AN ORDINANCE CREATING A LIBRARY BOARD• DEFINING AND
DESIGNATING THE TERM OF OFFICE OF ITS MEMBERS, PROVIDING FOR
APPOINTMENT OF ORIGINAL MEMBERS OF &A.I1l BOARD AND THEIR
SUCCESSORS, VESTING SAID BOARD WITH POWER TO INVESTIGATE AND
MAKE RECOMMENDATIONS TO THE CITY COMMISSION AS DIRECTED BY
THEM, OF MATTERS CONNECTED WITH THE CITY'S PUBLIC LIBRARY;
AND PROVIDING FOR REMOVAL OF SAID BOARD.
BE IT ORDA.JNED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK;
SECTION 1. There is hereby created and established a Library Board,
to be composed of seven (7) members, each of whom shall be resident citizens
of the City of Lubbock, Texas, and said board shall be officially designated as
the Library Board of the City of Lubbock, Texas. The members of said board
shall be appointed by the City CollUl\,i.ssion of the City of Lubbock, Texas, and
shall hold their office for a term of four (4) years, except that four (4) of the
members first selected shall hold office for terms of four (4) years, the other
three {3) members to hold terms of two (2.) years, the term. of each to be
determined by lot, and thereafter their successors shall hold office for four (4)
years and until their successors are appointed.
SECTION 2.. Upon the death .. resignation, removal or expiration of the
term of office of any of th.e members of said Library Board, the City Com-
mission shall nominate and appoint a successor as a member of said board
who shall hold h.is membership on said board for the unexpired term of the
member he is appointed to succeed, or for the period of four (4) years when
the appointment is made due to the expiration of a board member's term,
and further provided that in the event the best interests of the City of Lubbock
require the removal of any member of said board, removal of such member
shall be effected through appointment of such member's successor by unani-
mous vote of the City Commission.
S.ECTION 3. No salary or compensation of any kind shall be paid to the
members of the Library Board for their services.
SECTION 4. When the City Commission of the City of Lubbock has
~ppointed seven (7) persons to compose the Library Board of the City of
Lubbock, said board shall, as soon thereafter as is practicable, meet and
organize and shall appoint one of its members as Chairman, and one of its
members as Secretary; and it shall be the duty of the Chairman to preside at
all meetings of the Board, and the Secretary shall keep a record of all the
proceedings of said board which shall, upon the request of the C\ty Commis-
sion, be delivered to it for its inspection and review.
SECTION 5. Any and all recommendations made by said board to the
City Commission shall be by the concurring vote of four (4) members of the
Board, provided however, this provision shall not exclude a minority recom-
mendation which is hereby authorized to be made in writing by less than a
majority of the members of said board, and a majority of the total membership
of said board shall constitute a quorwn for the transaction of all matters to be
""considered by said board.
SECTION 6. The Library Board hereby created is and shall constitute
an advisory board to the City Commission of the City of Lubbock, with author-
ity to hold hearings in Lubbock, to consider and make recommendations to the
City Commission in writing from time to time on any and all matters pertain-
ing to the City of Lubbock's Public Library..System.
SECTION 7. The following officers of the City of Lubbock shall be ex
officio members of said board without voting privileges and shall act in an
advisory capa<:ity to said board:
City Manager
The fact that there is an immediate need for study and consideration of
matters involving public libraries in the City of Lubbock creates an emergency
and necessity for suspending all rules that ordinances be read on several days,
and the said rules are hereby suspended and this ordinance shall become effect-
ive upon its first reading and passage.
AND IT IS SO ORDERED.
