ORDINANCE NO. 1341 .;;;;;..;,...;;;.;;;;.._ __ _
AN ORDINANCE AUTHORIZING THE TAX COLLECTOR AND ASSESSOR
OF THE CITY OF LUBBOCK TO CANCEL ASSESSMENTS MADE AGAINST
CITY -OWNED PROPERTY! AND DECLARING AN EMERGENCY.
WHEREAS, the City of Lubbock has from time to time purchased sundry
tracts of land for right-of-way purposes and in some instances has parts of
lots or tracts of land remaining after the establishment of a right-of-way for
street and highway purposes. which tracts are being sold by the City from
time to time; and.
WHEREAS, it has been found that delays have been occasioned in con-
nection with such sales due to the factthat assessments against exempt City-
owned property have beenmade; THEREFORE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. That when the Tax Collector and Assessor of the City of
Lubbock hasreceive d proof and finds that tax assessments have been errone-
ously made against exempt tracts of land owned by the City of Lubbock, the
Tax Collector and Assessor is hereby authorized to cancel on his rolls all
such City taxes assessed against said property during the time said land was
owned or otherwise in lawful possession of the City of Lubbock as provided
by law, includingArticle 7151, Revised Civil Statutes of Texas.
SECTION 2. The fact that in the daily operation of the City's business,
and especially in the Tax Collector and Assessor's Department, business trans-
actions are being avoidably delayed since the Tax Collector bas not been
previously given authorityto cancel erroneous tax assessments made against
tracts of land belonging to the City of Lubbock, creates an emergency requir-
ing that all rules requiring two {2) readings in connection with the passage of
an ordinance be suspended~ and the same are hereby suspended, and this
ordinanceshall become effective on the date of its passage.
AND IT IS SO ORDERED.
