J-4. 0?>-13-1.952. u J.,,~ ORDINANCE NO. 1195 f 03-::z:1 -195:L....,._ __ _ AN ORDINANCE ESTABLISHING BUILDING LINES ON INDIANA AVENUE BETWEEN 34TH STREET AND 40TH STREET; PROHIBITING PLACING OF BUILDINGS OR OTHER STRUCTURES OR REPAIR OR RECONSTRUCTION BETWEEN SAID LINES IN FURTHERANCE OF WIDENING, STRAIGHTENING AND IMPROVING SAID STREET SO AS ULTIMATELY TO PROVIDE A RIGHT OF WAY EIGHTY (80) FEET IN WIDTH. WHEREAS, the City Commission finds that public convenience, safety and necessity in the City of Lubbock require that building lines, or right-of-way lines, be established on Indiana Avenue between 34th and 40th Streets, to prevent repair and replacement of structures and trees in the area between the building lines so established, such areas being ultimately required in the public interest to improve said street, and the City Commission further finds that such establishment at this time will promote economy, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. That public necessity, convenience and safety in the City of Lubbock require the extension, opening, widening, construction and improve- ment of that part of the street hereinafter designated within the building lines herein established. SECTION z. That a building line is hereby established on the East side of Indiana Avenue as follows: Starting at a point in the intersection of 34th Street and Indiana Avenue, said point being the Northwest corner of Section Sixteen (16), Block B, Lubbock County, Texas; THENCE South fifty (50) feet along the East line of said Section Sixteen (16)i THENCE East forty (40) feet along the South property line of 34th Street for the Place of Beginning; THENCE South along a line, said line being forty (40} feet from and parallel to the East line of Section Sixteen {16) a distance of 1900 feet, more or less, to the North property line of 40th Street. And a building line is hereby established on the WEST SIDE of Indiana Avenue as follows: Starting at a point in the intersection of 34th Street and Indiana Avenue, said point being the Northwest corner of Section Sixteen (16), Block B, Lubbock County, Texas; THENCE South fifty (50} feet alon-g the East line of said Section Sixteen (16); THENCE West forty (40} feet for the Place of Beginning; THENCE South along the line, said line being forty (40) feet from and parallel to the East line of Section Sixteen (16) a distance of 1905 feet. more or less, to the North property line of 40th Street. SECTION 3. The term "Building Line, 11 as used herein shall be construed o mean "Street Right-of7 \'{ay_ Line, 11 and the set-back requirements under l.oning Ordinance No. 661 shall apply in addition to the right-of-way lines, or building lines, herein established, it being the intent and purpose of the Ordinance to preserve a~lland within the building lines herein established for ultimate street purposes. SECTION 4. That no building or other struJ:ture shall be erected, re- erected, or substantially repaired. and no new structures or parts thereof shall be erected or re-erected on that part of the street herein designated within said lines herein established. SECTION 5. That all structures now extending into or being located within or between said building .lines herein established are hereby required to conform to the lines herein established within five (5) years from the effec- tiv-e date of this Ordinance. SECTION 6. That the prov1s1ons of this Ordinance prohibiting the placing of structures between the building lines herein established shall not apply to any officer, agent, employee or other person duly authori~~d by the City of Lubbock, when such work relates to utility extensions or street improvements, PROVIDED this p·rovision shall not be construed as authorizing any such per- sons to enter upon private property lying between such lines until the same has been dedicated to public use or otherwise acquired for such purpose. SECTION 7. The City Secretary is hereby directed to cause publication of the descriptive caption of this Orciinance as an alternative provided by law. AND IT IS SO ORDERED.
