WHEREAS, the operators of various aircraft have recently engaged in conduct over the City of Lubbock in a manner extremely hazardous to the operators of such aircraft and to persons and property within the corporate limits in disregard of public safety, endangering the lives of persons within the corporate limits, creates an emergency requiring the immediate passage of this ordinance; THEREFORE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. It; shall be unlawful for any person to take' off or land, or being the owner of any aircraft, to permit or authorize the taking off or landing ' of ·any aircraft within the corporate limits of the City of Lubbock, unless said aircraft shall be taking off or landing from an airport that has been previously approved and designated by the Lubbock Municipal Airport Board as a public airport. SECTION 2. It shall be unlawful for any person to take off or land any aircraft, or, being the owner of such aircraft, to kno'lo\iingly permit the taking off or landing of any aircraft in such close proximity to the corporate limits of the City of Lubbock as to require flight of said aircraft below one, thousand (1, 000) feet above the surface over the City of Lubbock, unless such' take -off or landing of any such ai-rcraft be from an airport previously approved and designated by the Lubbock Municipal Airport Board as a public airport. SECTION 3. It shall be unlawful for any person to operate any aircraft over the City of Lubbock at an altitude less than that altitude which will permit a landing outside the congested area in the event of a compl~te power failure, but in no event at an altitude of less than one thousand ( 1, 000) feet above ground or water surface. SECTION 4. It shall be unlawful for any person to operate aircraft engines through acceleration or deceleration while over the City of Lubbock in such a manner as will distract, excite or disturb persons on the ground regard-less of altitude. SECTION s. It shall be unlawful for any person to perform aerobatics, or being the owner of any aircraft, to permit the performance of aerobatics in an aircraft over the City of Lubbock at any altitude. SECTION 6. Whoever shall violate any of the foregoing provisions of this ordinance shall be guilty of a misdemeanor and, upon conviction, shall be fined in any sum not exceeding Two Hundred Dollars ($200).

It being imperative that this ordinance be passed immediate-ly in the interest of public safety creates an emergency, and this ordinance shall become effective upon first reading, provided, however, that the ordin-ance shall be published in its entirety.
