- ING DATA REQUIRED TO BE SHOWN ON SALES PERMITS; PROHIBITING THE USE OF PUBLICWAYS AND OTHER PUBLIC PROPERTY, INCLUDING STREETS AND ALLEYS, ADJACENT TO ANY PUBLIC PARK OR SWIMMING POOL FOR THE PURPOSE OF EXHIBITING, OFFERING FOR SALE1 OR SELLING ANY SUCH COMMODITIES; PROVIDIN'G FOR THE INSPECTION OF SALES PERMITS BY PARKAND SWIMMING POOL SUPERINTENDENTS, MANAGERS, AND UNIFORMED POLICE; MAKING IT AN OFFENSE FOR ANY PERSON TO REFUSE TO IMMEDIATELY REMOVE ANY GOODS, WARES, MERCHANDISE, OR OTHER COMMODITIES FROM PUBLIC PARKS, SWIM- MING POOLS, PUBLICWAYS, AND PUBLIC PROPERTY ABUTTING PUBLIC PARKS AND SWIMMING POOLS WHEN ANY SUCH PROPERTY FOUND LOCA- TED ON ANY SUCH PREMISES IS OWNED BY SUCH PERSON OR IN HIS POSSESSION OR UNDER HIS CONTROL! PRESCRIBING A PENALTY NOT EXCEEDING $200 FOR THE VIOLATION OF ANY PROV.ISION OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. It shall be unlawful for any person to go on or into or remain upon any public park or swimming pool of the City of Lubbock for the purpose of selling goods, wares or merchandise, or any other commodity, unless such person shall have previously applied to the Park Commission of the City of Lubbock for a permit so to do and pursuant to which said Park Commission has issued or caused its Park Superintendent to issue a written permit to sell goods, wares and merchandise in and upon such public parks and swimming pool grounds. SECTION 2. Any permit so issued by the Park Commission or the Park Superintendent shall be printed or in writing, and shall specify the following: The name, age and gender of the person authorized to make sales; The park and/or swimming pool at which the sales are authorized; The specific goods, wares, merchandise, or other commodities which the permittee is authorized to sel11 That the permit shall not be transferable, and is subject to revo- cation,with or without cause, by the Park Superintendent. SECTION 3. It shall be unlawful for any persQn to offer or exhibit for sale any goods, wares or merchandise, or other commodities, on or at any public park or swimming pool in the City of Lubbock. SECTION 4. It shall be unlawful for any permit holder, as provided for in this ordinance, to exhibit or offer for sale any goods, wares, merchandise, or other commodities, upon any premises constituting a public park or swim- ming pool in the City of Lubbock unless a permit duly issued to him in com- pliance with the provisions of this ordinance has been registered with the Park Manager and/or the Swimming Pool Manager prior to the time any such commodities are offered for sale. I e P. Z SECTION 5. It shall be unlawful for any person exhibiting or having in his possession any goods, wares or merchandise, or other commodities, for sale at any public park or swimming pool in the Ctty of Lubbock, to fail or refuse to exhibit the permit required by this ordinance upon request of any uniformed police officer of the City of Lubbock, or the Pa~k Superintendent, or the Park Manager, or the Swimming Pool Manager of any such park and/or swimming pool where such goods, wares, merchandise, or other commodities, are exhibited, effered for sale, or possessed for the purpose of sale. SECTION 6. It shall be unlawful for any person not having a permit, as provided by this ordinance, to refuse or fail to immediately remove any goods, wares, merchandise or other commodities belonging to him, or in his posses· sion or under his control, fr0m a:ny public ~ark or svHrpming pool premises upon request of the Park Superintendent, a park manager or swimming pool manager, o·r any uniformed police officer of the City of Lubbock. SECTION 7. It shall be unlawful for any person to use any public property including streets or alleyst abutting or adjacent to any public parks or swim- ming pool in .the City af Lubbock for the purpose of exhibiting, selling or offer- ing for sale any goods, wares, merchandise or other commodities to any person I or persons on any premises constituting any public park or ·swimming pool in the City of Lubbock. SECTION 8. Any person who shall violate any provision of this ordinance shall, upon conviction, be fined in any sum not exceeding Two Hundred Dollars ($ZOO). SECTION 9. The provisions of this ordinance shall not apply to any per- son duly ope:cating a concession and his duly authorized employees having a concession cQntract duly entered into between such concessionaire and the City of Lubbock and/or the City of Lubbock Park Commission.
