TRIPP, MAYOR, Presiding; HARRY MORRIS HURLEY CARPENTER l LUCIAN THOMAS COMMISSIONERS, L. E. DAVIS and MRS. LA VENIA LOWE, CITY SECRETARY, also being present; constituting a quorum, at which time the following, among other business, was transacted, to-wit: Commissioner ru~ presented for the consider- ation of the City Commission an ordinance ratifying, confirming and approving an ordinance duly passed and adopted by the City Commission of said City on April 24, 1953, authorizing the issuance of $200,000 "crry OF LUBBOCK, TEXAS, STREET IMPROVEMENT BONDS, SERIES 1953", dated June 1, 1953. The ordinance was read in full by the City Secretary. Thereupon, Commissioner ~~~moved that the rule requiring that no ordinance shall be passed on the day on which it is introduced be suspended, and that in view of the emergency set forth and defined in the preamble to the pro- .. ./ posed ordinance~ that the same be declared an emergency measure. This motion was duly seconded by Commissioner 1\\o ~ The motion carried by the following vote: AYES: Mayor Tripp and Commissioners Carpenter~ Morris, Thomas and Davis. NOES: None. • Thereupon, Commissioner :I""'"'\M...¢.1.< moved that the ordinance as read in full by the City Secretary be finally passed and adopted by the Commission. This motion was seconded by Commissioner b~ v l~ ~ and ~he motion~ carrying with it the final passage and adoption of the ordinance, was unanimously carried by the following vote: AYES: Mayor Tripp and Commissioners Cmpenter, Morris, Thomas and Davis. NOES: None. Thereupon, the Mayor announced that the ordinance had been final.ly passed and adopted by unanimous vote of the Com- mission, in accordance with the requirements of Sections 15, 16 and 17, of Article IX of the Lubbock Charter; and the Mayor thereupon signed and approved the ordinance in the presence of the Commission. The ORDINANCE is as follows: NO. l 't-ot "AN ORDINANCE by the City Commission of the City of Lubbock~ Texas, ratifying, confirming and approving an ordinance duly passed and adopted as an emergency measure by the City Commission of said City on April 24, 1953, authorizing the issuance of $600,000 'CITY OF LUBBOCK~ TEXAS, STREET IMPROVEMENT BONDS, SERIES 1953', dated June 1, 1953; enacting provisiQns incident and relating to the subject and purpose of this ordinance; and declaring an emergency.11 WHEREAS, heretofore, to-wit: on the 24th day of April, 1953, the City Commission of the City of Lubbock, Texas, duly passed and adopted an ordinance as an emergency measure, authorizing the issuance of "CITY OF LUBBOOK, TEXAS, STREET IMPROVEMENT BONDS, SERIES 195311 , dated June 1, 1953, in the principal sum of $200,000, which ordinance is duly recorded in Book 11, page lt9 V et se(b, of the Minutes of said City Commission, said ordinance being NO.. 1381 ,.AN ORDINANCE by the City Commission of the City of Lubbock, Texas, authorizing the issuance of bonds for the principal sum of $200,000, for the purpose of making permanent public improvements, to-wit;-. constructing street improvements in and for said City; prescrib- ing the form of the bonds and the form of interest coupons; levying a continuing direct annual ad valorem tax on all taxable property within the limits of said City to pay the interest on said bonds and to create a sinking fund for the redemption thereof, and providing for the assessment and collection of such taxes; enacting the provisions incident and relating to the purpose and subject of this ordinance; and declaring an emergency." AND WHEREAS, Section 16 of Article IX of the Charter of the City of Lubbock, Texas, provides "No ordinance, unless it shall be declared to be an emergency measure, and passed by a unanimous vote of the Commission, shall be passed on the day on which it shall be introduced."; and WHEREAS, one member of the City Commission being absent on April 24, 1953, this City Commission now deems it necessary and proper to ratify, confirm and approve said ordinance passed on April 24, 1953; and WHEREAS 1 it is FOUND 1 DETERMINED AND ADJUDGED that it is necessary and to the best interest of the City to provide funds for the purpose of constructing street improvements in and for said City at the earliest possible date, for the 1mme- diate preservation of the public peace, property, health and safety of the citizens of the City of Lubbock, Texas, and that by virtue thereof this ordinance should be passed and adopted as an emergency measure; therefore BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1: That the ordinance by the City Commission of the City 'of Lubbock, Texas, authorizing the issuance of $200,000 "CITY OF LUBBOCK, TEXAS, STREET IMPROVEMENT BONDS, SERIES 1953", dated June 1, 1953, be, and the same is hereby RATIFIED, CONFIRMED AND APPROVED. SECTION 2: BE IT FURTHER ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: The public importance of this measure, and thet fact that it is to the best interest of the City to provide funds tor the purpose of cnnstructing street improvements in and for said City, at the earliest possible date, for the immediate preservation of the public peace, property, health and safety of the citizens of the City of Lubbock, constitute and create -an emergency and an urgent public necessity, requiring that this ordinance be passed and take effect as an emergency measure, and that this ordinance is accordingly passed as an emergency measure and shall take effect and be in force imme- diately after and from its passgge. 1953.· PASSED AND APPROVED, this the 1&~ day of 'M~ar , ATTEST: of Lubbock, (City seal) CERTIFICATE OF CITY SECRETARY THE STATE OF TEXAS I CITY OF LUBBOCK COUNTY OF LUBBOOK I, the undersigned, City Sedretary of the City of Lubbock, Lubbock County, Texas!
