MUNICIPAL ORDINANCE NO. 1346
{Construction and Maintenance)
AN ORDINANCE PROVIDING FOR THE OONSTRUCTlOO AND JfLAINTENANCE OF THE PORTIOO OF
HIGHWAY NO. U.S. 84 (34TH STREET) IN THE CITY OF LUBBOCK, BETWEili THE FOLLOWING
LIMn'S, TO-WIT: AVlNUE Q AND 850 FEET EAST OF AVENUE H., HEREINAFTER REFERRED TO AS
"THE PROJECT'* AND AUTHORIZING THE MAYeR OF THE CITY TO EXECUTE AND THE ClTY SECRETARY
TO AFFIX THE C<EPORATE SEAL AND ATTEST THE SAME, A CERTAIN COORACT BETWEEN THE CITY
AND THE STATE OF TEXAS PROVIDING FCR THE CONSTRUCTION, MAINTENANCE, EXISTENCE AND UBE
OF SUD PROJECT AND DETEBMINING 'l'HE LIABILITIES AND RESPONSIBILITI~ OF THE CITY AND
THE STATE \6 TEXAS WITH REFERENCE THERETO; AND DECLARING AN FMEEGENCY AND PROVIDING
THAT THE ORDINANCE SHALL BE EFFECTIVE P'ROM AND AFTER ITS PASSAGE.
WHEREAS, the public cgnvenience, safety and necessity at the City, and the peopla
of the Cit7 require that the portion of Highway No. U.S. 84 from Av«tue Q to 850 feet.
East of Avenue H be constructed, since the existing condition constitutes a serious
inconvenience to the public, which it is urgently required to be remedied; and,
WHEREAS, the Cit7 has requested tha State of' Texas to cort. ribute tinanoiall.7 in
the project; and,

assist the City in the improvement and maintenance of said project prorlding the Cit7
approves the plana for said project.
N{)l, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL~
SECTION 1. That since the public convenience, saf'et7 and necessity of the Cit7
and the people ot the City require it, said project shall be constructed.
SECTI<Ji 2. That the State of Texas be atd is hereby authorized to enter upon.,
construct and maintain the project at the location and in the aanner shown on the plan
attached hereto, marked "Exhibit A", and made a part hereof in all respects.
SECTION 3. The Mayor of the City be and is hereby authorized to execute for and
on behalf of the City an agreement. and contract with th! St.ate of' Texas in accordance
