WHEREAS, Article 1105a, ~vised Civil Statutes of Texas, pt:bvides for the
establis~~t of building lines on ~ part or side of any street in the City of
Lubbock, said City or Lubb9.ck having a population or more than 15,000; and,
YH$REAS, th~ Oity Commission of the City of Lubbock finds that it would
be in the public interest to establish building lines in connectipn with the
widening, opening, straightening and improving of that part of Quirt Avenue
described in the body of this Ordinance; and,
WHEREAS, the widening, straightening and improving of said Quirt A. venue
and the establishment or such building lines are necessary and will ultimately pro"'i~ streets ot desirable and adequate widths which will aid in re.a eving heavy
traffic in conjested areas in accordance with the Cityts comprehensive plan, and
the Oity Planning Commission has recommended such improvements; THEREFORE,
BE IT ORDAINED BY THE CITY C01+1ISSION OF THE CITY OF LUBBOCK:
SECTION 1. That public necessity, convenience and safety in the City or
Lubbock requires the extension, opening, widening, construction and improvement
of that part of the street hereinafter designated within the building lines
established.
SECTION ~. That a building line is hereby established on the East and
West sides of Quirt Avenue lying within the corporate boundaries of the City of
Lubbock, which East a.nd llfest building lines are more particularly described as
follows, to-wit:
EAST SIDE:
BEGINNING at a point which is 320.0 feet North of and 45.0 feet
East of the Southwest Corner of Section Two (2), Block A in Lub-
bock County, Texas, said point being in the North City limit line
of the City of Lubbock, Texas;
THENCE Southerly with a line which is 45.0 feet East or and
parallel to the West boundary line of Section Two (2), Block A
and Sect.ton Four (4), Block 0 in Lubbock O~unty, Texast a
di~tance 6f 2,320.0 feet, more or less, to a point, said point
being in the South right-of-way line of East Tenth Street and in
the North property l-ine of Block One (1) of the Stalnaker Sub-
division of the City of Lubbock, Texas;

parallel to the West boundary line of Section 4, Bl.ock 0 a distaJ}ce
of 640.0 feet, more or less, to a point, said point being 2640.0
feet South of the North line of Seotion 4, Block 0_~ and also being
13.50 feet North ahd 45.0 feet East of the point wnere the center
line of Broadway Street crosses the West boundar,y line of Section 4,

THENCE Southerly with a line which is 45.0 feet East of and parallel
to the West boundary line of Section 4, Block 0 a distance of
756~0 feet, more or less, to a point, said point being in the North
right-of-way line of East 14th Street, and in the South property line ~f Lot Eight (8), Block Two (2) of the Southwest McGaw Additi6n to
the City of Lubbock, Texas;

of 1~84.0 feet, more or less, to a point, said point being 45.0 feet
East of the Southwest Corner of Section 4, Block o, and also being

City of Lubbock, Texas, a distance of 71.82 feet, more or less, to
a point, said point being 60.00 feet East of the West boundary line
of Sect1on Three (3), Block B;

line and 25e0 feet South of the one-half section line of Section Six (6), Block . B in Lubbock County, Texas, said pdint being in the
South right-or-way line of 42nd Street and in the South City limit
line or the City of Lubbock, Texas, and also being in the North
boundary line of Block Twelve of the Nelson•Brown Addition to the
City of Lubbock, Texas;
THENCE .Northerly with a line which is 30.0 feet West of and
parallel to the East boundary line of Section Six (6), Block B a
distance ·of ~665.0 feet, more or less, to a point', said point being

the center line of Broadway Street crosses the East boundary line or Section Three (3), Block 0;
THENCE Northerly with a line which is 45e0 feet West or and
parallel to the East line of Section Three (3) , Block 0 a distance
of 2640.0 feet, more or lese, to a point, said point being 45.0 feet
West of'the Northeast Corner of Section Three (3), Block 0, and
also being in the North City limit line of the City of Lubbock, Texas.

SECTION 3. The term "building linert as used herein shall be construed to
mean "street right-of-way line" and the setback requirements under Zoning Ordinance
No. 661 and amendments thereto shall apply in addition to the right-of-w~ lines
or building lines herein established, it being the intent and purpose of this
Ordinance to preserve all land within the building lines herein established for
ultimate street purposes.
SECTION 4. That no building or other structure shall hereafter be
erected, re-erected or substantially repaired a.nd no new structures or parts thereof
shall be erected or re-erected on that part of the sftreet or land herein designated
within said buildih lines herein established.
SECTION 5. That all structures on or between any building lines establish ~d
by this Ordinance or extending in whole or in part within such building lines are
hereby required to conform to the new building lines established by Section Two (2)
of this Ordinance within five (5) years from the effective date of this Ordinance.
SECTION 6. It shall be unlawful for any person, firm or corporation,
trustee or any authorized agent or representative thereof to erect, reconstruct or
substantially repair any building or other structure or to erect or to re-ereot
any new building or other structure within or between the building lines established
and described ~n Section Two (2) of this Ordinance, and whoever shall v~olate .any
provisions of this Ordinance shall, upon conviction, be fined in any sum not
exceeding $200.00.
SECTION 7. That the provisions of Section Six (6) of this Ordinance shall
not apply to any officer, agent, employee or other person duly authorized by the
State of Texas and/or the City of Lubbock when performing any employment pursuant
to the widening, straightening or extension of the street and/or right of way
contemplated by this Ordinance, or authorized utility extensions.

SECTION 8. If aey section, paragraph, subdivision, clause, phrase or
provision of this Ordinance shall be adjudged invalid or held unconstitutional,
then same shall not affect the validity of this Ordinance as a whole or ~ part
or provision thereof other than the part so decided to be invalid or unconstitutio
SECTION 9. That the City Secretary is hereby" authorized and directed to
cause the publication of the descriptive oaption of this Ordinance, together with
the penalty clause as an alternative method of publication provided by law.
