AN ORDINANCE RATIFYING, CONFIRMING AND APPROVING
AN ORDINANCE AUTHORIZING ISSUANCE OF $113,000
"CITY OF LUBBOCK, TEXAS, STREET LIGHTING
BDNDS .. SERIES 1953 II .. DATED JUNE 1, 1953

ON THIS, the 26th day of -=Maz;;a.__, 1953, the City
Commission of the City of Lubbock, Texas, convened in special
session, at the regular meeting place thereof in the City Hall,
with all members thereof present, to-wit:

HURLEY CAR FENTER l HARRY MORRIS
LUCIAN THOMAS COMMISSIONERS,
L .. E. DAVIS and
MRS • LA VENIA LOWE, CITY SECRETARY,
also being present; constituting a quorum, at which time the
following, among other business, was transacted, to-wit:
Commissioner _____ Th_o_ma __ s ___ presented for the consider&-
tion of the City Commission an ordinance ratifying, confirming
and approving an ordinance duly passed and adopted by the City
Commission of said City on April 24, 1953, authorizing the
issuance of $113,000 "CITY OF LUBBOCK, TEXAS, STREET LIGHTING
BONDS, SERIES 1953", dated June 1, 1953 (being the second and
final .parcel or installment of a total voted authorization of
$188,000 bonds).
The ordinance was read in full by the City Secretary.
Thereupon, Commissioner Carpenter moved that the
rule requiring that no ordinance shall be passed on the day on
which it is introduced be suspended, and that in view of the

emergency set forth and defined in the preamble to the proposed
ordinance, that the same be declared an emergency measure. This
motion was duly seconded by Commissioner __ ~_fu_r_ri_s __ _ The mo-
tion carried by the following vote:
AYES: Mayor Tripp and Commissioners Carpenter,
Morris, Thomas and Davis. I
NOES: None.
Thereupon, Co~issioner Thomas moved that the
ordinance as read in full by the City Secretary be finally
passed and adopted b~ the Commission. This motion was seconded
by Commissioner ___ D~a~V1~·~s ___ , and the motion, carrying with it
the final passage and adoption of the ordinance, was unanimously
carried by the following vote:
AYES: Mayor Tripp and Commissioners Carpenter, ·
Morris, Thomas and Davis.
NOES: None.
Thereupon, the Mayor announced that the ordinance had
been finally passed and adopted by unanimous vote of the Commi&-
sion, in accordance with the requirements of Sections 15, 16
and 17, of Article IX of t~e ~rLqhbock Charter; and the Mayor
thereupon signed and approved the ordinance in the presence of
the Conunission.

11AN ORDINANCE by the City Commission of the City
of Lubbock, Texas, ratifying, confirming and
approving an ordinance duly passed and adopted
as an emergency measure by the City Commission
of said City on April 2'4, 1953, authorizing the
issuance of $113,000 iCITY OF LUBBOCK, TEXAS,
STREET LIGHTING BONDS; SERIES 1953r , dated
June 1, 1953 (being the second and final parcel
or installment of a total VQted authorization
of $188,000 bonds); enacting provisions inci-
dent and relating to Jthe-.1 subtlect and purpose of
this ordinance; and 'declaring an emergency.11
WHEREAS, heretofore, to-wit: on the 24th day of April,
1953, the City Commission of the City of Lubbock, Texas, duly
passed and adopted an ordinance as an emergency measure, author-
izing the issuance of "CITY OF LUBBOOK, TEXAS, STREET LIGHTING
BONDS, SERIJS 195311 , dated June 1, 1953, in the principal sum
of $113,000 (being the second and final parcel or installment
of a total voted authorization of $188,000 bonds), which ordi-·
nance is duly recorded in Book 11, page 490 et seq., .or the
Minutes of said City Commission, said ordinance being

"AN ORDINANCE by the City Commission of the City
of Lubbock, Texas, authorizing the issuance
of bonds in •the principal sum of $113,000
(being the second and final parcel or in-
stallment of a total voted authorization of
$188,000), tor the purpose of making perma-
nent public improvements, to-wit: construct-
ing, installing, extending and improving the
City's Street Lighting System; prescribing the
form of the bonds and the form of interest
coupons; levying a continuing direct annual ad
valorem tax on all taxable property within the
limits of said City to pay the interest on
said bonds and to create a sinking fund for
the redemption thereof; and providing for the
assessment and collection of such taxes; en-
acting the provisions incident and relating
to the purpose and subject of this ordinance;
and declaring an emergency. 11
AND WHEREAS, Section 16 of Article IX of the Charter
of the City of Lubbock, Texas, provides "No ordinance, unless
it shall be declared to be an emergency measure, and passed by
a unanimous vote of the Commission, shall be passed on the day
on which it shall be 1ntroduced.11 i and
WHEREAS, one member of the City Commission being
absent on April 24, 1953, this City Commission now deems it
necessary and proper to ratify, confirm and approve said
ordinance passed on April 24, 1953; and
WHEREAS, IT IS FOUND, DETERMINED AND ADJUDGED that
it is necessary and to the best interest of the City to con-
struct, install,eKtiend and improve the City's Street Lighting
System at the earliest possible date, for the immediate pre-
servation of the public peace, property, health and safety of
the citizens of the City of Lubbock, Texas, and that by virtue
thereof this ordinance should be passed and adopted as an
emergency measure; therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
LUBBOCK:
SECTION 1: That the ordinance by the City Commission
of the Ctty or ~ubbock, Texas, authorizing the issuance of
$113,000 "CITY OF LUBBOCK, TEXAS, STREET LIGHTING BONDS, SERIES
1953", dated June 1, 1953 (being the second and final parcel or
installment of a total voted authorization of $188,000 bonds),
be, and the same is hereby RATIFIED, CONFIRMED AND APPROVED.
SECTION 2: BE IT FURTHER ORDAINED BY THE CITY
COMMISSION OF THE CITY OF LUBBOCK:
The public importance of this measure, and the fact
that it is to the best interest of the City to provide funds
for the purpose of construc~ing, installing, extending and
improving the City1s Street Lighting System at the earliest
possible date, for the immediate preservation of the public
peace, property, health and safety of the citizens of the City
of Lubbock, constitute and create an emergency and an urgent
publiQ necessity requiring that this ordinance be passed and
take effect as an emergency measure, and that this ordinance is
accordingly passed as an emergency measure and shall take
effect and be in force immediately after and from ita passage.
