BLOCK B, LUBBOCK COUNTY, TEXAS, AND THE NORTH-SOUTH HALF SECTION UNE OF SECTION 13, BLOCK B, LUBBOCK COUNTY, TEXAS;AND ESTABLISHING THE SOUTH BUILDING LINE ON THAT PART OF 34TH STREET BETWEEN THE NORTH-SOUTH HALF SECTION LINE OF SECTION 14, BLOCK B, LUBBOCK COUNTY, TEXAS, AND THE NORTH-SOUTH HALF SECTION LINE OF SECTION 7. BLOCK B, IN THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS: AND PROHIBITING THE PLACING OF BUILD- INGS OR OTHER STRUCTURES OR REPAIR OR RECONSTRUCT BETWEEN SAID NORTH AND SOUTH BUILDING LINES, IN FURTHERANCE OF WIDEN· ING, STRAIOHTENING AND IMPROVING SUCH PARTS OF STREETS AND ESTABLISHING TIME FOR EXISTINO STRUCTURES TO CONFORM, ***ETC., 11 SO AS TO EXTEND SAID BUILDING LINES FROM AVE~:UE Q .. ON 34TH STREET EAST TO A POINT OF TANGENT BEING APPROXIMATELY 575 FEET EAST OF THE NORTH-SOUTH HALF SECTION LINE IN AVENUE H~· AND ALSO WIDENING AND RE-ESTABLISHING THE NORTH AND SOUTH BUILDING LINES BETWEEN SAID POINTS TO PROVIDE A RIGHT OF WAY NINETY (90) FEET IN WIDTH, AS WELL AS FLARED INTERSECTIONS ON 34TH STREET AT AVENUES'Q'1 AND ''H.' WHEREAS, the governing body finds that public convenience, safety_ and necessity in the City of Lubbock require that buildins linea, or ri&ht-of-way linea. be eatabliahed on that part of 34th Street extended and as described in the caption and body of this ordinance, to prevent repair and replacement of struc- tures and trees in the area between the building lines ao established, auch areas being ultimately required in the public interest to extend, open, widen and other- wise improve aaid 34th Street, and, WHEREAS, the governing body finds tba,t the establishment at this time of aueh lines will promote economy in the extension and widening of said 34th Street to the Eaat, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT public necessity, convenience and safety in the City of Lubbock require the extension, openins. wtdenina. construction and improve- ment of that part of the street hereinafter desianated within the building lines hereit~ established and as herein amended. SECTION z. THAT a building line is hereby re·eatabliahed on the North aide of 34th Street and on the South aide of 34th Street as follows: On the North aide of aaid 34th Street the building line is re-established aa follows: BEOINNINO at a point in the North-South half section line of Section Seven (7), Block B (Avenue 'H'·), Lubbock County, Texas, said point beina4 a. 5 feet Nortb of the South line of a aid Section 7, Block B; THENCE Weat a diatance of 237.5 feet parallel to and 48.5 feet diatant from the said South line of Section 7, to a point; T'f.:!ENCE Southweaterly a diatance of 100 feet more or leas to a point, aaid point being forty-five (45) feet North of the aaid South line ·of Section 7; THENCE West a diatance of Z647. 5 feet parallel to and forty-five (45) feet diatant from the said South line ·of aaid Section 7 to a point; THENCE Northwesterly a dhtance of 100 feet to a point, said point being 48.5 feet North of the said South line of said Section 7; THENCE Weat a diatance of 190 feet parallel to and 48.5 feet di8tant from the said South line of Section 7 to a point, said point being in tbe East line of A venue "0. 1 On the South side of 34th Street the buildin& line ia re-eetabliabed as follows: BEGINNING at a point in the North-South half section line of Section Eight (8), Block B (Avenue "H"), Lubbock County, Texas, aaid point beina 48. S feet South of the North line of said Section 8; THENCE West a distance of Z37. 5 ft!et parallel to and 48. 5 feet distant from the said North line of said Section 8 to a point; THENCE Northwesterly a distance of 100 feet more or lese to a point, said point being forty- five (45) feet South of the said North line of aaid Section 8; THENCE West a distance of Z647. 5 feet parallel to and forty ~five <•s) feet dis tant from the said North line of said Section 8 to a point; THENCE Southwesterly a distance of 100 feet more or lees to a point, said point being 48. 5 feet South of t he North line of said Section 8; THENCE West a distance of ZOO feet parallel to and 48. 5 feet distant from the said North line of eaid Section 8 to a point, said point being in the Eaat line of Avenue ''0. 11 SECTION 3, A building line is hereby established on 34th Street extended East, as follows: On the North side: BEGINNING at a point in the North-south half section line of Section Seven (7), Block B (Avenue H11 ), Lubbock County, Texas, said point being 48 •. 5 feet North of the South line of said Section 7; THENCE North 88° 18' West a distance of 575 feet more or leas to a tangent point of. ten degree curve on Slaton Hiahway u. s. 84, said point being 65. l5 feet North of the said South line of Section 7. On the South side: BEGINNING at a point in the North-South half section line of Section Eight (8), Block B (Avenue 'a n), Lubbock County, Texae, said point being 48. S feet South of the North line of said Section 8;' THENCE North 88° 36' West a distance of 575 feet more or lese to a tangent point of ten degree curve on Slaton Highway U. S. 84, said point being 34.75 feet South of the said North line of said Section 8. SECTION 4. The term, "buildins line," aa used herein shall be con- strued to mean 11 etreet right-of-way line, and the set-back requirements under Zoning Ordinance No. 661 shall apply in adclition to the risht-of ... way linea, or building lines, herein establi8hed, it beins the intent and purpose of the Ordinance to preserve all land within the building lines herdn eatab· liehed for ultimate atreet purposes. SECTION s. That no building or other atructul'e shall be erected, re• erected, or subatantially repaired, and no new structures or parts thereof shall be erected or re-erected on that part of the street herein designated within said lines herein eatablil!ihed. . . SECTION 6. That all structures pow extending into or beins located within or between said building lines herein establiahed are hereby required to conform to the linea herein eatablished within five (5) yeara from the effective date of this 0Tdinance. SECTION 7. That the provisions of this Ordinance prohibiting the plac- ing of structures between the buildin& lines nerein established shall not apply to any officer, agent, employee or other person duly authorized by the City of Lubbock, when such work relates to utility extensions or street improve- mente, PROVIDED this provision shall not be < onstrued as authori..:.ins any such persons to enter upon private property lying between such lines until the same has been dedicated to public use or otlle rwise acquired for such purpose. SECTION 8. The City Secretary is hereby directed to cause publication of the descriptive caption of this Ordinance as an alternative provided by law. AND IT IS SO ORD.E..RED.
