AN ORDINANCE ESTABLISHING A PROCEDURE TO BE FOI.LOWED IN ENFORCING THE
PROVISIONS OF SECTION XVIII, ZONING ORDINANCE NO. 661 PROHIBITING OBSTRUCTIONS
OF VIEW ON LOT BOUNDARIES; AND DECLARING AN EMERGENCY.
~S, Section XVIII of Zoning Ordinance No. 661 prohibits obstruc-
tions of view on lot boundaries, and the City Commission finds that in order to
facilitate the enforcement thereof provision should be made for written notice
issuing to persons responsible for such obstructions requiring their abatement
with~n a reasonable time; and
WHEREAS, such procedure is necessary to facilitate the usual daily
operation of the Building Inspection Department and is an emergenc,r measure
creating a public necessity that the rule requiring proposed Ordinances to be
presented at two (2) separate meetings be dispensed with; THEREFORE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCKa
SECTION 1. Whenever the Building Inspector receives information and
proof of the existence of any obstruction existing in violation of the provisions
of Section XVIII of Zoning Ordinance No. 661, he shall issue a written notice to
the owner and person in possession of the premises on which such obstruction is
situated ordering the abatement of aame.t He shall at the same time send a copy
of the said notice to the Assistant City Attorney in charge of prosecutions in
the Corporation Court. Such notice shall specify the nature of the violation
and Shall designate a reasonable time within which such abatement shall be
accomplished. In the event such notice is not complied with within the specified
time, said prosecuting attorney who received the copy of the original notice shall
be so advised by the Building Inspector, and he shall immediately institute pro-
ceedings for the abatement thereof.
SECTION 2. The enactment of this Ordinance being n~c,ssary to facilita
the usual operation of the Building Inspection Department, it is declared to be
an emergen~ measure, thereby creating a public necessity that the rule requiring
proposed O~inances to be presented at two separate meetings be dispensed with,
and this Ordinance is passed b.Y unanimous vote at the meeting of its introduction.
This Ordinance shall become effective from and after its present read-
ing and adoption.
AND IT IS SO ORDERED.
On motion of Commissioner Carpenter , seconded by Commis-
sioner Thomas , this Ordinance was passed this Bth '· day of
January , 1953, by the following vote:
