R. FANNING, CONTRACTOR, FOR PAVDlG ON PARTS OF 34TH STREET FROM CANTON AVENUE SOUTH TO ELGIN AVENUE, THE ASSIGNMENT BEING LIMITED TO THE LIENS ON THE PROPERrY SP.I!X}lFICALLY DESCRIJJED IN THIS ORDINANCE, BEING PART OF PAVING UNIT NO. 857 FROM PAVING ORDINANCE NO. 917, WHICH ASSESSMENTS WERE NOT RELEASED BY ORDINANCE NO. 1072 PASSED MAY 2, 1951 WHICH RELEASED OTHER PARTS OF PAVING UNIT NO. 857, SUCH LIENS ASSIGNED BEING DESIGNATED AS UNIT 1213 UNDER GENERAL WORK ORDER (GWO) NO. 588. . WHEREAS, it was the original intention of the City of Lubbock to pave with its own forces all.of such 34th Street included in Ordinance No. 917 passed on June 6, 19491 but due to ma~ delays in connection with such project being occasioned due to annexation of areas in Southwest Lubbock, pursuant to circum-stances and in the public interest, portions of such paving program were released by Ordinance No. 1072 passed ~ 21 1951; and1 WHEREAS, the herein described properties were not released by such Ordi-nance, but held by the City of Lubbock Paving Collections Department for collection; and, WHEREAS, it was determined that pursuant to circumstances and in the public interest that such paving on 34th Street trom Canton Avenue South to Elgin Avenue would not be completed by City forces, but that such paving should be com-pleted according to City specifications by J. R. Fanning, Contractor, with the understanding and agreement that all paving liens were to be retained by the City of Lubbock until completion of such paving project and acceptance by the City of suoh completed paving and then such paving liens and special paving ·certificates to be assigned and collections made paid to J. R. Fanning, Contractor; and, WHEREAS, all of such paving as herein described has been completed by J. R. Fanning, and such paving accepted by the City of Lubbock; an~, WHEREAS, the City of Lubbock is now the legal owner and holder of all such paving liens and special assessment certificates as have not been paid, and the City Paving Collec~ions Department has collected cash on some of such paving while such liens were held by the City of Lubbock in the total sum of Tvo Thousand Seven Hundred Fifty-four and 59/100 ($2,754.59) Dollars, the property affected all lying and being situated in Lubbock, Lubbock County, Texas, amounts, and persons collected from in full for their porion ot paving, being further set out as follows to-wit: I Name s:-i. That the City Paving Collections Department is hereby autho ized and directed to turn over all cash collected on the above described propertie to J. R. Fanning, Contractor, in total amount of Two Thousand Seven Hundred Fitt~ four and 59/100 ($2,754.;9) Dollars, and the Mayor is authorized to execute an assignment of such mechanic's and assessment liens, as are now existing in the name or the City of Lubbock to J. R. Fanning to be filed with the County Clerk of Lubbock County, Texas, the properties which are affected by such liens lying and ~eing situated in the City of Lubbock, Lubbock County, Texas and the ownership, amount and characteristics of each described as follows, to-wit: Name 1Q1 Block Lela Trammel, a widow 1 1 W. That the assessment liens retained and held by the City Pav-ing Collections Department on Lot Four (4), Block One (1) of the Standard Addition of Lubbock, Lubbock County, Texas in the name of v. N. Burleson in the principal sum of One Hundred Ninety-seven and 93/100 {$197.93) Dollars shall be retained by the City of Lubbock to be collected by the City Paving Collections Department and in nowise assigned by this Ordinance. SECTION 3. This assignment Ordinance shall never be construed as in an.y manner affecting any property or as assigning assessment liens on a~ property or as releasing ~ assessments or other liens against any properties not herein specifically described. AND IT IS SO ORDERED. On motion of.
