1 IN CONFLICT AND PROVIDING A PENALTY1 AND DECLARING AN :EMERGENCY.
\mEREAS, it has been determined that the State Health Department has es-
tablished a rule providing penalties against public water supply systems where
stock pens are maintained within fifty (50) feet of wells and/or reservoirs of
such system and the maintenance of such conditions is deemed detrimental to
public health, safety and i'ielfare, and an emergency is created, THEREFORE:
HE IT ORDAINED BY THE CITY CO:MMISSION OF TEE CITY OF LUBBOCK:
SECTION 1. That the maintenance of stock or stock pens within fifty (50) feet
of any water well or reservoir of the City of Lubbock, used for the purpose of
supplying water to t he water sys tem of the City of Lubbock, is hereby declared
to be a public nuisance.
S~CTION 2. Any person who shall mairrte.in a nuisance as provided by this ordi-
nance shall, upon conviction, be fined in any sum not exceeding Two Hundred
($200.00) Dollars.
SECTION 3. That part of any ordinance in conflict rdth t h e provisions of this
ordinance is hereby repealed.
SECTION 4. The fact that the City of Lubbock has water lvells and reservoirs
located in various parts of the City and in locations which under the Zoning
Ordinance permit keeping of stock and maintenance of stock pens, and an effort
is being made to place such pens at or ldthin fifty (50) feet of at least one
of such wells or reservoirs used for supplying \'lat er to the City water system,
creates an emergency, and this ordinance shall be effective beginning January 29,
1952, and the City Secrete.ry is directed to i.Innediately publish the descriptive
caption and penalty clause.
AND IT IS SO ORDERED. •
