ORDINANCE NO. 1176 __ ....._ __ _
AN ORDINANCE REGULATING SOLICITORS, PEDDLERS, HAWKERS,
ITINERANT MERCHANTS OR TRANSIENT VENDORS OF MERCHANDISE IN
THE CITY OF LUBBOCK; DECLARING IT TO BE A NUISANCE FOR THOSE
ENGAGING IN SUCH PURSUITS TO GO IN OR UPON PRIVATE RESIDENCES
WITHOUT HAVING BEEN REQUESTED OR INVITED TO DO SO; PROVIDING
PENALTIES FOR VIOLATION OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF ,LUBBOCK:
SECTION 1. The practice of going in and upon private residences in the
City of Lubbock, Texas, by solicitors, peddlers, hawkers, itinerant mer-
chants, or transient vendors of m e rchandise not having been requested or
invited so to do by the owner or owners, occupant or occupants of said private
residences for the purpose of soliciting orders for the sale of goods, wares
and merchandise and/or disposing of and/or peddling or hawking the same is
declared to be a nuisance and puni shable as a misdemeanor.
SECTION z. Any person, firm or corporation violating the provisions
of this Ordinance shall upon conviction thereof be fined in any amount not to
exceed Two Hundred Dollars {$ZOO).
SECTION 3. The provisions of this Ordinance shall not apply to the
sale, or soliciting of order for the sale of bread, milk, butter, eggs, meat,
vegetables or other. agricultural products grown by the seller, so far as the
sale of the commodities named herein is now authoriz ed by law.
SECTION 4. The provisi~ns of this Ordinance shall not be deemed to
repeal the requirement in City of Lubbock Ordinance No. 51Z that peddlers,
hawkers, itinerant merchants or transient vendors of merchandise shall
obtain a ~cense and pay a license fee before any person engages in such
o~cupation. All other ordinances or parts of ordinances in conflict herewith
are expressly repealed.
SECTION 5. Should any part of this Ordinance be declared unconstitu-
tional or invalid, such declaration shall not impair the remainder of the
Ordinance.
AND IT IS SO ORDERED.

Some time ago the Supreme Court of the United States upheld, for the first time, an ordinance prohibiting peddlers, etc. at private resi-dences except by invitation. This Ordinance attached is substantially the same as that approved by the Supreme Court, and covers peddlers, hawkers, itinerant merchants and transient vendors of merchandise. The ordinance requiring a license remains in effect. It i~ recommended that this Ordinance be passed now, and at a later date another ordinance may be submitted which will require these people to have a bond and meet certain other requirements before they • -:,, "-~ .... -....... + ... 1'1 ~ lirense.
