TRIPP, MAYOR, Presiding; HURLEY CARPENTER l HARRY MORRIS LUC~N THOMAS COMMISSIONERS, L. E. DAVIS and MRS. LA VENIA LOWE, CITY SECRETARY, also being present; constituting a quorum, at which time the following, among other business, was )l,1n~ansacted, to-wit: C ommis s ione r Thomas presented tor ',the consider- ation of the City Commission an ordinance ratifying, confirming and approving an ordinance duly passed and adopted by the City Commission of said City on April 24, 1953, authorizing the issuance of fC!jOO ,000 11 CITY OF LUBBOCK, TEXAS, ELECTRIC LIGHT SYST~ BONDS, SERIES 195311 , dated JWle 1, 1953. The ordinance was read in full by the City Secretary. Thereupon, Commissioner Carpenter moved that the rule requiring that no ordinance shall be passed on the day on which it is introduced be suspended, and that in view of the ·. emergency set forth and defined in the preamble to the pro- posed ordinance, that the same be declared an emergency measure. This motion was duly seconded by Commissioner ___ M_o_rr_i_s _____ • The motion carried by the following vote: AYES: Mayor Tripp and Commissioners Carpenter, Morris, Thomas and Davis. NOES: None. Thereupon, Commissioner Thomas moved that the ordinance as read in full by the City Secretary be finally passed and adopted by the Commission. This motion was seconded by Commissioner C~~ter ~ and the motion, carry- ing with it ~he final passage and adoption of the ordinance, was unanimously carried by the following vote: AYES: Mayor Tripp and Commissioners Carpenter, Morris~ Thomas and Davis. NOES: None. Thereupon, the Mayor announced that the ordinance had been finally passed and adopted by unanimous vote of the Com- mission, in accordance with the requirements of Sections 15, 16 and 17, of Article IX of the Lubbock Charter; and the Mayor thereupon signed and approved the ordinance in the presenee of the Commission. The ORDINANCE is as follows: NO. 14QQ 11AN ORDINANCE by the City Commission of the City of Lubbock, Texas, ratifying, confirming and approving an ordinance duly passed and adopted as an emergency measure by the City Commission of said City on April 24, 1953, authorizing the issuance of $600,000 'CITY OF LUBBOCK, TEXAS, ELECTRIC LIGHT SYSTEM BONDS, SERIES 1953 t J dated June 1, 1953; enacting provisions inci- dent m:i relating to the subject and purp<S e of this ordinance; and declaring an emergency." WHEREAS, heret~fore, to-wit: on the 24th day of - April, 1953, the City Commission of the City of Lubbock, Texas, duly passed and adopted an ordinance as an emergency measure, authorizing the issuance of "CITY OF LUBBCCK, TEXAS, ELECTRIC LIGHT SYSTEM BONDS, SERIES 1953", dated June 1, 1953, in the principal sum of $600,000, which ordinance is duly recorded in Book 11, page 491 et seq., of the Minutes of said City Commission, said ordinance being NO. l36Q 11AN ORDINANCE by the City Commission of the City of Lubbock, Texas, authorizing the issuance of bonds for the principal sum of $600,000, for the purpose of making permanent public improvements, to-wit: constructing improve- ments and extensions to the City's Electric' Light System; prescribing the ,form of the · bonds and the form of interest coupons; levying a continuing direct annual ad valorem tax on all taxable property within the limits of said City to pay the interest on said bonds and to create a sinking fund for the redemp- tion ~Hereof, and providing for the assessment and collection of such taxes; enacting the provisions incident and relating to the pur- pose and subject of this ordinance; and declaring an emergency." AND WHEREAS, Section 16 of Article IX of the Charter of the City of Lubbock, Texas, provides "No ordinance, unless it shall be declared to be an emergency measure, and passed by a unanimous vote of the Commission, shall be passed on the day .on which it shall be introduced."; and WHEREAS, one member of the City Commission being absent on April 24, 1953, this City Commission now deems it necessary and proper to ratify, confirm and approve said ordinance passed on April 24, 1953; and WHEREAS, it is FOUND., DETERMINED AND ADJUDGED that it is necessary and to the best interest of the City to provide funds for the purpose of constructing improvements and exten- sions to the 'Cityts Electric Light System at the earliest possible date, for the immediate preservation of the public peace, property, health and safety of the citizens of the City of Lubbock, Texas, and that by virtue thereof this ordinance should be passed and adopted as an emergency measure; therefore BE IT ORDAINED BY THE CITY CCMMISSION OF THE CITY OF LUBBOCK: SECTION 1: That the ordinance by the City Commission of the City of Lubbock, Texas, authorizing the issuance of $600,000 "CITY OF LUBBOCK, TEXAS, ELECTRIC LIGHT SYSTEM BONDS, SERIES 1953", dated June 1, 1953, be, and the same is hereby RATIFIED, CONFmMED AND APPROVED. SECTION 2 : BE IT FURTHER ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: The public importance of this measure, and the fact that it is to the best interest of the City to provide funds for the purpose of constructing improvements and extensions to the City•s electric light system at the earliest possible date, for the immediate preservation of the public peace, property, health and safety of the citizens of the City of Lubbock, con- stitute and create an emergency and an urgent public necessity requiring that this ordinance be passed and take effect as an emergency measure, and that this ordinance is accordingly passed as an emergency measure and shall take effect and be in force immediately after and from its passage. 1953. of Lubbock, (City-seal) CERTIFICATE OF CITY SECRETARY THE STATE OF TEXAS I CITY OF LUBBOCK COUNTY OF LUBBOCK I, the undersigned, City Secretary of the City of Lubbock,.
