HomeMy WebLinkAboutOrdinance - 1241-1952 - Fixing Water Rates Making Bills Payable Within 10 Days From Date Rendered - 06/26/1952/it ;D~ UJQ~J-A;~ ORDINANCE NO. _.;;.12.;;..;4;.;.1_ AN ORDINANCE ESTABLISHING AND FIXING WATER RATES IN THE CITY OF LUBBOCK; MAKING: BILLS PAYABLE WITHIN TEN (10) DAYS FROM THE DATE RENDERED~ PRESCRIBING MINIMUM RATE OF ONE DOLLAR AND 80/100 ($1. 80) FOR EACH CONSUMER' REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; ESTABLISHING EFFECTIVE DATE; AND DECLARING AN EMERGENCY. WHEREAS, reeent study and investigation of the cost of maintaining and expanding the water system and related facilities establishes that water is being sold in many classifications at less than cost, and the City Commission finds that an immediate increase in rates is imperative to avoid any additional deficits and to approach placing the water and related systems on a self- sustaining basis, with due consideration given to both large and small consum- ers; and, .. WHEREAS, the Commission finds that such increases are required to be put into effect at the earliest possible time for the immediate preservation of public health and property and to further make provision for the daily operation of the Water Department1 as it affects all consum.ers of water, creates an emergency requiring the suspension of rules; and, WHEREAS, the City Commission finds that the rates here established are equitable and should be promulgated in the public interest: THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. That from and after the passage o.f this ordinance and as hereinafter provided for, the City of Lubbock through\ its Water Department shall charge and collect and every consumer of water~hall pay, for water furnished by the City of Lubbock to the consumer, the amounts calculated by application of the following rates to meter readings: First 3, 000 gallons of water per month $1.80 Next 2, 000 gallons of water per month • 30 per 1, 000 gallons Next 245, 000 gallons of water per month • 25 per 1, 000 gallons Next 2501 000 gallons of water per month Next 500, 000 gallons of water per month • 22 per I, 000 gallons • 20 per 1, 000 gallons Excess gallons per month • 18 per 1, 000 gallons SECTION 2. All bills shall be due and payable monthly within ten (10) days from the date rendered. SECTION 3. A minimum rate for water charged all consum.ers on meters shall be ONE DOLLAR AND 80/100 ($1. 80) per month. SECTION 4. All ordinances in conflict with the provisions of this ordin- . ): ance are hereby repealed. "-......: SECTION 5. The provisions of this ordinance shall not be construed as affecting the existing contract to furnish water to Texas Technological College. u ...., SECTION 6. The rates established by this ordinance shall be -effective to July 1952 water consumption on August 1952 billing, and remain in effect until duly changed by ordinance. SECTION 7. The fact that recent studl,es and invest igations disclose that water is being sold below cost, and maintenance and expansion demanded in the public interest requires immediate enactment of this ordinance and making the rates herein provided for effective at the earliest practicable time, and the application of such rates involves the daily operation of the Water Department as it relates to reading of some twenty thousand (ZO, 000) meters, creates an emergency requiring the suspension of all rules pertaining to the passage o~ ordinances on more than one (1) reading, and the same are hereby suspended for the preservation of public health and property, and this ordinance shall become immediately effective upon its passage and the rates applied according to the provisions of Section 6 (Six). AND IT IS SO ORDERED.
