AN ORDINANCE ESTABLISHING BUILDING AND RIGHT-OF-WAY LINES ON THE NORTH-
WEST AND SOUTHEAST SIDES OF PROPOSED AVENUE "Q" NORl'HEAST BETWEEN A POINT
APPROXIMATELY 300 FEEl' SOUTH OF ERSKINE STREET TO SOUTH SIDE OF KEMPER STREEI'
ON THE NOR'I'HWEST LINE AND TO THE SOUTH SIDE OF JARVIS STREF:l' ON THE SOUTHEAST LINE;
IN ACCORDANCE WITH A COMPREHENS lVE STREET IMPROVEMENT PROGRAM, El'C. , SO AS TO
CONF0~1 SAID BUILDING LINES TO REQUIREMENTS OF THE TEXAS STATE HIGHWAY COMM[SSION;
ECLARlNG THAT PUBLIC CONVENIENCE, NECESSITY AND SAFETY REQUIRE THE EXTENSION,
CONSTRUCTION AND IMPROVEMENT AND SECURING OF THE RIGHT OF WAY BETWEEN SAID BUILDING
LINES HEREJN ESTABLISHED; PROHIBITING PLACING OF BUILD:UmS AND STRUCTURES OR
REPAIRS OR RECONSTRUCTION BE'NEEN SAID LINES ESTABLISHED BY THIS ORDlNANCE;
EXCEP!'ING l'UBLIC UTILITIES ON THE PUBLIC 'PROPERTY BEI'WEEN BUILDING LINES; REQUmiNG
THAT STRUCTURES CONFORM TO SUCH BUILDING LINES AND SETBACK PROVISIONS OF ORDINANCE
NO. 661, AS AMENDED, WITHIN TWO (2) YEARS; DEFINING "BUILDING LINE 11; AND AUTHORIZ-
ING PUBLICATION OF THE CAPTION OF THIS ORDINANCE.
WHEREAS, the City Commission of the City of Lubbock in the public inter-
est has entered upon a comprehensive plan with the State of Texas State Highway Corronis~ion to extend, open, wid~n, straighten and improve certain streets and
highways within the City of Lubbock; and,
WHEREAS, the City Commission finds that public convenience, safety and
necessity in the City of Lubbock require that Avenue 11Q11 Northeast be opened,
widened, constructed, improved, and the right of way se6Ured in accordance with
this Ordinance, and that the designation ~f building lines i~ required in the
interest and preservation of pUblic safety and to prevent structures from being
placed within the area between said building lines for said ~ight of way; THEREFORE
BE IT ORDA:rnED BY THE CITY COMMISSION OF THE CITY OF LUBBOCKJ
SECTION 1. That public necessity, convenience and safety in the City
of Lubbock rGquire the extension, opening, widening, constructi on and improvement
of that part of the street hereinafter designated within the building lines
established.
SECTION 2. A building or right-of-way line is hereby established on
that part of the street or land on the northwest and southeast sides of the
proposed Avenue 1~11 Northeast between approximately three hundred (300) feet south
of Erskine Street and the south side of Kemper Street on the northwest side anc
the south side of Jarvis on the southeast side as foll~rs:
NORTHWEST LINE: B.OOINNlNG at a point 520.6 feet East and 211.9
feet South of the Nor~west Corner of Survey Eighty (80), Bloc~
"An, 'Lubbock County, Texas, said point being on the line where
the'right of way of Av~nue "Qil Northeast in the City of Lubbock,
Lubbock County , Texaa, widens abruptly;
THENCE North 300 21 t East along a line parallel to, and
One hundred (100) feet Northwesterly from measured perpendicular
to the centerline of said Avenue ttQtl Northeast, at 245.6 feet
~r.oss the North line of said Survey Eighty {80), in all 2423.8 feet to the North line of the Countr,y Club Addition to said City of Lub-
bock and the city limits line of said City of Lubbock.
SOUTHEAST LINE: BEGINNING at a point 735.1 feet East and 313.0 feet

Lubbock County, Texas, said point being on the line where the right

of way of Avenue ttQu Northeast in the City of Lubbock, Lub-
bock County, Texas, widens abruptly;
THENCE North ,30° 21 ' East along a line parallel to and
IDne hundred (100) feet Southeasterly from measured perpendicular
to the centerline of said Avenue "Q" Northeast( ~t .362.8 feet
cross the North line of said Survey Ei~hty (SO], in all 215.3.6
feet to the North line ot Block Six (6}, Oountr,y Olub Addition
to said City of Lubbock.
SECTION .3. The term 11building linen as used herein· shall be construed
to mean "street right-of-way line, u and the setback requirements under Zoning
Ordinance No. 661 shall apply in addition to the right-of-way lines or building
lines herein established, it being the intent and purpose of this Ordinance to
preserve all land within the building lines herein established for ultimate street
purposes.
SECTION 4. That no building or other structure shall be erected,
re-erected o~ substantially repaired and no new structures or parts thereof shall
be erected or re-erected on that part of the street or land herein designated
within said lines herein established.
SECTION;. That all·struatures now extending or being located within
or between said building lines herein established are hereby required to conform
to the building lines herein established within two (2) years from the effective
date of this Ordinance.
SECTION 6. That the provisions of this Ordinance ~~the placing
of structures between building linea herei~ established shal~ not apply to any
officer, agent, employee or other person duly authorized by the City of Lubbock
when such work relat es to utility extensions or street improvements, PROVIDED
this provision shall not be Qonstrued as authorizing any such persons to enter
upon private property lying batto~een au¢h linea until the same has been dedioated
to public use or otherwise acquife~ to~_SU9h purpose.
SECTION 7. ~he City Secret~ry is hereby directed to cause publication
of the descriptive caption of this Ordinance.
AND IT IS SO ORDERED.
