Commission of the City of Lubbock, Texas, convened in ~~~~~
session, at the regular meeting place thereof in the City Hall,
there being present and in attendance the following members,
to-wit:

the following, among other business, was transacted, to-wit:
Commissioner t\\oB,\3\ <, presented for the consider
ation of the City Commission an ordinance authorizing the
issuance of "CITY OF LUBBOC~, TEXAS, STORM SEWER BONDS, SERIES
1953", dated June 1, 1953, in the principal sum of $50,000.
The ordinance was read in full by the City Secretary.
Thereupon, Commissioner ~ A\) .L.S moved that
the rule requiring that no ordinance shall be passed on the
day on which it is introduced be suspended, and that in view
of the emergency set forth and defined in the preamble to the
proposed ordinance, that the same be declared an emergency
measure. This motion was duly seconded by Commissioner -------
• The motion carried by the following vote:
AYES: Mayor Tripp and Commissioners Carpenter,
Morris, 'f, L&s and Davis.
NOES: None.
Thereupon, Commissioner M ~ '-~~ moved that the
ordinance as read in full by the City Secretary be finally
passed and adopted by the Commission. This motion was seconded
by Commissioner bo.-\tt ? , and the motion, carrying
with it the final passage and adoption of the ordinance, was
unanimously carried by the following vote:
AYES: Mayor Tripp and Commissioners Carpenter,
Morris, ~~&-and Davis.
NOES: None.
Thereupon, the Mayor announced that the oDginance had
been finally passed and adopted by unanimous vote of the
Commission, in accordance with the requirements of Sections
15, 16 and 17, or Article IX of the Lubbock Charter; and the
Mayor thereupon signed and approved the ordinance in the
presence of the Commission.
THE ORDINANCE is as follows:
NO. 1383
"AN ORDINANCE by the City Commission of the City
of Lubbock, Texas, authorizing the issuance
or bonds for the principal sum of $50,000,
for the purpose of making permanent public
improvements, to-wit: constructing, enlarging,
extending and installing storm sewers, drains,

curbs and gutters and other improvements
incidental thereto in and for said City;
prescribing the form of the bonds and the
form of interest coupons; levying a con-
tinuing direct annual ad valorem tax on
all taxable property within the limits of
said City to pay the interest on said bonds
and to create a sinking fund for the redemp-
tion thereof, and providing for the assess-
ment and collection of such taxes; enacting
the provisions incident and relating to the
purpose and subject of this ordinance; and
declaring an emergency.n
WHEREAS, the City Commission of the City of Lubbock,
Texas, on the 21st day of November, 1952, adopted a resolution
and order calling an election on the question of the issuance
of $50,000 general obligation tax bonds tmmature serially over
a period of years not to exceed Thirty (30) years from their
date, and bearing interest at a rate or not exceeding 3-3/4%
per annum, payable annually or semi-annually, for the purpose
or making permanent public improvements, to-wit: constructing,
enlarging, extending and installing storm sewers, drains, curbs
and gutters and other improvements incidental thereto in and
for said City; and,
WHEREAS, the said election was held pursuant to said
resolution and order on the 9th day of December, 1952; and,
WHEREAS, the Commission has heretofore examined into
and investigated the regularity of the proceedings for said
election and found that the aame was duly and legally held;
that the notice required by law to be given had been duly and
legally given; and that said election was conducted in strict
conformity with the law; and that due returns of said election
had been made by the proper officers; and,
WHEREAS~ at said election~ the qualified voters who
are property taxpayers of the City of Lubbock~ voting at said
election~ sustained by a majority vote~ the proposition to
issue bonds for the purpose of making permanent public improve-
ments, to-wit: constructing, enlarging, extending and install-
ing storm sewers, drains, curbs and gutters and other improve-
ments incidental thereto in and for said City; and
WHEREAS, the City Commission has heretofore adopted a
resolution declaring the results of said election and determin-
ing the specific authority of the City to issue said general
obligation tax bonds; and
WHEREAS, it is now necessary and proper that the City
Commission of the City of Lubbock, Texas, proceed with the
issuance of such general obligation tax bonds; and
WHERBAS, it is FOUND, DETERMINED AND ADJUDGED that it
is necessary and to the best interest of the City to provide
funds for the purpose of constructing, enlarging, extending and
installing storm sewers, drains, curbs and gutters and other
improvements incidental thereto in and for said City at the
earli est possible date, for the immediate preservation of the
public peace, property, health and safety of the citizens of
the City of Lubbock, Texas, and that by virtue thereof this
ordinance should be passed and adopted as an emergency measure;
therefore
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
LUBBOCIC:
SECTION 1: That the bonds of the City of Lubbock,Texas
to be ~alled "CITY OF LUBBOCK, TEXAS, STORM SEWER BONDS, SERIES
1953", be issued under and by virtue of the Constitution and

laws of the State of Texas, and in the principal sum of FIFTY
THOUSAND DOLLARS ($50,000), for the purpose of making per-
manent public improvements, to-wit: constructing, enlarging,
extending and installing storm sewers, drains, curbs and
gutters and other improvements incidental thereto in and for
said City.
SECTION 2: That said bonds shall be numbered con-
secutively from One (1) to Fifty (50), both inclusive; shall
be of .the denomination or One Thousand Dollars {$1,000) each,
aggregating the sum or FIFTY THOUSAND DOLLARS ($50,000).
SECTION 3: That said bonds shall be dated June 1,
1953, and shall become due and payable serially according to
the following schedule:

SECTION 4: That the said bonds shall bear interest
from date until paid at the following rates per annum, that is
to say
(a) Bonds Numbered 1 to ~Q , both inclusive,
maturing on June 1st in each of the years 1975 and l3li!

such interest to be evidenced by proper coupons attaahed to
each of said bonds, and said interest shall be payable on June
1st, 1954, and semi-annually thereafter on December 1st and

SECTION 5: That both principal of and interest on
said bonds shall be payable in lawful money of the United
States of America without exchange or collection charges to

holder at the CITIZENS NATIONAL BANK1 LUBBOCK, TEXAS, upon
presentation and surrender of bonds or proper coupons.
SECTION 6: That each of said bonds shall be signed by
the Mayor and countersigned by the City Secretary, and the
corporate seal of the "CITY OF LUBBOCK, TEXAS" shall be im-
pressed upon each of them.
SECTION 7: That the facsimile signature of the Mayor
and City Secretary may be lithographed or printed on the
interest coupons attached to said bonds, -and shall have the
same effect as if they had been signed by them.
SECTION 8: That the form of said bonds shall be sub-
stantially as follows:

The CITY OF LUBBOCK, a municipal corporation of the
State of Texas, acknowledges itself indebted to and for value
received, hereby promises to pay to bearer, the sum of
ONE THOUSAND DOLLARS
($1,000) in lawful money of the United states of America with-
out exchange or collection charges to the owner or holder, on
the FIRST DAY OF JUNE, 19 ___ , with interest thereon from
the date hereof until paid at the rate of THREE ---===~-----------
PER CENTUM ( 3 %) per annum, payable semi-annually on December
1st and June 1st in each year, the first interest payment date
being June 1, 1954, and interest falling due on or prior to
maturity hereof is payable only upon presentation and surrender
of the interest coupons hereto attached as they severally be-

BOTH PRINCIPAL and interest of this bond are hereby

the CITIZENS NATIONAL BANK, LUBBOCK, TEXAS, and for the prompt
payment of this bond and the interest thereon at maturity, the
full faith, credit and resources of the City of Lubbock, Texas,
are hereby irrevocably pledged.
THIS BOND is one of a series of like tenor and effect
except as to number and maturity, numbered consecutively from
one (1) to Fifty (50), both inclusive, in denomination of
One Thousand Dollars ($1,000) each, aggregating in amount .
FIFTY THOUSAND DOLLARS ($50,000), and issued for the purpose
of making permanent public improvements, to-wit: con-
structing, enlarging, extending and installing storm sewers,
drains, curbs and gutters and other improvements indidental
thereto in and for said City, under authority of the
Constitution and laws of the State of Texas6 and pursuant to
an ordinance duly adopted by the City Commission of the City
of Lubbock, Texas, and recorded in the Minutes of said City
Commission.
IT IS HEREBY CERTIFIED, RECITED AND REPRESENTED that
the issuance of this bond and the series of which it is a part,
is duly authorized by law and by a vote of the qualified pro-
perty taxpaying voters of the City of Lubbock, Texas, voting
at an election held for that purpose within said City on the
9th day of December, 1952; that all acts, conditions and things
required to be done precedent to and in the issuance of this
series of bonds and or this bond, have been properly done and
performed and have happened in regular and due time, form and
manner as required by law; that sufficient and proper provis-
ions for the levy and collection or taxes nas been made which,
when collected, shall be appropriated exclusively to the pay-
ment of this bond and the series of which it is a part, and
to the payment or the interest coupons thereto annexed as the
same shall become due; and that the total indebtedness of the
City of Lubbock, Texas, including the entire series of bonds
of which this is one, does not exceed any constitutional or
statutory limitation.
IN WITNESS WHEREOF, the City of Lubbock, Texas, by its
City .commission, has caused its corporate seal to be affixed
hereto, and this bond to be signed by its Mayor and counter-
signed by its City Secretary, and the interest coupons hereto
attached to be executed by the lithographed or printed facsimile
signatures of the Mayor and City Secretary; the date of this
bond, in conformity w1tb the ordinance above referred to,
being the lst day of June, 1953.

State of Texas, to the effect that this bond has been examined
by him as required by law, and that he finds that it has been
issued in conformity with the Constitution and laws of the
State of Texas, and that it is a valid and binding obligation
upon said City of Lubbock, Texas, and said bond has this day
been registered by me.

SECTION 11: BE IT FURTHER ORDAINED BY THE CITY
COMMISSION OF THE CITY OF LUBBOCK:
That a special fund to be designated "CITY OF LUBBOC~J
TEXAS, STORM SEWER BOND, SERIES 1953~ FUND", is hereby created,
and the proceeds of all taxes collected for or on account of
this series of bonds shall be credited to said fund for the
purpose of paying the interest on and to provide a sinking fund
for the redemption of said bonds at maturity; and said fund
shall be used for no other purpose; that, to create said fund
and to pay the interest on said bonds and to provide a sinking
fund sufficient to redeem them at maturity, a tax of Q ~)C:

ion of all taxable property in the City of Lubbock, Texas, or
such amount as may at all times be legally necessary, shall
be annually levied on said property and annually assessed and
collected until said bonE with interest thereon have been fully

or so much thereof as shall be necessary, or in addition theret
as may be required, is hereby levied for the current year and
each succeeding year while said bonds, or any of them, are out-
standing, and the same shall be annually assessed and collect-
ed and applied exclusively to the purpose named. No mistake
in the computation or insertion of the aforesaid specific rate
of tax shall be construed or considered as the levy of an in-
sufficient rate for the bonds herein authorized and the City
Commission hereby declares its purpose and intent to provide
and levy a tax fully and iegally . .aufficient for such bonds,
it having been determined that the existing and available tax-
ing authority of the City for such purpose is adequate to per-
mit a legally sufficient tax in consideration of all other out-
standing obligations.
SECTION 12: BE rr FURTHER ORDAINED BY THE CITY COM-
MISSION OF THE CITY OF LUBBOC~:
That the M~or of said City shall be and he is hereby
authorized to take andtave charge of all necessary orders and
records pending investigation by the Attorney General of the
State of Texas, and shall take and have charge and control of
the bonds herein authorized pending their approval by the
Attorney General and their registration by the Comptroller of
Public Accounts.
SECTION 13: AND BE IT FURTHER ORDAINED BY THE CITY
COMMISSION OF THE CITY OF LUBBOC~:
The public importance of this measure, and the fact
that it is to the best interest of the City to provide funds
for the purpose of constructing, enlarging, extending and in-
stalling storm sewers, drains, curbs and gutters and other
improvements incidental thereto in and for said City at the
earliest possible date, for the immediate preservation of the
public peace, property, health and safety of the citizens of
the City of Lubbock, constitute and create an emergency and an
. urgent public necessity requiring that this ordinance be passed
and take effect as an emergency measure, and that this ordinance
is accordingly passed as an emergency measure and shall take
effect and be in force immediately after and from its passage.
