Section ~vo (2) of Ordinance No. 564 is hereby amended to limit the time of parking in any parking zones i n the City of Lubbock, Texas to Sixty (60) minutes or such lesser time as designated for the particular parking zone, which shall read as follows: 11That in order to avoid traffic congestion and to regulate traffic and the parking of vehicles in the parts of the streets in the City; of Lubbock, Texas, described in Section 23 of this Ordinance and hereby established and created as parking meter zones, and in such other parldng meter zones as may be hereafter created by Ordinance of the C:i.ty of Lubbock, said City shall cause to be ins·talled park- i ng meters, and shall cause parking me·t:.er spaces to be designated and identified in accordance with the provisions of this Ordlnance. Sai d parking meters are to be paid for ·exclusively from the receipts from said meters. The City of Lubbock is in no way obli ga·ted to pay t he purchase prlce of said meters out of any funds, moneys or revenues of the City of LUbbock, except from the receipts received by said City from the operation of said meters as herein provided. The funds here autho:d.zecl. to be paid as a purchase pr.ice of said meters shall never be considered in determining tho constitutional statutory or o·bher legal limitations imposed upon the City with respect to its power t.o create debts. 11\'Yhen parking meter spaces are indicated by metal markers upon the sUt'fuco of tna streets in said parking meter zones, as hercJ.n pro· vi dod , and when~~~~-Bre installed adjacent t? or adjoining said reupect ive park~ng spaces, no vehicle shall rema J.n parked within nuy of said spaces within the zone or upon any of the portim1s of t ho fJtreots described in Section 23 of this Ordinance for a. longer continuous period than sixty (60) minutes at any time, between tho fi'ours of Nine 0 1 clock A. M. and Si:x; 0 1 clock P. M., on any day ·ex- cept Sundays and holidays officially designated by the Board of City Commissioners of the City of ~ubbock, Texas; provided, however, that in any parking meter zone, provided fol' by this Ordinance or any amendment her eto, wherein the time limit designat,ed for o.:ny park- ing zone is a time less than Sixty (60) minutes, such lesser "time shall bo the legal limit of time for· which a vehicle may be parked continuously in an:y such parking space. 11 SECTION 2. That Ordinance No. 564 is hereby amended by addiu~ Section 5-D, which shall read as followsl 116I:CTION 5-B. That Twenty-Four (.24) minute parking meter zones are hereby created, and that. Twenty-Four (2/~) minute parking meters shall be so situated as to display a signal sholdng legal parking wlth adjacent parking spaces, which parking spaces sha11 be identi- fi ed and desibnated by proper markings as herein provided. Each parking meter shall, by mecl:anical devi ce, begin and continue in operation from the time of deposit of two (2) one-cent United States of A':terica coins for a period of Twenty-Four (24) minutes; if one (1) such coin is deposited in said meter( it shall begin and continue in operation for a period of Twelve (12) minutes and at the e.xpiration of such time, if an additional coin is not deposited, such expire.tion shall constitut.e a parking violation; in aey event, Twenty .. Four (;21;.) minutes shall be the maximwn allonable time any vehicle shall be parkod in such space Vlithont being in violation of the provisions of this Ordinance." •. c SECTION 3. Ordinance No. 564 is hereby amended b.Y adding Section 6-B, which shall read as follows: "SECTION 6-B. That when any vehicle shall be parked in a park- ing space as herein provided, alongside of, adjacent to and ad ... joining a Twenty-Four (24) minute parking meter which is located under the provisions of this Ordinance or b.r an Amendment hereto, the owner, operator, manager or driver of said vehicle shall, up- on entering said parking space, immediately deposit Two Cents (2¢) in coins of the United States of America in the parking meter along- side of, adjacent to or adjoining said parking space, and said park- ing space may then be lawfully used by such vehicle for the purpose of parking during the parking limit of Twenty-Four (24) minutes provided for by this Ordinance of the City of Lubbock, for the por· tion of the str~et on which(said parking space is located; pro- vided, however, that One Cent (1¢) piece or penny may be used, where ·~he person so depositing One Cent piece or one (1) pe~ limits the time of his parking to not more than Twelve (12) minutes.11 SECTION 4• That Section Fifteen (15) of Parking Meter Ordinance No. 564 is hereby amended so as to limit the One Hundred Twenty (120) minutes parking m(eter zone designated in Section Twenty-Three (23) of Ordinance 564 to Sixty 60) minute parking zones, to-vdtt ~J~) "That it shall be unlawful and an offense for any person, firm or corporation operating a vehicle to allow such vehicle to remain standing or parked upon any of the streets within said parking meter zones designated in Section Twenty-Three {23) of this Ordi- nance for a longer continuous period than Sixty (60) minutes at a time between the hours of Nine O'clock A. M. and Six O'clock P. M. of any day except Sunda~and holidays officially designated by the City Conunission of the City of Lubbock, Texas; provided, ho\'tever, that in any parking meter zone designated in Section Twenty-Three (23) of this Ordinance, wherein the time limit designated is a time less than Sixty (60) minutes, such lesser time shall be the legal limit for which a vehicle may be parked continuously in such parking space." SECTION 5. That Section Sixteen {16) of Ordinance No. 564 is hereby amended 'by adding a provision requiring the deposit in parking meters of coins of the United States of America in such denominations as are required by Ordi- nance No. 564, to-wit: nThat it shall be unlawful and an offense for any person, firm or corporation operating a vehicle to park or permit to be parked or remain standing any vehicle upon any street within any parking meter space in the City of Lubbock, Texas as designated in this Ordinance, between the hours of Nine 0 1clock A. M. and Six O'clock P. M. on any days excepting Sundays and holidays designated by the City Commission of the City of Lubbock, Texas, unless the person .in charge of said vehicle shall, immediately upon entering said parking space, deposit in the parking meter adjacent to, adjoining or alongside of said parking space, coins of the United States of America of such denominations as are required by this Ordinance or any Amendment hereto, thereby causing such parking meter to dis- play a sign or signal for the period of legal parking within said parking meter zone." 0 SECTION 6. Section Eighteen (18) of Ordinance 564 is hereby amended so as to prohibit the deposit of any denomination of coin of the United States of America for the purpose of extending the parking time, to-wit: 11That it shall be unlawful and an offense for any person to de- posit or cause to be deposited in the parking meter within any of the parking meter zones as herein established any denomina- tion of coins of the United States of America for the purpose of extending the parking time of the vehicle occupying said parking space beyond tlie period of ti'~"le fixed by this Ordinance as a parking limit for the particular parking meter zone within which said parking meter is located. 11 SECTION 7. Section Twenty (20) of Ordinance 564 is hereby amended to pro· hibit the deposit of any slug, device as a substitute for a~ coin of the United States of America in any parking meter, ~o~dt: l 11That it shall pe unlawful and an offense to deposit or cause to be deposited'within any parking meter any slug, device or substitute for a coin of the United States of America as is re- quired to be deposited in a parking meter b,y this Ordinance, or any Amendment hereto.11 SECTION 8. That Section Twenty-Three (23) of Ordinance 564 and the Amend- ments thereto be and are hereby amended so as to change and modify the parking meter zones set forth therein; to change all Two (2) hour parki~ zones set forth therein to One (1) hour parking zones; to change all Twenty (20) minute (Five Cents) parking zones set forth therein to Twenty-Four (24) minute (Two Cents) park- ing zones; 'f;o create Twenty .. Four (24) minute (Two Cents) parking zones .. parallel parking; and to create a One (1) hour parki~ zone -parallel parking to include the East side of Avenue J between Fifteenth (15th) and Sixteenth (16th) Street, to- wits "A. All two (2) hour parking met er zones now existing, hereto- fore established under this Ordinance or any Amendment here- to are hereby abolished, and are hereby designated and es- tablished as one (1) hour parking meter zones. B. All Twenty (20) minute (Five Cents) parking meter zones now existing, heretofore established under this Ordinance or any Amendment hereto are hereby abolished, are hereby designated and established as TvTenty-Fou~ (24) minute (Two Cents) park- ing meter zones. C. A Twenty-Four (24) minute parking meter zone is hereby created and established in the City of Lubbock, Texas to include all zones now existing as Twenty (20) minute (Five Cents) parking meter zones. D. A parking meter zone is hereby designated and established; said parking meter zone shall embrace that part of the streets hereinafter designated which shall limit the time of p.arking as follows, to-wit-: 1. One (1) hour parking zone -parallel parking. a. All the parking spaces on the East side of Ave- nue J between Fifteenth (15th) and Sixteenth (16th) Street13. SECTION 9. Ordinance No. 564 is hereby amended by adding Section Twenty- Five-B (25-B) which shall read as follmvsa "SECTION 25-B. That the One-Cent (penny) coins required to be deposited in the parking meter, as provided herein, are hereqy levied as a Police Regulation Supe·rvision and Inspection Fee to cover the cost of inspection, supervision and regulation in- volved in the installation, operation, upkeep and maintenance of the parking space, the Twenty-Four (24) minute parking meters described herein and involved, and in checking up and regulating the parking of vehicles in the parking meter zones created hereby.11 SECTION 10. That all provisions or portions of any Ordinance"OP",Amendment thereto in conflict with the provisions of this Ordinance are hereby modified and shall be construed consistent with the provisions of this Ordinance provided that nothing herein shall ever be construed as affecting any part of Ordinance NO. 564 or any Amendment thereto except as herein expressly provided. SECTION 11. The Officer in charge is directed to place parking meters indacating the time designated on that part of the st~eets designated by Section Eight (8) hereof. SECTION 12. That any person, firm Ol' corporc.tion who shall violate or aid or abet the violation of any prbvision of this Ordinance shall, upon conviction, be fined in any s~un not exceeding Two Hundred and N0/100 (f;200.00) Dollars. SECTION lJ. That the City Secretary is hereby directed to cause publica- tion of the descriptive caption of this Ordinance, together with the penalty clause as an alternative method of publication, as provided by law. SECTION 14. That .the enactment of this Ordinance, being necessary to the public safety and to provide for a greater use of the public streets, is declared to be an emergency measure, thereby creating a public necessity that the rule requiring proposed ordinances to be presented at tVTo (2) separate meetings be dispensed with, and this Ordinance shall become effective from the date of its publication as herein provided. On motion of Commissioner Carpenter , seconded by Commissioner Morris this Ordinance was passed this ~ day of April, 1952 by the following vote.
