ORDINANCE NO. 1240 AN ORDINANCE CREATING A LUBBOCK AUDITORIUM-COLISEUM BOARD, DESIGNATING THE FUNCTIONS OF SAID BOARD, INCLUDING AUTHORITY TO HOLD PUBLIC HEARINGS AND TO MAKE RECOMMENDA- TIONS TO THE CITY COMMISSION CONCERNING MATTERS PERTAINING TO THE LOCATION AND CHARACTER OF PROPOSED IMPROVEMENTS GENERALLY KNOWN AS THE LUBBOCKAUDITORIUM-COLISEUM; AND PROVIDING FOR A FINAL REPORT UPON COMPLETION OF ITS INVESTI- GATION. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. There is hereby created and established the Lubbock Auditorium-Coliseum Board, to be composed of nine (9) members, each to be a resident citizen of the City of Lubbock. The members of said Board to be appointed by the City Commission of the City of Lubbock and to hold office for the duration of the Board and until its final report has been made to the City Commission or until said Board is relieved of the responsibilities here imposed by the City Commission. SECTION 2. If for any reason any member of said Board shall vacate said membership by voluntary withdrawal, incapacitation or otherwise, the City Commission will immediately appoint a successor. SECTION 3. No salary or compensation of any kind shall be paid to the members of the Lubbock Auditorium-Coliseum Bo~nd. SECTION 4. When the City Commission has duly appointed the nine (9) members who shall compose the Lubbock Auditorium-Coliseum Board, the said members shall, as soon thereafter as is practicable, meet and organize and appoint one of its members as chairman and one of its members as secretary; and it shall be the duty of the chairman to preside at all meetings of the Board, and the secretary shall keep a record of all its proceedings which shall be available and delivered to the City Commission upon request, for its inspection and review. SECTION 5. Any and all recommendations made by said Board to the City Commission shall be by the concurring vote of not less than five (5) members of the Board; provided, however, this provision shall not exclude a minority recommendation, which is hereby authorized to be made in writing by less than a majority of the members of said Board, and a majority of the total membership of said Board shall constitute a quorum for the transaction of all matters to be considered by said Board; and timely notice of each meeting of said Board shall be given each member. SECTION 6. The Lubbock Auditorium-Coliseum Board is hereby author- ized and requested to investigate, explore and study probable locations for the proposed LUBBOCK AUDITORIUM-COLISEUM, to hold public hearings at such times as the Board may deem expedient for the purpose of considering propo- sals submitted by interested groups and organizations with reference to the type, kind and character of both location and auditorium-coliseum; and to timely consider all pertinent matters and make such recommendations with II . . I ? ,-.! respect thereto as is by said Board deemed for the best interest of the City of Lubbock as a whole. When any such recommendation made by the Board is found by the City Commission to be final, the Board shall thereby be dissolved and its members relieved of all responsibilities imposed by membership thereon • SECTION 1. The following officers of th~ City of Lubbock shall be ex officio members of said Board without voting privileges, and shall act in an advisory capacity to the Board: The City Manager & City Planning Engineer The fact that there is an immediate need for study and consideration of all matters pertaining to the location and type of construction of the proposed Lubbock Auditorium-Coliseum creates an emergency, requiring the suspension of all rules that ordinances be read on more than one day, and said rules are hereby suspended and this ordinance shall become effective immediately upon its passage. AND IT IS SO ORDERED.
